On April 17, 1984 the City Council by your adoption of Ordinance No. 1269 amended the City's transient occupancy tax to apply it to private campgrounds and state park campsites. The Legislature by their adoption of AB 1427, Chapter 529, Statutes of 1985 has added Section 7282 to the Revenue and Taxation Code. Effective January 1, 1986 this new section prohibits the City from applying the TOT tax to a unit of the state park system. We have advised the Finance Director to change the collection practices accordingly. In order to maintain our code it is also necessary for the City Council to adopt Ordinance No. /.2 6P7 to remove the transient occupancy tax for state park campsite—s from the Code. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 3, Chapter 3.12, Section 3.12.020 of the Carlsbad Municipal Code is amended by the amendment of the last sentence of subsection (1) to delete the following words: "and state park campsites". SECTION 2: That Title 3, Chapter 3.12, Section 3.12.020 of the Carlsbad Municipal Code is amended by the amendment of subsection (3) to delete the last sentence which reads: "Operator shall include the State of California." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
