CITY ATTY UB RUBBERIZED RAILWAY CROSSINGS AT CANNON
ROAD, ELM AVENUE AND GRAND AVENUE
RECOMMENDED ACTION:
Approve Resolution No. g23P authorizing the Mayor to accept for the City an
agreement with the Atchison, Topeka & Santa Fe Railway Company to install
rubberized railway crossings and direct the staff to solicit price quotes in
accordance with the specifications provided by AT&SF.
ITEM EXPLANATION:
The AT&SF has agreed to install rubberized crossings at Cannon Road, Elm Avenue
and Grand Avenue under the following conditions:
1. City procures the crossing material in accordance with specifications
provided by AT&SF.

The railway company accepts only the products produced by Goodyear Tire and
Rubber Company and Sof & Dri Structural Rubber Products Company. Proposals
from both companies will be returned to council for final approval.
FISCAL IMPACT:
Two of the crossings (Elm and Grand) are in the Redevelopment area and are
considered appropriate for agency funding. Appropriate documents for fund
transfer will be provided on the Housing and Redevelopment Agency agenda.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AGREEMENTS WITH THE ATCHISON, TOPEKA RND SANTA FE RAILWAY COMPANY FOR INSTALLATION OF RUBBER MATERIAL RAILWAY CROSSINGS
WHEREAS, the City Council of the City of Carlsbad desires to upgrade
the railway crossings at Cannon Road, Elm Avenue and Grand Avenue, and;
WHEREAS, the Atchison, Topeka & Santa Fe Railway Company will install
rubber material crossings at the above intersections and;
WHEREAS, the AT&SF Railway Company has provided agreements for the
work to be performed which are attached hereto and a part thereof;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows:
1. The proposal to upgrade the railway crossings is approved.
2. The Mayor is authorized to execute the attached agreements on
behalf of the city.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
held on the 22nd day of October , 1985, by the following vote,
to wit:

Dear Mr. Greer:
Enclosed are completed Job Data Sheets for your use in obtaining bids from
Saf & Dri and Goodyear Rubber Company, for installation at Grand Avenue, Elm
Avenue and Cannon Road.
At Grand Avenue, we presently have two tracks at this crossing. In order to
lower your rubber-material cost, we are willing to remove a portion of Spur
Track No. 8 from the north side of Elm Street, to the north side of Grand
Avenue (as indicated on the attached sketch) at our expense, which will
enhance the vehicular riding quality over the crossing, providing the City
absorbs the costs to repave the area through the street after the track has
been removed.
Several meetings have been held on site at Tamarack Avenue, pertaining to
proposed widening and improvements which will require the Public Utilities Commission and Santa Fe involvement and approval of plans to improve the
crossing. At this time, preliminary plans have not been received, and we
recommend that the installation of rubber crossing material be held in
abeyance until the street is widened.
Enclosed is our standard Letter Agreement covering each crossing.

Re : Proposed Placement of Rubberized Crossing Material
Dear Mr. Greer:
CITY OF CdaLSBAD proposes that rubber crossing panels be installed within
the existing track area across Santa Fe's Fourth District Main Track at
Cannon Road, designated by California Public Utilities Commission as Crossing
NO. 2-231.4.
Santa Fe has no objection to City's proposal and is willing to install the
rubberized crossing material under the following conditions:

City shall, at City's expense, provide temporary A.C. cold mix paving to
allow reopening of street, prior to Santa Fe's placement of rubber
crossing material.
City shall, at City's expense, place A.C. paving as City may desire to
place in roadway approaches up to edges of rubberized crossing material.
City shall, at City's cost, provide all necessary rubber crossing material
and arrange to have said material delivered to job site when requested to
do so by Santa Fe.
City shall, at City's cost, provide detour road, with all required
vehicular traffic-control devices, including such flasher lights,
barricades and delineators as may be necessary to close one-half of the
crossing at a time, and continue such closure until that portion of the
crossing work is completed by Santa Fe.
City shall advise emergency agencies and public of the partial closure of
the crossing prior to construction.

City shall permit Santa Fe to stockpile removed material a minimum of
15 feet ,from track along construction area to provide additional
protection for Santa Fe employes during construction, which material will
be promptly removed by Santa Fe prior to reopening street.
Santa Fe shall, at Santa Fe's expense, remove existing crossing material
in track area, refurbish track structure as necessary and install the
rubber crossing material.
Santa Fe to provide portable automatic warning device or flagman to
accommodate vehicular traffic during temporary street closure of one-half
of Street.
That all work covered by this agreement shall conform to requirements of
the California Public Utilities Commission.
Santa Fe will, at its expense, maintain that portion of the crossing lying
between rails of the track and for two feet outside thereof.
City will, at its expense, maintain any street improvement within said
crossing other than specified to be maintained by Santa Fe in above
Paragraph 40.

To indicate that the foregoing conditions are satisfactory, please endorse
your approval on the acknowledgement section of the letter and return one copy
to Santa Fe, at which time we will schedule for construction.
