RECOMMENDED ACTION:
It is recommended that the City Council authorize the concef
of the sale of surplus street right-of-way on Carlsb;
Boulevard at the North Ponto interchange (Anacapa exit).
ITEM EXPLANATION
Community Partners is processing a rezone and general pl;
amendment of the nine (9) acre site lying generally north I
Poinsettia Lane and south of Palomar Airport Road between tt
Santa Fe Railroad and Carlsbad Boulevard.
On October 23, 1984 the City Council authorized a sale
surplus land in conjunction with the dedication of new righ
of-way for Anacapa Road for So-Cal Development company (C
283, ZC-308, CT 84-11). The proposed project, however, w
subsequently denied by the City Council.
The existing interchange is an antiquated structure with

Planning Commission. If the project is approved, then
City Council will have another opportunity to approve
actual disposition of the property.
ENVIRONMENTAL IMPACT
The Land Llse Planning manager has determined that release

review.

In return for the surplus right-of-way the developer proposes to dedicat
land within the 5 acre open space area to the north of the proposed proj
(Exhibit W') claiming that the land could be used by the City, perhaps
a parking lot.
Staff position is that the land to the north is open space and is impact
by the flow of Encinas Creek. If any public parking were to be needed i
the area, it could be furnished in the area between the northbound and
southbound roadways of Carlsbad Boulevard. Staff recommends that the
surplus right-of-way be sold at fair market value.

The Land Use Planning Manager has determined that this action will not t-
