R/AG TITLE; REVISED WEST BATIQUITOS PROPERTIES AMENDMENT TO COASTAL PROGRAM LAGOON/SAMMIS THE CARLSBAD LOCAL nePT. HO.?W^ r.lTY ATTY CITY MGR. RECOMMENDED ACTION: a.2s o I Approve the attached resolution adopting the revised West Batiquitos Lagoon/Sammis Properties amendment to the Carlsbad Local Coastal Program and direct staff to forward to the Coastal Commission. ITEM EXPLANATION: On April 23, 1985 the City Council approved the Sammis Properties' Local Coastal Program (LCP) amendment. The purpose of that amendment was to add the newly annexed Sammis Properties to the City's LCP. Prior to annexation the properties as well as the entire lagoon were part of the San Dieguito LCP. On May 1, 1985 at the request of the Coastal Commission, the LCP Committee increased the area covered by the amendment to include the entire lagoon west of 1-5. The eastern lagoon as well as the north shore and Green Valley (Hunt Properties) will be dealt with in a subsequent LCP amendment and master plan. The April 23rd amendment reflected the general policies established by the land use segments of both the San Dieguito LCP and the Carlsbad General Plan. That LCP amendment provided for the Sammis Properties to be developed under a single master plan with those uses permitted by the Carlsbad General Plan. To date, the Coastal Commission has not taken action on the (West Batiquitos Lagoon/) Sammis Properties LCP amendment. On October 1, 1985 the City Council adopted the Batiquitos Lagoon Educational Park master plan (Sammis Properties). The master plan required a General Plan amendment to allow the proposed uses. This action necessitates a revision to originally proposed LCP amendment to make it consistent with the General Plan amendment and the master plan. The revisions recommended by the LCP Committee only affect the land use designations and policies for the Sammis Properties. No changes were made to'either the provi- sions for the conversion of 64 acres of non-prime agricultural land on part of the Sammis property, or for the protection and enhancement of the lagoon. Conversion of the agricultural land would be pursuant to Public Resource Code Section 30171.5. That section allows agricultural conversion mitigation through the payment of fees to be used for coastal resource enhancement. The protection and enhancement of the lagoon would be based on the "Enhancement Plan" currently being prepared by the Coastal Conservancy. Once the City takes action as recommended by this agenda bill, the documents will be forwarded to the Coastal Commission. Coastal staff has indicated that the amendment could probably be scheduled for the November 19-22, 1985 hearings in Los Angeles. EXHIBITS: 1. Resolution Number 2. The purpose of the public hearing is to accept input regarding revisions to a proposed amendment to the Carlsbad Local Coastal Program adopted by the City Council on April 23, 1985. That amendment was to include the West Batiquitos Lagoon/ Sammis Properties geographical area within the jurisdiction of the Carlsbad Local Coastal Program (LCP). The subject area which was formerly part of the San Dieguito LCP was annexed to Carlsbad in 1983 and removed from the San Dieguito LCP jurisdiction by the California Coastal Commission in 1984. The amendment provided for land uses consistent with the Carlsbad General Plan in effect at the time. Subsequently, a master plan and a General Plan amendment for portions of the area have been approved. The proposed revisions would make the LCP amendment consistent with Master Plan and General Plan amendment. Council approval would initiate Coastal Commission review and subsequent action on the revised LCP amendment. Copies of"the proposed LCP amendment are available for review at the Carlsbad Main Library and the La Costa Branch, Carlsbad City Hall and Research/Analysis Group offices: 2945 Harding Street, #207, Carlsbad. Landscaping. In order to guard against introduction of any species which are inherently noxious to, or incompatible with, the adjacent lagoon hab±tat, drought tolerant plants and native vegetation shall be used to the maximum extent feasible. Landscaping adjacent to structures should provide an effective screen of urban development. Note: The Batiquitos Educational Park Master Plan provides additional specific standards which relate to landscaping - see standards for individual use areas and the Open Space section. 5. Environmentally Sensitive Habitats. The environmentally sensitive habitats located on the affected area (i.e. wetlands and bluff slopes) shall be preserved as open space. -7- These sensitive areas shall be protected from any sig- nificant disruption. Furthermore, development on the bluff tops shall be set back from the bluff edges to prevent possible impacts on adjacent evironmentally sensitive habitats. Such accessways shall be pre- served for public use by requiring irrevocable offers of dedication of those areas as a condition of development. The accessways shall not adversely impact environmentally sensitive habitats. The public facilities and improvements specified by the Batiquitos Educational Park Master Plan shall be provided by the developer - see Phasing, Open Space and Public Fac- ilities Phasing sections of the Master Plan. 7. Archaeology. A program of preservation and/or impact mitigation regarding archaeological sites located on the affected area shall be completed prior to any development. 8. State Lands Commission Review. Prior to issuance of a coastal development permit, the permittee shall obtain a written determination from the State Lands Commission that: A. No State Lands are involved in the development, or B. State Lands are involved in the development and all permits required by the State Lands Commission have been obtained, or C. State Lands may be involved in the development, but pending a final determination an agreement has been made with the State Lands Commission for the project to proceed without prejudice to that determination. -8- Master Plan Approval. The Batiquitos Lagoon Master Plan as adopted by the Carlsbad City Council Ordinance No. 9778 is approved as the Implementing Ordinance for this Land Use Plan. The Master Plan shall be amended to imple- ment the Agricultural Mitigation Fee. The amendment may be certified by the Commission Executive Director without further Commission action. Upon certification by the Executive Director this portion of the Carlsbad Local Coastal Program shall be deemed certified. -9- CONCEPTUAL LAND USE SUMMARY WEST BATIQUITOS LAGOON/SAMMIS PROPERTIES LCP AMENDMENT Map A r/ag 10/85 •Sammis Properties," LCP Amendment^ Boundary Map B r/ag 10/85 '/ ity£*t sis*^ non-prime s agricultural Map C r/ag 10/85 Carlsbad Journal Decreed a Legal Newspaper by the Superior Court of San Diego County 3138 ROOSEVELT ST. • P.O.
