TITLE APPEAL OF INSTALLATION OF DEPT. HD. TIME-LOCK GATE AT BEACH ACCESS LB# 84 177
RECOMMENDED ACTION:
If Council supports the appeal by Sally Vigil, then action would be to
instruct staff to present a proposal to the Coastal Commission request- ing permission to install a time-lock gate at the Christensen Way beach access. It is further recommended that the costs and installation be paid for by the property owner.
BACKGROUND
Mrs. Sally Vigil contacted the Parks and Recreation Department regarding
the possible closure or installation of a time-lock gate at the
Christensen Way beach access. This item was referred to the Parks and
Recreation Commission for discussion at their meeting on April 15, 1985;
Although staff could not support closure, they recommended to the

Mrs. Vigil's appeal is to ask the City Council to consider overruling
the decision of the Parks and Recreation Commission and to approve the
installation of a time-lock gate.
FISCAL IMPACT
The price of a time lock gate is approximately $2,000. Staff recommends that the costs and installation-be paid for by the
property owners.

Dear Mr. Mannon:
In accordance with our conversation, this letter is to formally
request that the proposed time/locked gate to be installed on
Christenson Way beach access, be placed on the on City Counsel
Agenda for June 18, 1985 at 6:OO p.m.
As discussed, I represent Dr. Josebh Vigl and his wife, Sally
who are adjacent property owners to the access. The reason that
this request to place the issue on counsel is being made, following
staff recommendations from Park and Recreation. If approval is
given, Parks and Recreation staff must then present a proposal
to the Coastal Commission seeking their approval as well.

Dear Mr. Bradstreet:
For several months we have worked with constituents who express concern
regarding the beach access located to the north side of 2805 Ocean
Street -- directly adjacent to the Tony Howard-Jones Best Western.
The specific problem. is one of vandalism and abuse to property and
residents. As you know, lifeguard service has never been provided in this area and with the renewal of beach sand, foot traffic has tremen-
dously increased.
The total area in question encompasses approximately 3/4 miles running
from Pine Street to Buena Vista and is inclusive of several other beach
access points. Because this is one of the early access sites, buildings
are close to one another and this has caused an invasion of privacy for
the residents as well as the motel visitors. Given the amount of parking
available in the area, we believe there are more than adequate access
points available for the beachgoer.
Because this access point falls under the purview of the City of Carlsbad,
we ask that consideration be given to closing this throughway: and, at
the very least, the City should request that the access point be closed
to the public during the evening and early morning hours.

Dear Council Members:
I am writing in opposition to the Flanning Commission's
denial and in support of city staff's recommendation to
install a time-lock gate at the Christiansen Way beach access.
The reasons for a time-lock gate were clearly stated
in staff's report. It has been my observation that the
greatest number of violations; i.e. vandalism, fires, and
broken bottles, occur during the late night and early
morning hours.
