ITEM EXPLANATION
The City Council at your meetings of November 19, 1985 and Dece 10, 1985 directed our office to prepare documents approving
amendments to the Land Use Element of the General Plan as follc
a. GPA/LU 85-11 - City of Carlsbad revised density ranges.
b. GPA/LU 85-3 - Expanding the commercial designation at t Country Store site.
c. GPA/LU 85-6 - Changing the Aroney parcel from commercia residential.
Attached is Resolution No. f307 incorporating these thre changes into one single General Plan amendment. Also attached two ordinances implementins the zone changes which correspond t
General Plan amendments. Ordinance No. 9787 approves the change from R-A-10 to C-2 for the Country Store, 2C-326. Ordin
No. approves the zone change from C-2-Q to RDM-Q for Aroney property, ZC-335. The Country Store ordinance contains conditions of approval as discussed by the Council. You should satisfy yourselves that we have appropriately carried forward t Council’s intentions in the findings aEd conditions of the atta
documents.

CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMEN'
TIONS FOR TWO AREAS' OF THE CITY'S GENERAL PLAN AND
WHEREAS, the Planning Commission did on October 9,
hold duly noticed public hearings as prescribed by law to
consider amendments to the Land Use Element of the General 1
GPA/LU 85-3 and GPA/LU 85-11: and
WHEREAS, The Planning Commission did on August 28,
hold duly noticed public hearings as prescribed by law to
consider amendments to the Land Use Element of the General 1
GPA/LU 85-6; and
WHEREAS, the Planning Commission has determined thc
GPA/LU 85-6/ZC-335 and GPA/LU 85-11 would not have signific(
impacts on the environment and the City Council has determii
that GPA/LU 85-3/2C-326 could not have significant effects (
environment and Negative Declarations were issued and appro'
satisfaction of the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1980 and the Californ
Environmental Quality Act: and

WHEREAS, the City Council did on November 19, and
December 10, 1985 hold duly advertised public hearings to
consider said amendments and at that time received the
recommendations, objections, protests and comments of all
interested persons desiring to be heard: and

WHEREAS, the City Council, after considering all
proposed changes to the Land Use Element of the General Plai
directed the City Attorney to return with appropriate docum1
to allow the City Council to' vote on the change individual1
part of one single amendment to the Land Use Element of the
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council
the City of Carlsbad, California as follows:
A. That the above recitations are true and correc'
B. That the findings of the Planning Commission a!
forth in Planning Commission Resolution No. 2476 (GPA/LU 85.
and Resolution No. 2506 (GPA/LU 85-11) constitute the findii
the City Council.
C. The findings of the Planning Commission in
Resolution No. 2497 for GPA/LU 85-3 are not approved and tht
applicant's appeal is granted.
D. That the Land Use Element of the General Plan
amended as follows:
1. GPA/LU 85-3 Country Store: To change the Land
Element from RLM to Neighborhood Commercial for approximatel
3.67 acres of property generally loeated at the Country Stor
El Camino Real as shown on the map marked Exhibit A - GPA/Lt
attached hereto and made a part hereof.

2. GPA/LU 85-6 Arony: To change the Land Use Elen
from Community Commercial to RMH on approximately 4-56 acres
property qenerally located on the southwest corner of the Lz
Costa Avenue and Rancho Santa Fe Intersection as shown on tk

ZC-326 - COUNTRY STORE.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21 of the Carlsbad Municipal
is amended by the amendment of a zoning map for a zone change
from R-A-10 to C-2-Q on property as shown on the map marked
ZC-326, Exhibit A, attached hereto and made a part hereof.
SECTION 2: That the change of zone approved by this
ordinance is subject to the following conditions :
1. The property owner shall dedicate all access rig
from the property to El Camino Real including the relinquishm of the two existing driveways. Access shall be provided. in a
driveway on the easterly boundary of the property unless otherwise approved by the City of Carlsbad as a part of the s development plan.
2. The property owner shall pay for a traffic study required by the City Engineer to determine the design of the access to the property. The study shall include a determinat on whether or not a traffic signal is required to accommodate
access.

installed at the applicant's expense. If the signal benefits property across El Camino Real the City will use its best
efforts to obtain reimbursement from such properties. 4. The applicant in preparing the site development
shall coordinate that with the City Engineer and the traffic study to improve access from the mobile home park. Arrangeme
shall be made satisfactory to the City Council for improving access to the mobile home park includinq the possibility of access through this property to El Camino Real.
3. If it is determined as a part of the site
All of the conditions contained in this ordinance sh
be satisfied prior to the issuance of any building permits or
site.

We, the undersigned residents of La Costa, City of Carlsbad, California, hereby petition and say:
That the property has been planned and zoned for a neighborhood shop center for more than 10 years;
That the Planning Commission, by 5 to 2, voted to maintain the zonin a neighborhood shopping center and deny the rezoning to residential;
That there is an imdiate need for a neighborhood commercial center the Property which allows the purchase of goods and services convenient t' homes that could be provided by stores such as an ice cream parlor, flowe shop, bakery, video store, beauty shop, specialty restaurants and deli, boutique, and other convenience i terns;
THEREFORE, we respectfully request that the City Council reconsider rezoning, and vote to retain the zoning for neighborhood commercial use.
