RECOMMENDED ACTION:
Approve the refund of the following fees:
Homes By Polygon $14,542.22

The following fees have been collected by the City and should be
refunded to the appropriate parties:

FISCAL IMPACT:

$14,542.22
REASON
Due to error on the Builders
part 20 permits were recently
issued to Polygon Homes based
on plans for La C.resta(phase
B) 84-238 when in fact the
builder intended to build homes
as submitted under toe file Las,
Brisas (phase A) 83-548. This
error resulted in an over pay-
ment of building permit fees.
The Building Director has
reviewe~ this request and
recommends this refund.
Any refund of fees reduces the amount of revenue available to the
city: however, the city may not retain fees collected in error,
collected for ser¥ices ~hich cannot be rendered, or collected with
the intention of using said fees for a deposit to guarantee the
completion of a task once the task is completed.
