Approve the Negative Declaration prepared3 the Land Use Planning Manager and Introduce Ordinance No. 978s I APPROVING ZCA-188.
ITEM EXPLANATION
This item is a city-initiated amendment to the Zoning Ordinance
regarding the location and placement of satellite antennae in the City of Carlsbad. The ordinance was drafted by the City Attorney's Office in cooperation with the Planning Department. The ordinance would permit satellite antennae but would regulate specifically where they could be located and placed. The major features of the ordinance are as follows:
A permit would be required before any satellite antenna could be installed in any zone in the city;
In residential zones:
a) No roof mounted antenna is permitted b) A ground mounted antenna would only be permitted in the
c) The antenna must be screened so no more than 25 percent rear and side yards
of it extends above the screening
In commercial and industrial zones:
a) A roof mounted antenna could be permitted if it is not visible from ground level and does not extend more than five feet above the permitted height of the building.

Both staff and the Planning Commission are recommending that the City Council approve the proposed satellite antennae ordinance.

ENVIRONMENTAL REVIEW
This amendment will not have any significant impacts on the environment and a Negative Declaration was prepared by the Land Use Planning Manager on September 28, 1985 and recommended for approval by the Planning Commission on November 13, 1985.
FISCAL IMPACT
Staff time in enforcing the ordinance which should not be significant .

CARLSBAD, CALIFORNIA AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF VARIOUS CHAPTERS AND SECTIONS TO PERMIT AND REGULATE SATELLITE ANTENNAE.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21, Chapter 21.04 of the Carlsbad
Municipal Code is amended by the addition of Section 21.04.302 to
read as follows:
21.04.302 Satellite television antenna. "Satellite television antenna" or "satellite antenna" means any instrument or device capable of transmitting or receiving television, microwave, or other electronic communications from a transmitter, or a transmitter relay, located in planetary orbit. This may
include,. but is not limited to, "satellite earth stations,"' "satellite receiving dish," and "dish antenna."
SECTION 2: That Title 21, Chapter 21.07 of the Carlsbad
Municipal Code is amended by the addition of Section
21.07.020(14) to read as follows:

(j) Whenever a discretionary permit is required for construction of a project, the satellite antenna permit may be consolidated with the discretionary permit.
(k) Redevelopment zone: A redevelopment permit issued pursuant to Chapter 21.35 shall be required for any satellite television antenna located in the Villaqe Redevelopment Zone. In addition to complying with the provisions of this section all satellite television antennae in the Villaqe Redevelopment Zone shall conform to the provisions of the Village Design Manual.

RECOMMENDATION
That the Planning Cornmission recommend APPROVAL of the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 2501 , recommending APPROVAL, of ZCA-188, based on
the findings contained therein.
I1 . DISCUSSION
This item was continued from the Planning Commission meeting of October 9, 1985 in order to have staff return with a revised
ordinance incorporating several changes suggested by -the Commission. The ordinance has been revised as follows:
1. Antennae less than 30 inches. in diameter are exempted
(Section 21.44.220(a) - Page 5).
2. Cross sections showing adjacent properties and streets are
required as part of th,e application (Section 21.44.220(b) -
Page 5) .
3. More than one antenna may be approved for commercial and
industrial lots (Section 21.44.220(e) (3) - Page 6) .
4. Antennae for public utilities in the Public Utility Zone

11. DISCUSSION -
This item is a city-initiated amendment to the Zoning Ordinance to permit and regulate the location and placement of satellite antennae in the City of Carlsbad. This matter was discussed at a City Council meeting earlier this year at which time the Council referred the matter to the Planning Commission for a recommendation.
The placement of satellite television antennae especially in residential zones has become a growing concern in most of the cities in San Diego County. The visual impact particularly when they are placed in a front yard area or on the roof of a building is the major concern. Several satellite dish antennae have been erected in Carlsbad and many more are expected in the future. Staff has received several complaints regarding the visual impact of the structure.
The City Attorney's office, with input from Land Use Planning,
has drafted a proposed ordinance to permit but regulate the
specific location or placement of the antennae. The major features of the proposed ordinance are as follows:
1) A permit would be required before any satellite antenna could be :installed in any zone in the city;
2) In residential zones:
a) No roof mounted antenna is permitted
b) A ground mounted antenna would only be permitted in the

hearing at the City Council Chambers, 1200 Elm Avenue, Carlsbad, California, at 6:OO P.M.,
on Tuesday, December 17, 1985, to consider an amendment to the Zoning Ordinance to
regulate the placement of satellite antennae within the City of Carlsbad.
If you have any questions please call the Land Use Planning Office at 438-5591.
If you challenge the Zone Code Amendment in court, you may be limited to raising only
those issues you or someone else raised at the public hearing described in this notice,
or in written correspondence delivered to the City of Carlsbad at or prior to the
