RECOMMENDED ACTION:
Adopt Resolution No. f& I amending Contract No. 3085 - the Central
Business Storm Drain - by approving Change Order No. 2, approving Supplement
No. 2 to the Agreement with Fraser d( Associates and appropriating additional
funds in the mount of $307,606.00.
ITEM EXPLANATION:
Council approved the construction of the Central Business Storm Drain and
appropriated $800,000.00 in the 1984-85 Capital Improvement Program. On
August 7, 1984, Council awarded the contract for construction to the low
bidder, Peter C. David Co. for $693,480.20.
During construction, many situations occurred here existing utilities shown
on the plans were not in the locations indicated by existing records. In some
instances there were no records of the underground utilities and they were a
complete surprise when encountered. Council may be aware that State Street
was once a state highway (hence the name). The numerous underground utilities
and poor accuracy of records are not unusual circumstances in older urban
areas such as this. Unfortunately, on this project nearly every inaccuracy
resulted in another conflict with the storm drain due to the very tight
circumstances.
The work involved in Change Order No. 2 primarily due to utility conflicts
encountered due to utilities being at different locations than shown on
records includes:

Reconstruct portion of 15 inch storm drain.
Reconstruction of sewer force main.
Construct air relief valve on force main.
Adjustment of alley grade to resolve drainage problem.
Relocation of 8-inch sewer in State Street.
Install temporary sewer by-pass in State Street.
A complete list of the required changes and reasons is contained in Change
Order No. 2 attached as Exhibit 02",
In addition to the specific items of additional work identified, the con-
tractor is claiming that the changes in State Street constitute a "change in
the character of the work". As a result, the contractor states that his
construction time will be three weeks longer than anticipated and is claiming
an extra for all equipment and labor for this extra time. This mounts to
$123,000.00 and has been listed separately in Change Order No. 2 as Part B.

Because of the extension of time of the contract and the extremely difficult
negotiations with the contractor, Fraser & Associates - who are performing the
contract management, redesign and inspection services for the City - is
requesting an increase in their contract limit. Their fee will continue to be
on an hourly basis and they are requesting a second supplement to their
agreement not to exceed an additional $1 8,000.00.
The contractor, after a long absence, has resumed work and is currently
installing the storm drain in State Street. Work has started at the hena
Vista Lagoon and is moving south. The contractor has been urged by staff and
Fraser and Associates to submit a construction schedule and a completion date,
but has yet to do so. Staff is withholding further progress payments to the
contractor until the schedule is received.
FISCAL.IMPACT:
Funds in the amount of $800,000.00 have been appropriated and are available in
Account No. 881-820-3410-3085. Total actual and estimated expenses for this
project are as follows:

Change Order No. 2 $ 282,706.30
Fraser (Agreement and Supplement No. 1) $ 60,000.00
Supplement No. 2 $ 18,000.00

The addition of $307,606.00 to this project constitutes a loan to the
Redevelopment Agency from the General Capital Construct ion fund.
If Council approves Change Order No. 2 and Supplement No. 2, an additional
appropriation is required from the General Capital Fund No. to the project
Account No. 881-820-3410-3085.
Because this project will be paid for the the Redevelopment Agency and not the
City, it is exempt from Proposition H requirements.

The utilities encountered in Grand Avenue are in locations
different than that shown on the contract plans. These differences necessitated field revisions in the pipeline
alignment which in turn required the construction of sixteen concrete collars southerly of Grand Avenue.
The existing 8-inch diameter force main crossing at station
10+20 is different from that depicted on the contract plans.
This resulted in the reconstruction of approximately 120 feet
of 8-inch PVC pipe in lieu of 40 feet as would normally be
anticipated.
The utilities encountered in Grand Avenue are in locations
different from that shown on the contract plans. These differences necessitated field revisions in the pipeline alignment which in turn required the construction of five
concrete collars northerly of Grand Avenue.
The contract plans required the abandonment of an existing 15-inch diameter storm drain. Had this been accomplished, the
existing catch basins at the intersection of State Street and
Grand Avenue would have had no outlet.
The contract documents stipulate that a Type B Cleanout be constructed at station 20+00. However, the 66-inch diameter
RCP is too shallow to allow the construction of that type of
structure.
An 8linch diameter sewer force main crosses the storm drain
alignment near station 22+75. The force main is depicted in
the plan view but it is not identified in the profile view. A physical conflict existed between the sewer force main and the storm drain pipe requiring the reconstruction of the sewer force main.

