RESCIND AWARD OF CONTRACT FOR
LA COSTA AVENUE RIGHT TURN LANE
RECOMMENDED ACTION:
Adopt Resolution No. B;r. 4f2 rescinding Award of Contract
Number 3198 La Costa Avenue Temporary Right Turn Lane to Scibilia
& Sons Co. Inc.
ITEM EXPLANATION:
On August 20, 1985, City Council awarded Contract No. 3189 to
Scibilia & Sons Co. Inc. The City's intention was to alleviate
congestion at the intersection of La Costa Avenue and El Camino
Real by constructing a temporary right turn lane from La Costa
Avenue eastbound to El Camino Real southbound.
Since the construction of the ultimate intersection improvements
will start within four to five months and right-of-way
aquisition for the right turn lane would take two or three
months, staff recommends that the construction of the temporary
right turn be cancelled and the Award of Contract to Scibilia &
Sons be rescinded.
Staff has contacted the contractor, Scibilia & Sons, and
explained the City's position in possible cancellation of the
contract.
If Council approves the contractor's expenditures of $131.00 for
bond purchase will be reimbursed.
FISCAL IMPACT:
Funds in the amount of $30,000 are available in the account
number 330-820-1840-3189. If Council approves the City will pay
contractor's expenditures of $131.00 for his cost of contract
preparation and bond purchases.

A RESOLUTION OF THE CIlY COUNCIL OF THE CIlY
OF CARLSBAD, CALIFORNIA, RECINDING AWARD OF
CONTRACT NO. 3189, LA COSTA AVENUE 1EMPORARY
RIGHT TURN LANE.
WHEREAS, the ultimate intersection improvements of La
Costa Avenue and El Camino Real will be constructed in
February, 1986; and
WHEREAS, the construction of a temporary right turn lane
will not be necessary after the full intersection improvement
is constructed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:.
1. That the above recitations are true and correct.
2. That the payment of contractor's expenditures in the
amount of $131.00 is hereby approved.
3. The Award of Contract for the contruction of the La
Costa Avenue Right Turn Lane, Contract No. 3189 to Scibilia &
Sons is hereby rescinded.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 29th day of October 9
1985 by the following vote, to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
NOES: None
ABSENT: None
