ITEM EXPLANATION
The City Council at your meetings of November 19,, 1985 and De(
10, 1985 directed our office to prepare documents approving amendments to the Land Use Element of the General. Plan as fol:
a. GPA/LU 85-11 - City of Carlsbad revised density range:
b. GPA/LU 85-3 - Expanding the commercial designation at Country Store site.
c. GPA/LU 85-6 - Changing the Aroney parcel from commerc: residential,
Attached is Resolution No. f307 incorporating these thi changes into one single General Plan amendment. Also attache( two ordinances implement ins the zone changes which correspond
General Plan amendments. Ordinance No. ? 787 approves tl
change from R-A-10 to C-2 for the Country Store, ZC-326. Ord. No. approves the zone change from C-2-Q to RDM-Q fc

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMEE OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNf TIONS FOR TWO AREAS' OF THE CITY'S GENERAL PLAN ANI:
TO CHANGE THE MAP AND TEXT TO IMPLEMENT THE REVISI DENISTY RANGES. GPA/LU 85-3 - THE COUNTRY STORE GPA/LU 85-6 - ARONEY
GPA/LU 85-11 - THE CITY OF CARLSBAD.
WHEREAS, the Planning Commission did on October 9
hold duly noticed public hearings as prescribed by law to
consider amendments to the Land Use Element of the General
GPA/LU 85-3 and GPA/LU 85-11; and
WHEREAS, The Planning Commission did on August 28
hold duly noticed public hearings as prescribed by law to
consider amendments to the Land Use Element of the General
GPA/LU 85-6; and
WHEREAS, the Planning Commission has determined t
GPA/LU 85-6/ZC-335 and GPA/LU 85-1 1 would not have siqnifi
impacts on the environment and the City Council has determ
that GPA/LU 85-3/2C-326 could not have significant effects
environment and Negative Declarations were issued and appr
satisfaction of the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1980 and the Califor
Environmental Quality Act; and

WHEREAS, the City Council did on November 19, and
December 10, 1985 hold duly advertised public hearings to
consider said amendments and at that time received the
recommendations, objections, protests and comments of all
interested persons desiring to be heard: and

proposed changes to the Land Use Element of the General PI;
directed the City Attorney to return with appropriate docul

SECTION 1: That Title 21 of the Carlsbad Municipal
is amended by the amendment of a zoning map for a zone chang
from C-2-9 to RD-M-Q on property as shown on the map marked
335, Exhibit B, attached hereto and made a part hereof.
EFFECTIVE DATE: This ordinance shall be effective

CARLSBAD, CALIFORNIA AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY AMENDING THE ZONING
MAP TO GRANT A CHANGE' OF ZONE FROM R-A-10 TO
C-2-Q ON APPROXIMATELY 3.67 ACRES OF PROPERTY
GENERALLY LOCATED AT THE COUNTRY STORE ON EL
CAMINO REAL SUBJECT TO CERTAIN CONDITIONS.
ZC-326 - COUNTRY STORE.
The City Council of the City of Carlsbad, Californii
does ordain as follows:
SECTION 1: That Title 21 of the Carlsbad Municipal
is amended by the amendment of a zoning map for a zone change
from R-A-10 to C-2-0 on property as shown on the map marked
ZC-326, Exhibit A, attached hereto and made a part hereof.
SECTION 2: That the change of zone approved by this
ordinance is subject to the following conditions :
1. The property owner shall dedicate all access rig from the property to El Camino Real including the relinquishn of the two existing driveways. Access shall be provided in i driveway on the easterly boundary of the property unless otherwise approved by the City of Carlsbad as a part of the E development plan. 2. The property owner shall pay for a traffic stud1 required by the City Engineer to determine the design of the access to the property. The study shall include a determinat on whether or not a traffic signal is required to accommodate access.

We, the undersigned residents of La Costa, City of Carlsbad, California hereby petition and say:- .
That the property has been planned and zoned for a neighborhood shc center for more than 10 years;
That the Planning Commission, by 5 to 2, voted to maintain the zon. a neighborhood shopping center and deny the rezoning to residential;
That there is an inmediate need for a neighborhood commercial centc the property which allows the purchase of goods and services convenient homes that could be provided by stores such as an ice cream parlor, flor shop, bakery, video store, beauty shop, specialty restaurants and deli, boutique, and other convenience items;
THEREFORE, we respectfully request that the City Council reconsidel rezoning, and vote to retain the zoning for neighborhood commercial use
