RECOMMENDED ACTION:
The Planning Commission and staff are recommending that the City
Council DENY the applicant's appeal for approval of CUP-277., and
direct the City Attorney to prepare documents of denial.
ITEM EXPLANATION
This is an appeal of a Planning Commission decision to deny a
request for a conditional use permit to permit the sale of beer and
wine coolers at Sunday evening events at the Carlsbad Raceway site
between March and November. This request is not related to an
existing conditional use permit permitting the Carlsbad Raceway to
sell beer at five events during the year.
Staff originally recommended approval of the conditional use permit
with special conditions. The proposed conditions (attached as
Exhibit "A") basically put security into the hands of the police
chief, who also was recommending approval of this application. The
major issue concerning the Planning Commission was the affect of
approval on the public safety. They felt approval could increase
the number of persons driving under the influence of alcoholic
beverages. They were particularly concerned because the
application was for evening events, a time when driving conditions
usually worsen.
For these reasons both the Planning Commission and the staff are
recommending denial of the appeal.

ENVIRONMENTAL REVIEW
A Negative Declaration was issued by the Planning Director on
October 5, 1985 and approved by the Planning Commission on October
23, 1985.
FISCAL IMPACT
There will be no direct fiscal impact from the approval of the
proposed application. Some police department staff time might be
utilized to coordinate security prior to occurance of the events.

WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code,
the Planning Commission did, on the 23rd day of October, 1985 and
on November 13, 1985, hold a duly noticed public hearing to
consider said application on property described as:

WHEREAS, at said hearing, upon hearing and considering all

SUBJECT: CUP-277 - CALIFORNIA SPEEDWAY, INC. - Request for
approval of a conditional use permit to allow the sale
of beer and wine coolers at Sunday evening events from
April to November at Carlsbad Raceway.
I. RECOMMENDATION
That the Planning Commission APPROVE the Negative Declaration
issued by the Land Use Planning Manager and ADOPT Resolution No.
2505 APPROVING CUP-277, based on the findings and conditions
contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
California Speedway, Inc., the applicant, presently leases the
"speedway track" from Carlsbad Raceway to conduct racing events
on Sunday evenings. The applicant is requesting approval of a
conditional use permit to allow the sale of beer and wine coolers
at Sunday evening events which are held every Sunday from April
through November, from 7:30 to 9:30 p.m. The beverages would be
sold from a stand to be located near the existing food stand and
bathrooms.
This request is not related to the existing conditional use
permit which allows Carlsbad Raceway Corporation to sell beer at
five events throughout the year. The applicant was advised by
the Police Chief to keep the permits separate since they pertain
to separate organizations.
The applicant also will have to obtain a permit from the
Alcoholic Beverage Control (ABC) Board. Carlsbad Raceway's
concessionaire currently has the license for the entire raceway
area. That concessionaire would have to concede the speedway
area from their licensed area before a permit would be issued to
another concessionaire, i.e. California Speedway, Inc.
III. ANALYSIS
Planning Issue
1 . Will the requested sale of beer and wine coolers at Sunday
evening events be detrimental to the public safety?
DISCUSSION
Probably the major problems associated with the sale of
alcoholic beverages at public events are the possibility of
patrons driving home from the site in an intoxicated condition
and possible unruly behavior.
Staff believes that the proposed conditional use permit, as
conditioned, will assure adequate protection of public safety.
The Police Chief will have the ability to revoke permission to
sell the beverages if he determines that the continued sale of
the beer and wine coolers would be detrimental to the public
safety of the spectators, participants, or members of the
surrounding community. The Police Chief also will have final
authority over the level of security provided each week, and will
be advised 45 days in advance of the first event. In addition,
serving of the alcoholic beverages will end at 9:30 P.M. or at a
certain point in the evenings event, whichever is sooner. This
point is specifically defined in the conditions of approval.
Finally, the conditional use permit will be issued for a period
of only one year. Staff feels this is a prudent condition since
the applicant is a new concessionaire to the raceway.
Since the Police Department believes that these conditions will
result in adequate crowd control and subsequent public safety,
staff is recommending approval of CUP-277.
IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant impact on the environment and,
therefore, has issued a Negative Declaration on October 5, 1985.

PROJECT DESCRIPTION: Conditional use permit to sell beer and wine
coolers at Sunday evening racing events at Carlsbad Raceway.
The City of Carlsbad has conducted an environmental review of the
above described project pursuant to the Guidelines for Implementation
of the California Environmental Quality Act and the Environmental
Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not
have a significant impact on the environment) is hereby issued for the
subject project. Justification for this action is on file in the
Land Use Planning Office.
A copy of the Negative Declaration with supportive documents is on
file in the Land Use Planning Office, City Hall, 1200 Elm Avenue,
Carlsbad, CA. 92008. Comments from the public are invited. Please
submit comments in writing to the Land Use Planning Office within ten
(10) days of date of issuance.