An existing buried telephone conduit, a water line and an
existing 8-inch diameter sewer within State Street are located in the field differently than that depicted on the contract
plans.
The City Maintenance and Utility Department has requested that
an air relief valve be installed on the 8-inch sewer force main upstream of the reconstruction described in item f herein
above.
This has been the cause for several major revisions,
The contract drawings stipulate a finished grade for the alley
which would not properly serve the adjacent property owners.
The stipulated alley grade would also have impeded the exist- ing drainage from adjacent parcels.
The contract documents do not include any provisions for ultimate disposal of the storm water tributary to the improved alley or adjacent properties.
The contract documents, utility improvement drawings and
utility field markings denoted several of the utilities in
State Street incorrectly, The accurate field location of these facilities is necessary prior to the construction of the
storm d’rain in the immediate vicinity.
The trench backfill in the deeper portions of the project are
greater than can be safely sustained by the pipe specified,
An existing 30-inch diameter lateral was encountered conveying
storm water to an existing catch basin in Elm Avenue. This
lateral required reconstruction and reconnection to the new catch basin,
A local depression exists in the alley between Grand Avenue
and Cedar Avenue. This depression was previously served by a catch basin which was removed during the construction of this
project. A new inlet structure is required to serve this
local depression,
During a meeting, February 6, 1985, the City Engineer
requested that the existing 8-inch sewer in State Street be
excavated and located.

r. The plans and specifications did not include provisions for the adequate protection of a 36-inch vcp trunk sewer in Grand
Avenue. The weight of the storm drain pipes cannot be
sustained by the 36-inch vcp.
s. The resiting of the junction structure in Grand Avenue
necessitated resurveying of the area and also additional concrete curb and gutter work.

Construct 66-inch RCP in State Street and right-of-way between
State Street and alley westerly of State Street in accordance
with Change Order Proposal 13 and accompanying sketches 13B
and 13C all dated May 21, 1985.
Alignment of 66-inch RCP is revised as follows:
1. In order to avoid physical conflict with existing 48-
inch storm drain, the horizontal curve with EC at
approximately 1+95 shall be located northwesterly so as

labor and equipment required.
3. Reconstruction of existing 8-inch diameter sanitary sewer ,
City’s responsibility includes the following:
1, Existing 24-inch diameter storm drain, location unknown.
2. Concrete curb and gutter along easterly side of State
Street.
3, Cost of electric energy required to operate sewer by- pass pumps.
4. Increased amounts included herein are additive to the
amounts included in the bid proposal.

all in accordance with Sketch CO 3085-12 dated 5-1-85 attached

Payment thereof shall be in accordance with Bid Proposal and contract documents.

Relocate existing ditch outside of proposed fence and pavement

k. Provide equipment and labor to excavate the existing utilities in State Street at five specified lcoations. Work is to be
performed and compensated for in accordance with Subsection 3- 3.2 of the Standard Specifications (Time and Materials).
1. Where the depth of pipe, as shown on the construction grade sheets, exceeds 15 feet provide crushed rock bedding. Rock pipe bedding shall be in accordance with SDRSD S 5.1.
Payment shall be based upon certified weigh bills and include
materials, delivery, taxes and all labor and materials necessary for the placement thereof. The agreed unit price is
$21.00 per ton. The estimated quantity of rock required is
600 tons. Total estimated price is $12,600.00.
m. Reconnect existing 30-inch diameter lateral to new catch basin in Elm Avenue and repair damaged drive entrance adjacent thereto.

