ITEM EXPLANATION: Staff is proposing to initiate District. La Costa Avenue widening 2. Bridge widening over 1-5 at: a. La Costa Avenue b. Poinsettia Lane c. Palomar Airport Road Before the proposed District boundary can be defined, the area of benefit must be determined. This Consultant Agreement is for the purpose of developing the area of benefit and its boundaries, allocate the cost of improvements and determine the fee apportionment. A Benefit District is an equitable way to spread the cost of facilities that will serve a large portion of the City. Upon completion of the study, the Engineer will prepare a report of the findings, alternatives and recommendations which will be presented to Council. A public hearing will also be required. FISCAL IMPACT: The estimated cost to set up the district is $65,000 including $48,000 fixed fee for the consultant services, legal counsel, staff time and miscellaneous expenses. FOR CONSULTING ASSESSMENT ENGINEERING S-ERVICES. The City Council of the City of Carlsbad, California does hereby resolve as follows: 1. The Fourth Supplemental Agreement to an Agreement between the City of Carlsbad and the firm of Neste, Brudin & Stone, Inc. for consulting assessment engineering services is hereby approved. 2. The Mayor of the City of Carlsbad is hereby authorized and directed to execute such agreement for and on behalf of the City of Carlsbad. 3. Funds in the amount of $65,000. are hereby appropriated for this project and are hereby transferred from the unappropriated balance in the General Capital Construction Fund to the project account. LEWIS, Mayor Pro-Tem Ak!T%U$ENgi&rk (SEAL) 4TH SUPPLEMENTAL AGREEMENT TO AGREEMENT FOR ASSESSMENT ENGINEERING SERVICES DATED MARCH 13, 1985 (MASTER AGREEMENT) THIS 4TH SUPPLEMENTAL AGREEMENT to the above described agree- ment as approved by the City Council of the City of Carlsbad on March 19, 1985, hereinafter referred to as "Master Agree- ment", is made and entered into as of the day of , 1986, by and between CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "City" and NESTE, BRUDIN & STONE INCORPORATED, hereinafter referred to as "Consultant". RECITALS City requires the services of an assessment engineering con- sultant to assist in processing a Bridge and Thoroughfare Benefit District referred to as the La Costa - 1-5 Benefit District; and The City Council on January 7, 1986 directed the City staff to proceed with the establishment of a Bridge and Thoroughfare Benefit District; NOW, THEREFORE, City and Consultant mutually agree to supple- ment the above referenced agreement as follows: -1- .. A 1. CONSULTANT'S OBLIGATION The following paragraphs are intended to encompass all duties and responsibilities of the Consultant for the estab- lishment of a Bridge and Thoroughfare Benefit District to fund the construction of improvements to La Costa Avenue from El Camino Real to 1-5 and to widen three bridges over 1-5 at La Costa Avenue, Poinsettia Avenue and Palmar Airport Road. In addition, Consultant shall be responsible for providing public information with regard to the Benefit District for City. Consultant shall perform all work necessary to assist the City Engineer in processing the Benefit District. The work shall include but not be limited to the following as directed by the City Engineer: a. Define Benefit District boundary and all lands within boundary subject to payment of a fee as a condition of approval of a building permit. b. Benefit boundary to be determined by a traffic analysis using SANDAG data to produce an assignment of origin and destination within traffic assignment zones previously established. This will identify traffic volumes originating from specific areas and utilize the proposed facilities to be funded from this benefit district. This will be the primary basis for determining benefits. c. Secure aerial photos for the purpose of identifying developed and undeveloped land and other land uses. -2- -. d. Allocate costs of improvements and fee apportion- ment. Review alternatives. e. Prepare and mail notices of public hearing to all properties that may be required to pay a fee. f. Prepare written report defining project costs, boundaries of the area of benefit, method of allocation of costs to the area of benefit. g. Attend all public hearings and make presentation to City Council. h. Perform all services pursuant to Section 66484 of the Government Code and Section 20.08.140 of the City of Carlsbad Municipal Code. 2. ADDITIONAL SERVICES When authorized in writing by the City Engineer, Consul- tant shall perform or obtain from consultants or subcontractors approved by City, additional services in connection with the Project not otherwise provided for in this Agreement. Said additional services shall be paid for by City as provided in Section 5 of the Master Agreement. 3. PERIOD OF SERVICE Work shall begin immediately after receipt of notifica- tion to proceed by the City Engineer. Work shall proceed in a diligent manner to conclusion according to a schedule approved by the City Engineer. Extensions of time may be granted by the City Engineer in accordance with Section 3 of the Master Agreement. - 3- -: The date of the public hearing before the City Council is tentatively set for ADril 15, 1986 4. FEES TO BE PAID TO CONSULTANT City shall pay Consultant for services described under Section 1 of this Supplemental Agreement, a lump sum fee of Forty-Eight Thousand Dollars ($48,000) . Upon the execution of this Agreement, any payments made by or billed to City by Consultant on an hourly rate basis pursuant to the Master Agreement for this Benefit District shall be credited to and be considered as included in the lump sum fee set forth above in this Section. IN WITNESS WHEREOF, this Supplement to Agreement dated March 13, 1985, has been executed by the parties through their duly authorized representatives as of the date first herein- above written.
