TITLE:
STIPULATED FINDING AND AWARD
RECOMMENDED ACTION:
Adopt Resolution No. 833a .
ITEM EXPLANATION:
Firefighter, Robert Wild, has incurred a knee injury arising
out of his employment and in the course of his employment with the city.
The disability resulting from the injury was agreed upon by
the city and Wild as a 14 1/4% permanent disability. This agreement is known as a Stipulated Finding and Award. A
permanent disability award equals $6,142.50. The city would still be liable for future medical costs for treatment of Robert Wild's knee injury.
FISCAL IMPACT:
The Stipulated Finding and Award will cost $6,142.50 plus
future medical care.

Dear Mr. Pieti:
Mr. Wild is a firefighter and was 34 years old when he injuried his left knee while climbing down a bank to assist a drowning victim.
The knee required surgery and treatment was provided by
Dr. Esch. We tried to settle his case when he became Permanently
Stationery, but he secured the services of an attorney instead,
who had him examined by Dr. Phillips.
Both medical reports are rated. and our report of Dr. Esch rates 14 1/4%, while the report of Dr. Phillips rates 17%.
I have tentatively agreed, subject to your approval, to settle this claim by was of a Stipulated Findings and Award, for 14 1/4%, which is based an our medical, with a (may need)
future medical. This would amount to $6 ,[42, So.

RESOLUTION NO. 8330
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING A STIPULATED FINDING AND AWARD FOR A
ROBERT WILD - WORKERS' COMPENSATION CLAIM IN THE CASE OF
WHEREAS, the City Council has established and clearly defined
its authority to settle workers' compensation claims in excess of
five thousand dollars ($5,000) ; and
WHEREAS, the claim of ROBERT WILD is approximately $6,142.50;
and
WHEREAS, the City Council authorizes a settlement in that
amount;
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council authorizes and directs the City
Manager to obtain a Stipulated Finding and Award in the workers'
compensation case of ROBERT WILD in the amount stated plus future
medical care.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 7th day of January , 1986, by
the following vote to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