Conditions;
1) Approval of this conditional use permit allows the sale of
beer and wine coolers at Sunday evening events sponsored by
California Speedway/ Inc. It does not affect the conditions
of approval for the conditional use permit previously issued
to Carlsbad Raceway. California Speedway, Inc. shall comply
with those conditions by virtue of being a lessor of Carlsbad
Raceway.
2) Prior to March 1, 1986 applicant shall execute a hold harmless
agreement indemnifying the City and any of its officers or
employees for any damages or injuries to any persons or
property resulting from or caused by any event or activity
conducted pursuant to this permit or by any act related to any
event or activity conducted pursuant to this permit. Further,
the applicant shall obtain general liability insurance in an
amount of not less than $1,000,000.00 in a form satisfactory
to the City Manager and City Attorney which shall include
coverage for the activities for which the applicant agrees to
indemnify and hold harmless the City and its officers and
employees. The policy shall name the City and its officers
and employees as additional insureds. This policy shall be
filed with the City prior to March 1, 1986. Failure to comply
with this condition shall render this permit automatically
void.
3) This conditional use permit shall be effective for one year,
beginning March 1, 1986. During that time, there shall be 90-
day review periods, when Land Use Planning staff will review
the Sunday evening operations with the Police Department.
4) The Chief of Police shall approve the sale of beer and wine
coolers at Sunday evening events at least 45 days prior to the
date of the first event.
5) The Chief of Police has the final authority over the level of
security and Police services required for the Sunday evening
events.
6) California Speedway, Inc. shall pay for Police manpower
required for the Sunday evening events.
7) The sale of beer and wine coolers shall occur only between the
ho'urs of 7:00 p.m. to 9:30 p.m. or at the following times in
the Sunday evening program, whichever is sooner:
During the Regular Season at "Main" events (approximately 5-6
events from end); at a "Championship" event, beginning of the
last round of 5 rounds of events; and at a "Qualifying" event,
at the semis, (6 events from the end). The intent of this
condition is to ensure that the sale of alcoholic beverages
will cease at least one-half hour prior to the end of the last
event.
8) Security personnel shall be stationed at all beer vending
areas. These personnel shall monitor sales to ensure that
patrons purchasing beer are not in an intoxicated condition and
shall have the right to prohibit sales to those persons
appearing to be in such condition.

Dear Members of the Council:
We represent Carrillo Rancho Partnership which owns 71 acres
between the raceway property and Palomar Airport Road. The
partnership leases its 71 acres to the Raceway operators for a
parking lot when big racing events occur.
The partnership is AGAINST any permit which would allow sale
of alcoholic beverages on the Raceway premises for the following
reasons:
1. Such a permit could lead to very serious automobile
accidents on Palomar Airport Road.
2. It would increase the number of people who would become
intoxicated and contribute to security problems.
3. It would jeopardize public safety, especially drivers on
Palomar Airport Road, when spectators leave the raceway after the
event.

Dear Members of the City Council:
Kaiser Development Company, as a member of the community and as the owner of
approximately 90 acres adjacent to Palomar Airport Road, would like to voice
its objection to the granting of a Conditional Use Permit to sell beer and
wine at Sunday evening events at Carlsbad Raceway.
Kaiser Development Company feels that Palomar Airport Road as it currently
exists adjacent to the Carlsbad Raceway is already a very dangerous
thoroughfare for the volume of traffic traveling upon it. The introduction of
additional traffic from the Raceway containing a number of drivers having
consumed beer and wine only accentuates the already existing dangerous traffic
situation on Palomar Airport Road.
Kaiser Development Company strongly supports the denial of the Conditional Use
Permit for the sale of beer and wine at the Carlsbad Raceway by the Planning
Commission of the City of Carlsbad and urges the City Council to affirm the
Planning Commission's decision at the appeal of Case No. CUP-277 on
November 26, 1985.

Regarding Resolution 2505
I would like to congratulate and praise the Carlsbad
Planning Commission for their October 23rd decision in deny-
ing a conditional use permit to sell alcoholic beverages at
the Carlsbad Raceway.
I understand this decision has now been appealed to
the City Council. I beg and plead with you to back up the
good judgement of your commissioners.
There are anywhere from 1,000 to 5»000 people exiting
across my land on a Sunday evening from 10 p.m. to 10:30 p.m.
into an extremely dangerous and busy intersection onto Palomar
Airport Road.
To license these indulgers of alcohol, who have been also
highly stimulated by the race drivers they have been watching,
is to me, the same as giving them a license to kill. Drink-
ing and driving doesn't mix!
