IN THE CITY OF CARLSBAD RECOMMENDED ACTION: Adopt Resolution No. r3qq to provide parking for handicapped persons and to regulate traffic on privately owned off-street parking facilities. Due to changes in the California Vehicle Code, Resolution No. 6213 adopted August 20, 1980 regulating enforcement of handicapped parking and enforcement of the vehicle code provisions on certain privately owned parking facilities needs to be modified. The modified resolution will enable the police department to continue enforcing handicapped parking provisions of the vehicle code and will also allow enforcement of certain vehicle code provision relating to speed if the property owner posts the property as specified in California Vehicle Code, Section 21107.8. The provision on speeding vehicles applies only to those properties in Exhibit A. A "Ten Day Notice of Public Hearing" has been given to property owners cited in Exhibit A. WHEREAS, the City Council of the City of Carlsbad, California desires to provide adequate parking in the City for handicapped persons: and WHEREAS, the City Council finds that there are certain privately owned and maintained off-street parking facilities generally held open for use by the public for purposes of vehicular parking; and WHEREAS, the City Council has held a public hearing after notice to the owners and operators of the privately owned off-street parking facilities; and WHEREAS, the City Council is authorized, by Vehicle Code Sections 21107.8, 22507.8, 22511.7 and 22511.8 to enact this resolution; and WHEREAS, the City Council adopted Resolution No. 6213 to provide €or handicapped parking and Vehicle Code enforcement on privately owned parking facilities and that resolution has been obsolete because of amendments to state law, but the Council desires to continue the program established by Resolution No. 6213, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad, California establishes the following regulations pertaining to handicapped parking: 1. That the City Manager or his designee shall have the authority to designate parking stalls or spaces on any street or on any publicly owned, leased or controlled off-street parking facility for exclusive use by handicapped persons. 3. That the owners or operators of any privately owned and maintained off-street parking facility shall designate handicapped parkinq stalls or spaces and shall provide at the owner's or operator's own expense identifying marks and signs as required by the State Vehicle Code and Administrative Code. The location and number of the spaces or stalls shall be approved by the City Manager or his designee. 4. That the City Council finds that the following privately owned and maintained off-street parking facilities are generally held open for use by the public for purposes of vehicular parking; see list marked Exhibit A, attached hereto and made a part hereof. The provisions of Section 22350, 23103 and 23109 and Division 16.5 of the Vehicle Code shall apply to said facilities if the owner posts the signs required by Section 21107.8 of the Vehicle Code. 5. This resolution is adopted pursuant to authority granted in Vehicle Code Section 21107.8, 22507.8, 22511.7 and 22511.8. 6. NOTICE OF PUBLIC HEARING RE: PROVISION FOR PARKING FOR HANDICAPPED PERSONS AND ENFORCEMENT OF CERTAIN VEHICLE CODE PROVISIONS ON PRIVATELY OWNED AND MAINTAINED OFF-STREET PARKING FACILITIES. On January 7, 1986, the Carlsbad City Council will hold a public hearing at 6:OO P.M. in the City Council Chambers, 1200 Elm Avenue, to consider adoption of a resolution requiring handicapped parking spaces and enforcement of vehicle code provisions relating to speeding on private property.
