OF LAND FOR PARK AND RECREATION
FACILITIES CITY MGR.
If the City Council wishes to increase the standard for the
dedication of land for park and recreation facilities from 2.5 acres of property for each 1,000 persons to 3 acres your action
is to introduce Ordinance No. 7770 .
ITEM EXPLANATION
The City Council has directed staff to implement the
recommendation of the Land Use Committee that the standard for
the dedication of land for park and recreation facilities be
increased from 2.5 acres to 3 acres for each 1,000 persons. The Subdivision Map Act and the Park and Recreation Element of the General Plan already provide authority for the 3 acre standard. The only action necessary to implement the recommendation is to amend one section in Chapter 20.44 of the Carlsbad Municipal
Code. An ordinance in that regard is attached.
The increase in the amount of land to be dedicated or the
increase in fees, where the Council has determined to take money
in lieu of land, would apply to all projects which have not as
yet actually paid park fees. That is consistent with actions Council has taken in the past in regard to park fees. State law
and the Carlsbad Municipal Code provide that the actual amount of
fees is based on the value of the land and fixed at the time the
fees are paid which is prior to the issuance of building permits or the sale of the subdivided property, whichever occurs first.
(Lot Sale Program). Although the obligation to dedicate land or pay fees is imposed at the time of tentative map approval the
amount of the fee is not determined until building permits. All
outstanding park agreements and master plans provide for the
payment of fees (park in lieu, sewer, etc.) as they exist at the time of building permit when the fees are due. These fees are not set at the time of project approval which can be many years prior to the actual construction of the dwelling unit.

FISCAL IMPACT
The increase in the park acre standard means the city
will collect an additional 20% in fees and land
dedications. The revised land requirements per square foot and fees are as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 20, CHAPTER
20.44 OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 20.44.040 TO INCREASE THE
STANDARDS FOR THE DEDICATION OF LAND FOR PARK
AND RECREATIONAL FACILITIES.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 20, Chapter 20.44 of the
Carlsbad Municipal Code is amended by the amendment of Section
20.44.040 to read as follows:
20.44.040 Standards and formula for dedication of
land. If the City Council determines that a park or recreational facility is to be located in whole or in part
within the proposed subdivision to serve the immediate and
future needs of the residents of the subdivision, the subdivider
shall, at the time of the filing of the final or parcel map,
dedicate land for such facility pursuant to the following standards and formula:

The total number of dwelling units shall be the number permitted
by the City on the property in the subdivision at the time the
final map or parcel map is filed for approval; provided, however,
that except for subdivisions which consist of the conversion of existing buildings or mobile home parks into condominiums or
other planned developments, any existing residential unit or
units, whether or not the unit or units will be replaced, shall
be subtracted from the total.
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adopt ion.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 27th day of August I
1985, and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 3rd day of Septgnber , 1985 by the
following vote, to wit:
