No bids were received on sections 3006-3E roofing and 3006-3F
sheet metal for which the Construction Manager requests
permission to negotiate an acceptable contractor per Section
20166 of the Public Contract Code. Estimated cost of the roofing
contract is $169,712 and the estimated cost of the sheet metal
work is $94,035.
FISCAL IMPACT
Budgeted funds for this phase of construction are currently in
Account Nos. 332-820-1810-3006 and 114-820-1810-3006.
Including Bid Package 6, the current awarded bids total
$6,386,631 which is over the construction estimate by $100,789.

Dear Mike:
Approval to solicit bids for the referenced work was given by the
City Council on April 2, 1985. Work includes aluminum storefronts
and glass; aluminum canopies; lath, plaster, metal studs and drywall;
roofing, waterproofing, and insulation; sheet metal; building
insulation; coiling and sectional doors; pneumatic tube system;
finish carpentry; and site maintenance contractor. Numerous firms
specializing in these activities were contacted by your construction
manager with a pre-bid conference being held on 11/21/85, and bids
received on 12/4/85.
We have analyzed the low bids and finding a few irregularities recommend
that an award for the following bid package items be made to:

Vfe feel these awards represent a fair and reasonable price for the work
intended. Unfortunately, bids were not received for items 6E Roofing
and Waterproofing, and 6F Sheet Mstal and Accessories. Since these
trades are critical to current construction progress, we would request
council approval to negotiate this work. Lack of bids is really
unexplainable since numerous firms were contacted and expressed interest,
and the project bid was advertized.
Single bids were received for items 6A and 6B. This is perhaps understandable
due to the complexity and coordination required between these trades.
In an effort to reduce project costs, these trade requirements were
modified and issued as a performance specification by the project team.
Thus, engineering for these systems including coordination with the
precast design, shall be a requirement of each contractor. Both
Pacific Glass and Construction Specialties have demonstrated an
understanding of the project requirements, and their bids are within our
projected budgets.
Schmid Insulation Contractor's, Inc. was the low bidder of record for
item 6G. However, their bid was submitted without the required bid
security, i.e., bond, certified check, or cashier's check. This is
considered as a major irregularity by your construction manager and
award has been recommended to the next bidder.
Ross-Cook, Inc. was the low bidder of record for item 61. At bid time it was
obvious that a mistake was made since Ross-Cook was substantially
low. On December 6, 1985, we received a copy of a letter and bid
estimate from Ross-Cook requesting relief. In submitting their bid,
a typographical error was made for the bid price. After reviewing
their letter and estimate we concluded an honest mistake was made and
recommend relief, return of bid security, and award to the next bidder.

Vfe understand that an agenda bill will be prepared for City Council
approval of these awards on December 17, 1985. Please let us know
if additional information is required or if there are any problems

OF CARLSBAD CALIFORNIA, ACCEPTING BIDS AND
3 AUTHORIZING THE EXECUTION OF CONTRACTS 3006-6A,
6B, 6C, 60, 6G, 6H, 61, 6J, AND 6K , AND
4 AUTHORIZING THE KOLL COMPANY TO NEGOTIATE BID

5 THE CONSTRUCTION OF THE CARLSBAD SAFETY CENTER.

7 WHEREAS, bids have been received by the City of Carlsbad
8 for the construction of the Carlsbad Safety and Service
9 Center, Contracts Nos. 3006-6A, 68, 6C , 6D, 6G, 6H, 61, 6J, and
10 6K; and
11 WHEREAS, the bids received for the contracts total
12 $1,011,579; and
13 WHEREAS, the Construction Manager has recommended
14 accpeptance of the bids; and
15 WHEREAS, no bids were received for bid sections 3006-6E
16 and6F;and
17 WHEREAS, funds are available in Account No. 320-820-1810-
18 3006 and 114-820-1810-3006;
19 j NOW, THEREFORE, BE IT RESOLVED by the City Council of
20 Carlsbad, California, as follows: f
21 1. That the above recitations are true and correct.
22 2. The bids recommended by the Koll Company in the amount
23 of $1,011,579 for the construction of the- Carlsbad Safety
24 Center Bid Package No. 6 are hereby accepted and the Mayor and
25 City Clerk are hereby authorized to execute contracts

1 3. That Section 20166 of the Public Contract Code allows
2 Council to waive formal bidding requirements wKen no bids are
3 received and to authorize Koll Company to negotiate bid
4 sections 3006-6E for roofing and 3006-6F for sheet metal which
5 is work estimated at $263,747.00.
6 PASSED, APPROVED AND ADOPTED at a regular meeting of the
7 Carlsbad City Council held on the 17th day of December
8 1985 by the following vote, to wit:
