ITEM EXPLANATION The City Council at your meetings of November 19, 1985 and Dec 10, 1985 directed our office to prepare documents approving amendments to the Land Use Element of the General Plan as foll a. GPA/LU 85-11 - City of Carlsbad revised density ranges b. GPA/LU 85-3 - Expanding the commercial designation at Country Store site. residential. c. GPA/LU 85-6 - Changing the Aroney parcel from commerci Attached is Resolution No. r.3~37 incorporating these thi changes into one single General Plan amendment. Also attache( two ordinances implementing the zone changes which correspond General Plan amendments. Ordinance No. ?7f7 approves tI change from R-A-10 to C-2 for the Country Store, ZC-326. Ord: No. approves the zone change from C-2-Q to RDM-Q fc Aroney property, ZC-335. The Country Store ordinance contain: conditions of approval as discussed by the Council. You shou: satisfy yourselves that we have appropriately carried forward Council's intentions in the findings and conditions of the at1 documents. RESOLUTION NO. 8307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMEN' OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA TIONS FOR TWO AREAS OF THE CITY'S GENERAL PLAN AND TO CHANGE THE MAP AND TEXT TO IMPLEMENT THE REVISF, DENISTY RANGES. GPA/LU 85-3 - THE COUNTRY STORE GPA/LU 85-6 - ARONEY GPA/LU 85-11 - THE CITY OF CARLSBAD. WHEREAS, the Planning Commission did on October 9, hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General GPA/LU 85-3 and GPA/LU 85-11; and WHEREAS, The Planning Commission did on August 28 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General GPA/LU 85-6; and WEREAS, the Planning Commission has determined t GPA/LU 85-6/2C-335 and GPA/LU 85-11 would not have signifi impacts on the environment and the City Council has determ that GPA/LU 85-3/ZC-326 could not have significant effects environment and Negative Declarations were issued and appr 21 22 23 24 25 26 27 28 Environmental Protection Ordinance of 1980 and the Califor Environmental Quality Act; and WHEREAS, the City Council did on November 19, and December 10, 1985 hold duly advertised public hearings to consider said amendments and at that time received the recommendations, objections, protests and comments of all interested persons desiring to be heard: and a. ZC-326 - COUNTRY STORE. The City Council of the City of Carlsbad, Californi, does ordain as follows: SECTION 1: That Title 21 of the Carlsbad Municipal is amended by the amendment of a zoning map for a zone changc from R-A-10 to C-2-9 on property as shown on the map marked ZC-326, Exhibit A, attached hereto and made a part hereof. SECTION 2: That the change of zone approved by thi ordinance is subject to the following conditions: 1. The property owner shall dedicate all access ril from the property to El Camino Real including the relinquishi of the two existing driveways, Access shall be provided. in driveway on the easterly boundary of the property unless otherwise approved by the City of Carlsbad as a part of the development plan. 2. The property owner shall pay for a traffic stud required by the City Engineer to determine the design of the access to the property. The study shall include a determina on whether or not a traffic signal is required to accommodat access. development plan approval for this project and based on the traffic study that a traffic signal is required it shall be installed at the applicant's expense. If the signal benefit property across El Camino Real the City will use its best efforts to obtain reimbursement from such properties. 4. The applicant in preparing the site development shall coordinate that with the City Engineer and the traffic study to improve access from the mobile home park. Arrangem shall be made satisfactory to the City Council for improving access to the mobile home park includinq the possibility of access through this property to El Camino Real, 3.