In the process of comple-ing the storm drain projec , 23 instances of what the Contractor contends are changed
conditions have been encountered to date.
The reach of construction between the downstream outlet and upstream thereof to Station 10+16 include the deepest
construction and the greatest utility interferences.
This reach is the most difficult and should be the slowest
to construct.
The Contractor requested that because of these alleged changed
conditions, this work should proceed in accordance with Section 303 EXTRA WORK of the contract. This section is
commonly referred to as Time and Materials.
The Engineer has agreed that this method of proceeding is
equitable providing the City could be assured of a maximum authorized amount.
A review of the Contractors payroll records as well as known
equipment rental rates indicate that the Contractors costs for each working day are approximately $8,400.00.

approximately 15 working days in excess of the time to
construct this reach of the project, had the conditions
been as represented by the contract drawings.

THE CENTRAL BUSINESS STORM DRAIN DATED MARCH 5, 1985
THIS SUPPLEMENT NO. 2 to the above,described agreement, hereunder referred
to as "Orginal Agreement", entered into as of the 3rd day of June, 1985, by and
between CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "City"
and FRASER & ASSOCIATES, hereinafter referred to as ttConsultant".
City and Consultant mutually agree to supplement the above referenced agreement
as follows:
1. PROGRESS AND COMPLETION
The work under this contract shall continue as required until completion
of the construction of the Central Business Storm Drain Project by about October 31,
1985. Extensions of time may be granted if requested by Consultant and agreed to
in writing by the City Engineer.
2. FEES TO BE PAID TO CONSULTANT
The total amount of fees to be paid to Consultant under the Original
Agreement dated March 5, 1985 Supplement No. 1 and this Supplement No. 2 shall
not exceed the sum of $78,000.00
3. PAYMENT OF FEES
Payment of fees shall be on a monthly basis. Those fees shall be based
on the hourly rates and direct costs contained in Section 5 of the Original
Agreement.
4. EFFECTIVE DATE
This Supplement No. 2 shall be effective on and from the day and year
first above written.

f. Construct temporary force main sewer by-pass and reconstruct interfering portion of existing 8-inch diameter ACP force mair,
in accordance with Sketch C.O. 3085-4. Reference Change Order Proposal Number 4 dated April 4, 1985.
g. Construct 66-inch RCP in State Street and right-of-way between
State Street and alley westerly of State Street in accordance
with Change Order Proposal 13 and accompanying sketches 13B
and 13C all dated May 21, 1985.
Alignment of 66-inch RCP is revised as follows:
1. In order to avoid physical conflict with existing 48-
inch storm drain, the horizontal curve with EC at
approximately 1+95 shall be located northwesterly so as

to provide approximately 5 feet of clearance between the two storm drains.
Alignment in State Street shall be approximately 27 feet easterly of west curb in lieu of 22 feet as snown on the contract plans.
Alignment between approximate stations 8+00 and 9+20
shall be located two pipe lengths (16 feet) southerly of
that shown on the contract plans.

I. Relocate 66-inch RCP storage area $ 2,400.00
2. Temporary sewer by-pass 31 ,400.00

Total Amount $ 66,600.00
Contractors responsibility includes the following:
I. Relocate stock piling of 66-inch RCP as requested by
representative of Carlsbad Police Department.
2. Installation, operation, maintenance and removal of
approved sewer by-pass. Facility to include duty pump, stand-by pump, emergency stand-by generator and all
labor and equipment required.
3. Reconstruction of existing 8-inch diameter sanitary
sewer.
City's responsibility includes the following:
1. Existing 24-inch diameter storm drain, location unknown.
2. Concrete curb and gutter along easterly side of State
Street.
3. Cost of electric energy required to operate sewer by-
pass pumps.
4. Increased amounts included herein are additive to the
amounts included in the bid proposal.

