CITY BOUNDARY CITY AllY OFFSHORE LAFCO RECOMMENDED ACTION: That the City Council approve the proposed realignment of Carlsbad City boundary in the south western offshore area. BACKGROUND: The State Lands Commission which has boundary approval authority for tidelands, submerged lands and state owned territory has notified LAFCO that Carlsbad's boundary must be realigned to conform with State law. The boundary in questions was included in the 1985 annexation of the Batiquitos Lagoon. The change would remove 1,054 acres of submerged ocean land from Carlsbad. Staff has no objection. FISCAL IMPACT: None. Processing costs will be paid by LAFCO. Harmon, Jr. Frank Aleshire, City City of Carlsbad 1200 Elm Avenue Manager As discussed in your recent conversation with Mike Ott, LAFCO'S approval of the Hunt Properties Incorporated (HPI) Reorganization (Ref. No. R084-8), resulted in the extension of the off shore portion of Carlsbad' s city boundary in a southwest direction (see attached map). The State Lands Commission, which has boundary approval authority for tidelands, submerged lands, and state owned territory, has notified LAFCO staff that Carlsbad ' s off shore boundary must be realigned in a westerly direction to be consistent with the requirements of state law. As specified in Government Code Section 35009, the lands commission can require that extensions of municipal boundaries be at right angles (due west) to the direction of the shoreline. Realignment of Carlsbad's city boundary would necessitate the detachment of 1,054 offshore acres from Carlsbad and annexation of one offshore acre to the City. If we obtain consent from the City Council, we would be able to consider the detachment and annexation as part of the proposed San Dieguito incorporation in November or December, 1985. As you may be aware, the northern boundary of this proposal corresponds with the southern city boundary of Carlsbad. LAFCO would not charge the City of Carlsbad any processing fees for this action, because it is in response to a LAFCO request. In your conversation with Mike Ott, you indicated that the Carlsbad City Council would be able to consider the detachment and offer their consent if LAFCO staff would forward a map of the affected area and a legal description. We have enclosed these materials with this letter for your review and the Council's consideration.
