FOR 2895 OCEAN STREET

RECOMMENDED ACTION:
That the City Council approve an above-ground encroachment permit
for a refuse dumpster and enclosure within City right-of-way.
ITEM EXPLANATION
Dr. Gunther, owner of the Mooring Apartments, 2895 Ocean Street,
has requested an above-ground encroachment permit for a refuse
dumpster and enclosure within the City right-of-way.
The proposed enclosure and dumpster would be at the northwest
corner of Ocean Street and Grand Avenue. This westerly portion
of Grand Avenue (40-feet wide) is currently used as public access
to the beach. The proposed enclosure would be encroaching into
the landscaped portion of the public access 4-feet 8-inches and
also into Ocean Street right-of-way 3-feet 7-inches. Staff has
field checked the site and determined that there is no room on
their private property to locate the enclosure and dumpster and
that locating it within the public right-of-way at the specified
location will not restrict or interfere with the public beach
access on Ocean Street.
Staff, therefore, is recommending approval of this encroachment
with the condition that the area around the enclosure be land-
scaped by the applicant to the satisfaction of the City
Engineer.

NOTE: Trash from the Mooring Apartments is currently dumped in
an unenclosed dumpster located on property across Ocean
Street south of Grand also owned by Dr. Gunther. As a
condition of approval of this encroachment, Dr. Gunther
has agreed to also enclose the dumpster at that location.

In accordance with the applicable code this request for an "above ground encroachment" is hereby sub- mitted via the Engineering Department.
It is requested that permission be granted to erect a suitable enclosure for a refuse dumpster on the south side of the Mooring Apartments, 2895 Ocean Street, Carlsbad, California. The property required for this installation is part of an area presently providing a a public acceasto the beach area. requirement however, will in no way intrude or impede the said accesa. .

With reference to the attached drawing and enclosure .- specifications, the exact location of the proposed project with pertinent measurements and construction information may be ascertained.
At the present time refuse from the Mooring Apartments must be taken by hand truck to a dumpster located on the corner of Grand and Garfield Avenues, one block from the building. will eliminate our present refuse handling problem.