h. Construct sewage air relief structure with air relief valve
all in accordance with Sketch CO 3085-12 dated 5-1-85 attached
hereto.
i. Construct alley grade, cross-section and drive entrances in accordance with Sketch F.0.-2 dated May 10, 1985 in lieu of
profile identified on contract plans.
Payment thereof shall be in accordance with Bid Proposal and contract documents.
j. Construct one Catch Basin Type.1, one Catch Basin Type F and
24-inch RCP at low point in alley, Station 16+85 in accordance
with Sketch PCO 16-B dated June 18, 1985 attached hereto.
Relocate existing ditch outside of proposed fence and pavement
area in accordance with Sketch PCO 16-A dated June 18, 1985
attached hereto.
k. Provide equipment and labor to excavate the existing utilities in State Street at five specified lcoations. Work is.to be
performed and compensated for in accordance with Subsection 3- 3.2 of the Standard Specifications (Time and Materials).
1. Where the depth of pipe, as shown on the construction grade sheets, exceeds 15 feet provide crushed rock bedding. Rock pipe bedding shall be in accordance with SDRSD S 5.1.
Payment shall be based upon certified weigh bills and include materials, delivery, taxes and all labor and materials necessary for the placement thereof. The agreed unit price is
$21.00 per ton. The estimated quantity of rock required is
600 tons. Total estimated price is $12,600.00.
m. Reconnect existing 30-inch diameter lateral to new catch basin in Elm Avenue and repair damaged drive entrance adjacent
thereto.
n. Construct inlet structure Type 1 per drawing D-29.1 on the existing 66-inch RCP at the local depression near Station
24+00.

REASON/PURPOSE FOR CHANGE:
An existing buried telephone conduit, a water line and an existing
8-inch diameter sewer within State Street are located in the field differently than that depicted on the contract plans. This has
been the cause for several major revisions.
This is a companion to item g of Part A, but is being presented
separately for clarity,
ENGINEER'S RECITAL:
a. In the process of completing the storm drain project, 23
instances of what the Contractor contends are changed conditions have been encountered to date.
b. The reach of construction between the downstream outlet and
upstream thereof to Station 10+16 include the deepest
construction and the greatest utility interferences.
This reach is the most difficult and should be the slowest
to construct.
c. The Contractor requested that because of these alleged changed
conditions, this work should proceed in accordance with Section 303 EXTRA WORK of the contract. This section is
commonly referred to as Time and Materials.
d. The Engineer has agreed that this method of proceeding is
equitable providing the City could be assured of a maximum authorized amount.
e. A review of the Contractors payroll records as well as known
equipment rental rates indicate that the Contractors costs for each working day are approximately $8,400,00.

f. It is estimated that these conditions will require
approximately 15 working days in excess of the time to
construct this reach of the project, had the conditions
been as represented by the contract drawings.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING CONTRACT NO. 3085, CENTRAL BUSINESS
STORM DRAIN, BY APPROVING CHANGE ORDER NO. 2, APPROVING
SUPPLEMENT NO. 2 TO THE AGREEMENT WITH FRASER & ASSOCIATES
AND APPROPRIATING ADDITIONAL FUNDS.
WHEREAS, funds in the amount of $800,000.00 are available for the
Central Business Storm Drain in Account No. 881-820-3410-3085; and
WHEREAS, Contract No. 3085 was awarded by the City Council to the
Peter C. David Company on August 7, 1984 in the amount of $693,480.20 and
Change Order No. 1 was approved by Council on June 4, 1985; and
WHEREAS, an Agreement between the City of Carlsbad and Fraser &
Associates was approved by the City Council on April 9, 1985 in the mount of
$35,000.00 Supplement No. 1 to said agreement was approved by Council on
June 18, 1985;
and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. Change Order No. 2 in the amount of $282,706.30 on file in the
Engineering Department is hereby approved.
3. Supplement No. 2 to the Agreement between the City of Carlsbad and
Fraser & Associates, on file in the Engineering Department and made a part
hereof, is hereby approved.
4. Funds in the amount of $307,606.00 are hereby loaned to the
Redevelopment Agency from the General Capital Construction fund at an annual
interest rate of 10% per annum to be repaid to the General Capital
Construction fund from tax increment revenues received by the Agency. These
funds are hereby appropriated to Account No. 810-820-3410-3085.
