After interested parties have had the opportunity to speak, the Council may determine that the public health, safety and welfare require removal of overhead lines and the installation of underground utilities. If the district is formed, San Diego Gas and Electric will prepare plans and obtain permits. The process will take approximately one year. The dates when properties must disconnect from overhead lines and when the overhead lines will be removed will be established by Council as soon as a definite construction schedule has been established. Estimated cost of conversion is $160,000 which will be paid from the City's allocated balance of $255;333 available from San Diego Gas and Electric. Individual hook-ups of approximately $1,000 will be paid by property owners. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DECLARING AND DESIGNATING THE ALLEY EAST OF THE RAILROAD FROM ELM AVENUE NORTH TO CHRISTIANSEN WAY AS UNDERGROUND UTILITY DISTRICT NO. 9 WHEREAS, on June 4, 1985, the City Council of the City of Carlsbad, California adopted Resolution No. 8050 expressing its intent to initiate proceedings pursuant to Chapter 11.08 of the Carlsbad Municipal Code and calling a public hearing to determine the necessity for formation of an Underground Utility District in a portion of Carlsbad; and WHEREAS, pursuant to Resolution No. 8051) a public hearing was held on June 18, 1985, at 6:OO P.M. in the Council Chambers, Carlsbad, California to ascertain whether public health, safety or welfare required the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City known as the alley east of the railroad from Elm Avenue 1 north to Christiansen Way as shown on the attached Exhibit "A" attached hereto and made a part hereof; and WHEREAS, said hearing was also held to determine if the City should proceed to create and implement said underground utility district to accomplish said removal and installation; ar WHEREAS, notice of said hearing was given in the manner and time required by law to all affected property owners and utility companies; and WHEREAS, said hearing has been duly held and all interest( persons have been given an opportunity to be heard; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 I.8 19 20 21 22 23 24 25 26 28 27 0 W NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1) That the above recitations are true and correct. 2) That the Council of the City of Carlsbad hereby finds and determines that the public health, safety and welfare requ the removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication or simila or associated service in the above described area, 3) That said area is hereby declared to be Underground Utilit District No. 9 of the City of Carlsbad more clearly define as the alley east of the Railroad from Elm Avenue north to Christiansen Way. 4) That the City finds that said district is in the public interest since the right-of-way within the district is extensively used by the general public. That the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 9 of the adoption of this resolution within five (5) days after the date of such adoption. Such notification shall be made by mailing a copy of this resolution together with a copy of Chapter 11.08 of the Carlsbad Municipal Code to affected property owners as shown on the last equalized assessment roll and to affected utility companies. 5) 6) That the City Council hereby orders overhead removal and underground installation within said district. The City Council will fix by subsequent resolution the time within which such removal and installation shall be accomplished and within which affected property owners must be ready to receive underground service. WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provide for the formation in the City of Underground Utility Districts to accomplish the orderly removal of existing overhead facilities and the construction of new underground facilities; and WHEREAS, City staff has consulted with affected utilities- on the feasibility of such a district in the alley east of the Railroad from Elm Avenue north to Christansen Way; and WHEREAS, preliminary staff studies indicate further proceedings pursuant to Chapter 11.08 are warranted; NOW, THEREFORE, BE IT RESOLVED by the City of Carlsbad, as follows: 1) The Council hereby expresses its intent to initiate proceedings for the formation of Underground Utility District No. 9. I 2) Notice is hereby given that a public hearing will be held by the City Council of the City of Carlsbad on June 18, 1985, at the hour of 6:OO P.M. in the Council Chamber of the City Hall, Carlsbad, California, to ascertain whether the public health, safety, or welfare require removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communications, or similar associated service in the area hereinabove described and to determine if the City should continue proceedings to create and implement and underground utility district to accomplish said removal and installation. /I// ///I -.- 1 2 3 4 5 6 7 8 9 10 11 12 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 w 0 3) At said hearing, all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. The area to be included within the proposed District No. 9 is shown on the location map attached hereto and made a part hereof.
