CITY A MTG.10/15/85 SALE OF RIGHT-OF-WAY CARLSBAD BOULEVARD AT ANACAPA DEPT.= CITY h - RECOMMENDED ACTION: It is recommended that the City Council authorize the concef of the sale of surplus street right-of-way on Carlsb; Boulevard at the North Ponto interchange (Anacapa exit). ITEM EXPLANATION Community Partners is processing a rezone and general pl; amendment of the nine (9) acre site lying generally north I Poinsettia Lane and south of Palomar Airport Road between tt Santa Fe Railroad and Carlsbad Boulevard. On October 23, 1984 the City Council authorized a sale surplus land in conjunction with the dedication of new righ of-way for Anacapa Road for So-Cal Development company (C 283, ZC-308, CT 84-11). The proposed project, however, w subsequently denied by the City Council. The existing interchange is an antiquated structure with and off ramps and a two-lane freeway type overcrossi (bridge). CarlsSad Boulevard has a very wide median, The developer proposes to demolish the existing bridge E interchange and to replace it with a modern at-grf intersection, signalized and channelized. The median Carlsbad Boulevard would be reduced in width and t northbound roadway moved westerly. The plan would create two parcels of surplus street right-c way on the east side of Carlsbad Boulevard. One parcel is 51 acres in size, the other is 1.4 acres, for a total of 5 acre At this time, the City Council is being requested to appri only the concept of selling the surplus street area. TI will permit the developer to prepare plans for approval by Planning Commission. If the project is approved, then City Council will have another opportunity to approve actual disposition of the property. CARLSBAD BOULEVARD AT ANACAPA AB# 7726 fltLE: SALE OF RIGHT-OF-WAY RECOMMENDED ACTION: It is recommended that the City Council authorize sale of surplus land ii conjunction with dedication of new right-of-way for Anacapa- ITEM EXPLANATION: To eliminate a very sharp curve on Anacapa, alignment from So-Cal Development in conjunction with their proposed 9.5 acre development. surplus right-of-way no longer needed. The surplus right-of-way is in two parts (0.95 acres and 0.25 acres) totaling 1.2 acres. The dedication for new Anacapa alignment is 0.5 acr The net surplus acreage is 0.7 acres (Exhibit "A"). In return for the surplus right-of-way the developer proposes to dedicat land within the 5 acre open space area to the north of the proposed proj (Exhibit W') claiming that the land could be used by the City, perhaps a parking lot. Staff position is that the land to the north is open space and is impact by the flow of Encinas Creek. If any public parking were to be needed i the area, it could be furnished in the area between the northbound and southbound roadways of Carlsbad Boulevard. Staff recommends that the surplus right-of-way be sold at fair market value. staff requested a new road So-Cal agreed if the City would agree to part with ENVIRONMENTAL REVIEW: The Land Use Planning Manager has determined that this action will not t- an effect on the environment and issued a Negative Declaration on July 3 1984.
