Approve the refund of the following fees:

The following fees have been collected by the City and should be
refunded to the appropriate parties:

REASON
Lusardi Construction Co. has
applied for a refund on sewer
hookups and Major Water
Facilities Fees at 2221 Rutherford.
Lusardi Company was charged fees-
based on an EDU calculation in
which the initial design called
for a shell building constructed
for speculation. Since then a
plan has been submitted for
tenant improvements which details
specific usage.to the area within
th~ building.,: The complete
design reflects a different
category of usage resulting in
a lesser charge of $10,302.40
for EDU's.
Any refund of fees reduces the amount of revenue available to the
city: however, the city may not retain fees collected in error,
collected for services ~hich cannot be rendered, or collected with
the intention of using said fees for a deposit to guarantee the
completion of a task once the task is completed.
