RECOMMENDED ACTION:
The Planning Commission and staff are recommending that the City Council introduce Ordinance No. 9763 , APPROVING ZC-330.
ITEM EXPLANATION
The proposed zone change as initiated by the Planning Commission
would change the zoning from C-2 to C-2-Q on 4.56 acres located
at the southwest corner of La Costa Avenue and Rancho Santa Fe
Road (map attached). The Q-Overlay zone would require the
submittal of a site development plan to be approved by the Planning Commission prior to the issuance of any building permits.
Both the Planning Commission and staff felt that site review was
necessary for this area because of the sensitivity and visibility
of the property. A site plan will ensure proper driveway spacing
on arterial streets, compatibility with surrounding land use, and
quality design. Most of the other commercial sites in the city
have site plan review. For further information please see the attached report to the Planning Commission.

development will be constructed and paid for by the developer.
Increased operating expenses related to this development will be
offset to some extent from increased tax or fee revenue generated
by the development. No detailed economic impact analysis of this
development has been conducted at this time so predictions of the portion of operating expenses covered by additional operating revenue created as a result of this project cannot be made.

The Land Use Planning Manager has determined that this project

The City Council of the City of Carlsbad, California, does

SECTION 1: Title 21 of the Carlsbad Municipal Code is
imended by the amendment of a zoning map for a zone change from C-2
to C-2-0 on property as shown on the map marked ZC-330, Exhibit "A",

EFFECTIVE DATE: This ordinance shall be effective thirty

APPROVAL OF A ZONE CHANGE FROM C-2, GENERAL
COMMERCIAL TO C-2-Q, GENERAL COMMERCIAL WITH A
QUALIFIED DEVELOPMENT OVERLAY ON PROPERTY
GENERALLY LOCATED ON THE SOUTHWEST CORNER OF
THE LA COSTA AVENUE AND RANCHO SANTA FE ROAD
INTERSECTION,
APPLICANT: CITY OF CARLSBAD
CASE NO: ZC-330
WHEREAS, a verified application for certain property, to
wit:
Lot 249 of Map 7457 La Costa Vale Unit No. 1,
has been filed with the City of Carlsbad, and referred to the
Planning commission; and
WHEREAS, said application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 8th day of
May, 1985, hold a duly noticed public hearing as prescribed by law
to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Zone Change; and

The proposed zone change to C-2-0, General Commercial with a Qualified Development Overlay, is consistent with the General Plan designation of C, Community Commercial.
The proposed zone change from C-2 to C-2-0 would not result in
any adverse impacts to the subject property or surrounding properties since the addition of a Q Overlay upon the property will not increase the uses allowed by the existing C-2 zone.
Implementation of the Q Overlay zone will serve to reduce
adverse impacts to the subject property and to surrounding uses in that additional setbacks, landscaping, access and design regulations will be placed over the subject property associated with the site development plan review required with the Q-Overlay zone.
This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land Use Planning Manager on April 11, 1985 and approved by the Planning Commission on May 8, 1985.

SUBJECT: ZC-330 - CITY OF CARLSEAD - Request for a zone change from C-2 to C-2-Q for a 4.56 acre site located at the southwest corner of the La Costa Avenue and Rancho Santa Fe Road intersection.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2435 recommending APPROVAL of ZC-330 based one findings contained therein.
11. PROJECT DESCRIPTION
The requested zone change would change the zoning on the subject
4.56 acre site from C-2, General Commercial, to C-2-Q, General Commercial with a Qualified Development Overlay. This rezone to
C-2-Q would supplement the underlyinq General Commercial Zone
with additional regulations for the express purpose of ensuring that any future commercal development of the project site is; compatible with surrounding uses, both existing and proposed, is sensitive to environmental factors, will not adversely affect
traffic circulation, and incorporates design treatments which promote a positive visual image, design continuity, and a sense of community and well being. As stipulated under. Chaps-er 21.06 of Title 21, the Q-Qualified Development Overlay Zone requires that a site development plan must be approved by the Planning Commission prior to the issuance of a building permit. It is through this site development plan requirement, that the subject
C-2 zoned property can be adequately reviewed to ensure a good design and the project's compatibility with adjacent land uses and project vicinity as discussed above.
The subject property is currently vacant and sparsely covered
with grasses and weeds. It is topographically situated between
3 and 8 feet below the La Costa Avenue and Rancho Santa Fe Road intersection, and as a consequence is highly visible.
The property to the north of the site, across La Costa Avenue is partially developed with single family residences. The property to the south is proposed for the developmet of the Christ united Presbyterian Church with social hall, administrative offices, Sunday school and day care center. This project is currently under construction. The property to the west, across Levante Street, is developed with multi-family residential, (Centella Meadows). The property to the east, across Racho Santa Fe Road is vacant.

Discuss ion
The subject property is designated C, Community Commercial on the City's General Plan and the La Costa Master Plan. As previously discussed, it is currently zoned C-2, General Commercial. The C-
2 zone is the implementing zone for property designated C on the General Plan. The addition of the Q, Qualified Development Overlay Zone, will not increase the uses allowed by the C-2 zone; it will, however, allow the Planning Commission the opportunity to review any future development proposed on the site through the requirement of a site development plan. As with the existing
C-2 zone, the proposed zone change to C-2-0 is consistent with the property's General Plan designation of C, Community Commercial.
It is staff's opinion that because the subject commercially zoned property is clearly visible from the surrounding Rancho Santa Fe
Road (Prime Arterial) and La Costa Avenue (Secondary Arterial), and because the property is in close proximity to high quality existing and proposed residential uses, the need for more specific design review through a site development plan is warranted. Also, this project has frontage on an arterial street and a site development plan will ensure that access points will meet City standards.
Implementation of this Q overlay zone upon the subject C-2 zoned
property will function to effectively reduce adverse impacts to the subject property and to surrounding uses in that additional
setbacks, landscaping, access and design regulations can be placed over the subject property by the Planning Commission if necessary .
In conclusion, staff believes that the proposed zone change is compatible with the General Plan and will not adversely affect any of the adjacent properties. Therefore, staff recommends approval of 2C-330.

The Land Use Planning Manager has determined that this rezone
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on April 15, 1985.
