PER ~ RECOMMENDED ACTION: TITLE: WORKERS' COMPENSATION INSURANCE FOR RESERVE DEPT. HD. CITY MGR. POLICE OFFICERS Adopt Resolution No. 8394 to provide workers' compensation insurance for Reserve Police Officers. ITEM EXPLANATION : City Council Resolution No. 7408 adopted November 15, 1983, designated Carlsbad Reserve Police Officers as Disaster Service Workers. This action made the provisions of Chapter 10, Division 4, Part 1 applicable to Reserve Police Officers. This means workers' compensation insurance for Reserve Police Officers was provided by State Compensation Insurance Fund instead of being provided by the city. A recent Appeals Court decision may change the interpretation of the applicable section of the Labor Code. To insure Carlsbad Reserve Police Officers have continued protection regardless of the outcome of any court decisions. The attached resolution is forwarded for City Council consideration. FISCAL IMPACT: No fiscal impact until such time as a work related injury occurs and Disaster Service Worker coverage is refused at which time the city would absorb the workers' compensation costs. EXHIBITS : Resolution No. 8374 extending the city's self insured workers' compensation coverage to Reserve Police Officers if State Compensation Insurance Fund coverage is not applicable. 1 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8396 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, EXTENDING THE CITY'S SELF INSURED WORKERS' COMPEN- SATION COVERAGE TO RESERVE POLICE OFFICERS IF STATE COMPENSATION INSURANCE FUND COVERAGE IS NOT APPLICABLE. WHEREAS, City Council Resolution No. 7408 designated Reserve Police Officers as Disaster Service Workers in compliance with the provisions of Chapter 10, Division 4, Part 1 of the Labor Code; and WHEREAS, subsequent state court decisions may modify interpretations of these portions of the Labor Code. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That in any case where Carlsbad Reserve Police Officers are not protected by workers' compensation insurance provided by the State Compensation Insurance Fund as Disaster Service Workers, they are protected by the workers' compensation insurance provided by the city. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlsbad city Council held on the 11th day of February , 1986, by the following vote to wit: AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine NOES: None ABSENT: None ATTEST: ALETHA L.
