CITY DEPT. ENG FOR PASEO DEL NORTE
RECOMMENDED ACTION:
Adopt Resolution No. &dj -- to summarily vacate a portion of Pasec
Norte north of Palomar Airport Road, south of Cannon Road and accept
dedication of the new alignment.
Adopt Resolution No. rJ3 0 accepting a portion of right-of-wa
Paseo Del Norte.
ITEM EXPLANATION
Due to design changes and realignment of Paseo Del Norte, a request
made by Paul Ecke on behalf of Pea Soup Andersen's, to vacate an are;
that portion of the 86.00 foot public road easement known as Paseo
Norte as granted to the City of Carlsbad per document recorded November
1972 as File No, 72-320457 as shown within Parcels 2 and 3 of Parcel
No. 11284 in exchange for dedication of a road easement covering
alignment.
The utility companies have been notified of the vacation.
The Engineering Staff has reviewed this request and has concluded that '
strip of right-of-way is not needed for road purposes as it has i
superseded by the Paseo Del Norte realignment. State Codes provide t
where no improvements have been made within a right-of-way and the neec
superseded by relocation, the City Council may summarily vacate the ric
of-way without need for public hearing.
A replacement easement for roadway purposes covering the new alignment
included herein and is offered for acceptance.
FISCAL IMPACT
Exchange of right-of-way will result in approximately 6,000 square feet
of land returned to the tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING GRANT DEEDS.
WHEREAS, Carltas Co. and Paul and Magdalena
Poinsettia Foundation and Paul Ecke Sr. Trustee of the Paul
Sr. Trust dated September 8 1983, have submitted Grant C
conveying easements to the City of Carlsbad for street
highway purposes for Paseo Del Norte; and
WHEREAS, the City Council of the City of Carlsbac
determined it to be in the public interest to accept
Deeds;
NOW, THEREFORE, BE IT RESOLVED by the City Counc
