RECOMMENDED ACTION: Both the Planning Commission and staff are recommending that t city Council direct the City Attorney's Office to prepare docu APPROVING GPA/LU 85-7, and introduce Ordinance No. 777r , PLN APPROVING ZC-337. ITEM EXPLANATION In 1983 the City Council approved a 20-unit tentative map (CT on appeal for a project located on the south side of La Costa Avenue, west of La Coruna Place. At that meeting, a nuder of residents on La Coruna Place spoke against the project. On May 3, of this year, the City Council considered a map exteI request for CT 83-5. A nurriber of residents spoke against the extension. The City Council denied the extension and directed staff to investigate the appropriateness of the existing RMH (5 to 15 du's/acre) land use designation. The existing General Plan designation on this property was established by the county prior to annexation to the City of Carlsbad. In reviewing the land use for this property staff fe there were a number of reasons why the density is too high. Th property is extremely steep and only a portion is usable. Beca La Costa Avenue is a secondary arterial and the property is ver. steep along the La Costa frontage, access to the site comes froj La Coruna, a street which contains only single family residence Staff does not feel accessing a multiple-family project through rural single family oriented cul-de-sac is appropriate. Becaust these reasons staff feels that the property should be the same designation as the adjacent La Coruna area. This area is designated RLM (.1-4 du's/acre) with a corresponding zone of R-. 7500. If this General Plan Amendment and zone change are appro\ a maximum of 6 dwelling units could be proposed on the property. The Planning Commission concurred and recommended approval at t? meeting of August 28, 1985. For further information please see attached staff report to the Planning Commission. E NVI RONMENTAL IMPACT The Land Use Planning Manager has determined that this project ~r not cause any significant environmental impacts and, therefore, issued a Negative Declaration, dated August 10, 1985, which was approved by the Planning Commission on August 28, 1985. RECOMMEND AT I ON It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land use Planning Manager ar ADOPT Resolution Nos. 2478 and 2479 recommending APPROVAL of GPA/LU 85-7/ZC-337 , based on the findings contained therein. 11. PROJECT DES C RI PT I ON On May 25, 1983, the Planning Commission approved a request for a 20-unit tentative tract map and condominium permit on the subject property located as described above (Planning Commissic Resolution No. 2122). During the course of the Planning Commission meeting on May 25, 1983, several residents living nc the proposed project, spoke in opposition to the project becaui they felt it would impact the single-family character of La Coruna Place which is located immediately east of the project site. The project as proposed would have to take access off o La Coruna Place, thereby creating potential traffic nuisance impacts to the existing single-family residences located along this short cul-de-sac. Staff could not recommend the project taking access from La Costa Avenue which is located immediatel: north of the site, for traffic consideration reasons since it a secondary arterial. Also, the topography along La Costa Avenue is too steep for a driveway. Following the Planning Commission's original decision, the project was appealed to the City Council by adjacent neighbors The Council, however, upheld the Planning Commission approval a 3-2 vote. On May 3, 1985, the applicant, in a letter to the City Enginee requested a one-year time extension for CT 83-5, which was due expire on May 25, 1985, On June 11, 1985, the City Council denied this request for a one-year extension of time for tentative map (CT 83-5) for this project. During this hearins number of adjacent neighbors again spoke in opposition to the project relative to the potential compatibility problems this project could pose for adjacent single-family residences. 0 0 Eecause of the potential compatibility problems with adjacent single-famiy residential uses, the City Council directed staff to review the compatibility of the General Plan designation and zoning on the subject property with adjacent properties. 111. ANALY S I S 1) Is a land use designation of RLM (Residential Low Medium Density) more appropriate for the site than the existing RMH (Residential Medium High Density) des iqna t ion? 2) Would the uses allowed by the the RLM General Plan 3) Is the proposed zoning consistent with the General designation be compatible with surrounding uses? Plan? 4) Would the proposed zoning be consistent and compatible with surrounding zoning? DISCUSSION The proposed General Plan amendment would be from RFH (Residential Medium High) to RLM (Residential Low Medium) as shown on Exhibit "A". The General Plan designations and development surrounding the subject property includes; RLM and single-family homes to the north (across La Costa Avenue), RM i duplexes to the south (on top of a hill), with single-family . residences located to the east along La Coruna Place, and on a similar, steeply sloping'lot as the project site RMP and vacant to the west. The subject 1.58 acre project site is severely constrained by steep topography. Approximately 50 percent of the site is unbuildable. As discussed earlier in this report, the propert3 is also constrained in that it can only take access from La Coruna Place which runs through an existing single-family neighborhood to the east. It is staff's opinion that because the project site is so topographically constrained and because it is located adjacent to an existing single-family residential neighborhood, through which access must be taken, the proposed RLM General Plan designation would be more appropriate for the site. By redesignating the site to RLM, potential compatibility problem with the adjacent single-family neighborhood to the east, including, traffic nuisance impacts and effects on the existin single-family neighborhood character, could be mitigated. In addition, it is staff's opinion that because of the steep topography of the subject property, the higher density RMH des igna t ion is not appropriate. -2- 0 0 Redesignating the property to RLM and rezoning the property to R 1-7500 would allow for between one and six single-family dwellin units to be developed upon the property. This intensity of development and single- f amily residence product type would be more compatible and consistent with surrounding land uses, in particular those single-family neighborhoods to the north and th east. Approval of development even at the high end of the RLM designation (6 du/ac) wocld generate approximately 100 fewer trips per day through the existing single-family neighborhood located alonq La Coruna Place, than the previously approved 20- unit subdivision. As shown on Exhibit "A", the R-1-7500 zoning proposed for the property would be consistent with the General Plan. The R-1- 7500 zone would implement the RLM (0-4 du/ac) designation. The proposed R-1-7500 zone would also be consistent and compatible with surrounding zoning. Properties to the north and east are zoned R-1-10 and R-1-7500 respectively. Property to the south is zoned R-2 and property to the west is zoned RD-F. Overall, staff believes that the proposed RLM General Plan amendment would be more appropriate for the site than the existing RMH designation. In addition, the proposed zone changl to R-1-7500 is consistent with the General Plan. Therefore, staff recommends approval of GPA/LU 85-7/2C-337. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this General Plan amendment and rezone will not have a significant impact on the environment and, therefore, has issued a Negative Declarati on August 10, 1985.
