That the City Council adopt Interim Ordinance No. 9771 (four- fifths vote required).
ITEM EXPLANATION
At your meeting of August 8, 1985 the City Council adopted Interim Ordinance No. 9766 establishing temporary land use
controls to implement the recommendations of the Citizen's Committee for the review of the Land Use Element of the General Plan. As a part of that action, the Council set the matter to public hearing to consider whether or not to extend the control for an additional period not to exceed ten months and fifteen days.
The ordinance requires applications to comply with the
Committee's recommendations as approved by the City Council.
Consistent with your action of August 6, 1985, Section 2 of thc
ordinance grandfathers projects under the old density ranges
that have 1) already received approval of the specific density
and which have all other discretionary approvals and 2) which have been scheduled for public hearing before the Planning Commission or the City Council as shown on a list prepared by the Land Use Planning Manager which is attached as an exhibit the ordinance. Where to draw the line in terms of the effectiy date is a matter for the judgment of the City Council and you may wish to consider revising section 2 of the ordinance as thc City Council considers appropriate.
ENVIRONMENTAL REVIEW
The proposed ordinance is an urgency measure and exempt from
environmental review (Section 15269(c)).

AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA ADOPTED AS AN URGENCY
MEASURE ESTABLISHING TEMPORARY LAND USE CONTROLS
PENDING CONSIDERATION BY THE CITY COUNCIL OF ZONE
CODE AMENDMENTS, ZONE CHANGES AND GENERAL PLAN
AMENDMENTS AS RECOMMENDED BY THE CITIZEN'S COMMITTE
FOR THE REVIEW OF THE LAND USE ELEMENT OF THE GENEF
PLAN.
The City Council of the City of Carlsbad does ordai
follows:
WHEREAS, the Citizen's Committee studying revisions
the Land Use Element of the General Plan has prepared a repc
for the City Council making a series of recommended changes
the zone code, zoning ordinances and general plan of the Cit
Carlsbad; and
WHEREAS, the City Council has adopted the
recommendations of the Citizen's Committee with certain
additions and changes and indicated their intention to consi
making the changes to the City's land use regulations to
implement those regulations; and

1 WHEREAS, the City Council at their meeting of Augus

recommendations to impose interim controls to insure that th
public health, safety and welfare are protected by requiring
applications for development to comply with the Committee's
recommendations so that the City Council's considerations in

WHEREAS, the City Council at their meeting of Septe

desiring to speak determined that the public health, safety
welfare require that the interim controls be extended and no
exceed a period of ten months and fifteen days.
WHEREAS, this ordinance is adopted pursuant to Sect
65858(a) of the California Government Code,
NOW, therefore, the City Council of the City of Car
does ordain as follows:
SECTION 1: No tentative subdivision map, tentative
parcel map, conditional use permit, planned development perm
site development plan, specific plan, variance, redevelopment
permit, site plan, coastal development permit, zone change,
general plan amendment, final map, parcel map, certificate 01
compliance, grading permit, building permit, master plan or
master plan amendment or development permit processed pursuar
to an adopted master plan shall be approved unless the final
decision making body finds that approval of the permit, plan,
change or amendment is consistent with the report of the
, Citizen's Committee for the review of the Land rJse Element of ' Carlsbad General Plan dated July 1985 on file with the City C
and incorporated herein by reference, as adopted and suppleme

SECTION 3: As stated in the committee report as adc

has been adopted pursuant to the provisions of Title 21 of tl
Carlsbad Municipal Code prior to the effective date of this
ordinance. However, all other aspects of the report as adopt
by the Council shall apply to the master plan areas.
DECLARATION OF URGENCY: This ordinance is hereby
declared to be an emergency ordinance adopted as an urgency
measure to protect the public health, safety and welfare and
shall take effect immediately upon its adoption. The facts
constituting the emergency are set forth above and represent

immediately upon passage and shall be of no further force and
effect after July 20, 1986 unless extended by Council prior
