RECOMMENDED ACTION:
Adopt Resolution No. BS(ofaccepting easements for sewer lines and
appurtenances, ingress and egress and incidental purposes.
ITEM EXPLANATION:
In order to properly install a planned sewer line near the intersection of
El Camino Real and Haymar Drive, it is necessary that certain easements be
deeded to the city.
Trunk System which will cross a part of the May Stores parking lot.
Parking Authority is dedicating the easements.
minimize interference with shoppers.
FISCAL IMPACT:
Obtaining dedications for the installation of the sewer line will save the
expense of right-of-way acquisition.

EASEMENT FOR SEWER LINES AND APPURTENANCES
An easement for sewer lines and appurtenances, ingress and egress, and incidental purposes in, over, under, along hnd across a portion of Lot 9 of Carlsbad Tract No. 76-18, (Plaza Real Shopping Center) in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 8956, filed in the Office of the County Recorder of said County, August 11, 1978 as File No. 78-342265, said easement being a strip of land 20.00 feet in width, lying 10.00 feet on each side of a center line described as follows:
PARCEL 1
Beginning at a point in the East line of said Lot 9, which bears South 3'45'48" East (Record South 3'45'47" East) 82.78 feet from the Southeast corner of Lot 10 of said Map No. 8956; thence South 82'32'48" West 99.28 feet; thence North 45'30'33" West 318.21 feet; thence South 80"00'51" West 224.91 feet to a point designated herein as Point "A"; thence North 12'22'51" West 122.67 feet, more or less, to a point in the Northerly line of said Lot 9, said point being in the arc of a 95.00 foot radius curve concave Northeasterly, a radial line to said point bears South 33O34'36" West.
The sidelines of the above described easement are to be prolonged or shortened so as to terminate Easterly in the East line of said Lot 9, also being the Westerly sideline of El Camino Real and to terminate Northerly in the North line of said Lot 9, also being the Southerly sideline of Haymar Drive, all as shown on said Map No. 8956.
PARCEL 2
Beginning at Point "A" designated in Parcel 1 above; thence South 56'53'59" West 70.00 feet to a point of terminus of said center line.
The sidelines of the above described easement are to be prolonged or shortened so as to terminate Easterly in the sideline of Parcel 1 above and to terminate Westerly in a line which bears North 33"06'01" West through said point of terminus.

Beginning at a point which bears North 5°00'00" West 10.00 feet . from the Northwest corner of Lot 11 of said Map NO. 8956; thence parallel with and 10.00 feet Northerly, measured at right angles, from the North line of said Lot 11, North 85°00'00'' East 115.22 feet to a tangent 600.00 foot radius curve concaved Northerly; thence Northeasterly along the arc of said curve, through a central

The sidelines of the above described easement are to be prolonged or shortened so as to terminate Easterly in the boundary of said Lot 9, also being the Southerly sideline of Haynar Drive and to terminate Westerly in the Northerly prolongation of the West line of said Lot 11, all as shown on said Map No. 8956.

RESOLUTION NO. 8408
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING GRANT DEEDS FOR SEWER LINE INSTALLATION PURPOSES
WHEREAS, the Carlsbad Parking Authority has submitted two corporati
grant deeds conveying easements to the City of Carlsbad for sewer line
purposes; and,
WHEREAS, said deeds are on file in the Office of the City Clerk; ar
WHEREAS, the City Council of the City of Carlsbad has determined it
be in the public interest to accept said deeds;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C
as follows:
1. That -the above recitations are true.and correct.
2. That the grand deeds conveying easements to the City of Carlsba
sewer line purposes are hereby accepted.
3. That the City Clerk is hereby authorized and directed to cause
original deeds to be recorded in the Office of the County Recorder of
San Diego County, State of California, with the appropriate certificate
acceptance attached.
