TIME-LOCK GATE AT BEACH ACCESS LB# 84 177 RECOMMENDED ACTION: If Council supports the appeal by Sally Vigil, then action would be to instruct staff to present a proposal to the Coastal Commission request- ing permission to install a time-lock gate at the Christensen Way beach access. It is further recommended that the costs and installation be paid for by the property owner. BACKGROUND Mrs. Sally Vigil contacted the Parks and Recreation Department regarding the possible closure or installation of a time-lock gate at the Christensen Way beach access. This item was referred to the Parks and Recreation Commission for discussion at their meeting on April 15, 1985; Although staff could not support closure, they recommended to the Commission that the gate be installed for the following reasons: 1. Location of buildings. The buildings and homes are 2. Vandalism to nearby private structures. 3. Local residents have been terrorized by late 4. Additional beach access exists both to the north and 5. Limited parking exists in the area. 6. Nearby residents may reimburse City for installation costs. In addition, they recommended to increase the Police Department enforcement and suggested that adequate lighting be installed by the property owners. Mrs. Vigil's appeal is to ask the City Council to consider overruling the decision of the Parks and Recreation Commission and to approve the installation of a time-lock gate. FISCAL IMPACT The price of a time lock gate is approximately $2,000. Staff recommends that the costs and installation-be paid for by the property owners. EXHIBITS : 1. The specific problem. is one of vandalism and abuse to property and residents. As you know, lifeguard service has never been provided in this area and with the renewal of beach sand, foot traffic has tremen- dously increased. The total area in question encompasses approximately 3/4 miles running from Pine Street to Buena Vista and is inclusive of several other beach access points. Because this is one of the early access sites, buildings are close to one another and this has caused an invasion of privacy for the residents as well as the motel visitors. Given the amount of parking available in the area, we believe there are more than adequate access points available for the beachgoer. Because this access point falls under the purview of the City of Carlsbad, we ask that consideration be given to closing this throughway: and, at the very least, the City should request that the access point be closed to the public during the evening and early morning hours. Your assistance in this matter will Sincerely, Ass ernb lyman , 7 4th District 9 .L 3 .- EXHIBIT 3 BEACH ACCESSES EXHIBIT 4 f 13 I’ .. The reasons for a time-lock gate were clearly stated in staff's report. It has been my observation that the greatest number of violations; i.e. vandalism, fires, and broken bottles, occur during the late night and early morning hours. alone would more than pay the cost of installation. The time/cost savings factor to the police Therefore, I support the staff recommendations with the exception of item #6. It is my opinion that the initial cost be the responsibility of the city as one more step in recognizing the beach community as a "special treatment area".
