RECOMMENDED ACTION:
Aaopt Ordinance No. -312~ amending Carlsbad Municipal Code,
Chapter 10.40 to establish violation enforcement procedures and
fees.
ITEM EXP~ANATION
The State of California recently passed AB1551 authorizing San Diego
County to impose a $1 . 50 surcharge on all city parking fines for the
purpose of financing the building of court facilites in the County of
San Diego. The surcharge becomes effective upon adoption of a
resolution by the Board of Supervisors establishing a court
construction fund. State law Lequires cities which collect parking
fines to pay $1.50 for each ticket to the county.
The Police Department staff has determined that the change will
require the reprinting of parking citation forms. A substantial on-
hand supply can no longer be used. Additionally, there will be
other administrative handling costs associated with this mandated
change.
It is recommended that Section 10.42.010(b) of the Carlsbad Municipal
Code be amended to provide for an additional surcharge of $2.00 for
each parking ticket; $1.50 to cover the surcharge and $.50 to cover
the additionnal -dministrative costs necessitated by the legislative
change. The City already collects a $2.00 per ticket surcharge for
jail facilities; $1.50 of that charge is paid to the County.
FISCAL IMPACT
The fiscal impact for 1985-86 is estimated to be approxima~ely
$1,500. This cost will then be recovered by the additional $.50 per
citation. Therefore, there will be no net cost to the City of
Carlsbad once the change is implemented and collecton of fines
occurs.

ORDINANCE NO. 3195
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 10, CHAPTER
10.42 OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.42.010(b) TO INCREASE
THE SURCHARGE FOR PARKING VIOLATIONS TO $2.00.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 10, Chapter 10.42 of the Carlsbad
Municipal Code is amended by the amendment of Section
10.42.010(b) to replace the reference to "Government Code Section
68073.4" with a reference to "Government Code Sections 76000 and
76004" and to add the following sentence:
"·n addition to the fees established by this section,
and pursuar,t to Sections 76000 and 76005 of the State Government
Code, an additional surcharge of $2.00 for each violation shall
be paid; one dollar and fifty cents of the surcharge shall be
paid to the county pursuant to Section 76006 of the State
Government Code."
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption or upon adoption by the San Diego
County Board o: Supervisors of the resolution specified in
Government Code Section 76005, whichever is later, and the City
Clerk shall certify to the adoption of this ordinance and cause
it to be published at least once in the Carlsbad Journal within
15 days after its adoption.
