SP- 186 (A) -ECONOMY INNS/ZCA- 19 1 - CI1 CITY OF CARI;SBAD RECOMMENDED ACTION: Both the Planning Commission and staff are recommending thai City Council Introduce Ordinance Nos, 9 798 and 9 7579 APPROVING SP-l8Q(A) and ZCA-191. ITEM EXPLANATION , The applicant, Economy Inns is requesting an amendment to S Plan 186 which established a comprehensive development plan 23.6 acre site at the northeast corner of Poinsettia Lane a Avenida Encinas adjacent to Interstate 5. The amendment as proposed would provide for one freestanding sign to identif the freeway oriented uses in the specific plan area. In or( amend the specific plan, however, a zone code amendment is necessary. Specifically, the existing sign restrictions in SP-186 prov one freeway-oriented freestanding sign for the specific pla The sign was intended to identify the name of the center on not the names of individual uses. The applicant has propos modification of this regulation to permit name identificati the freeway oriented uses 3n the site. This request is bei because the freeway oriented uses (hotels/motels) in the so portion of the site are not visible to motorists on Interst because of the location of the Kaiser Medical Offices. The applicant believes that this lack of visibility has had a significant financial impact on these businesses. The Planning Commission and staff recommended approval of t proposed revision to the sign program since the specific pl has been further subdivided and lots were developed indeper of each other. The Planning Commission and staff also felt better to combine all the uses under one common sign with individual identification now than possibly consider a numk requests in the future for each lot to have its own freeste sign. In addition, the design of the sign would be compati the Spanish style of architecture approved for SP-186. The corresponding Zone Code Amendment was proposed by the C it was needed to modify the definition of a freeway service facility. Specifically, greater flexibility will be permit determining sign requirements for freeway service €acilitic 186(A). However, still only one freeway sign would be perc each corner of a freeway interchange. In addition, the prc amendment provides adequate safeguards to ensure that freev service facility signs are appropriate, do not impact other properties and avoid clutter. STAFF REPORT DATE : JANUARY 22, 1986 TO : PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: SP-l86(A) - ECONOMY INNS - An amendment to existing Specific Plan 186 to allow a freeway-oriented, freestanding sign identifying tourist-oriented uses property located at the northeast corner of Poinsett Lane and Avenida Encinas in the C-2 zone. I. RECOMMENDATION That the Planning Commission recommend APPROVAL of the Notice Prior Compliance issued by the Planning Director and ADOPT Resolution No. 2532 recommending APPROVAL of SP-l86(AFthe City Council based on the findings and subject to the conditi contained therein. 11. PROJECT DESCRIPTION The applicant is requesting an amendment to Specific Plan 18( which established a comprehensive development plan for the 2: acre parcel of land at the northwest corner of Poinsettia La1 and Avenida Encinas. Specifically, the sign restrictions of 186 provided for one freeway-oriented, freestanding sign for specific plan area. The sign was intended to identify the c only and not individual uses. The applicant has proposed a modification to this regulation to permit freeway identif ica of the tourist-oriented uses on the site. The amended wordi to SP-186 is attached as Exhibit "X". 111. ANALY S I S Planning Issue 1) Does the proposal ensure compliance with the intent and guidelines of Specific Plan 186? Discussion When Specific Plan 186 was approved, the southern third of t site was designated as Tourist/Commercial (zoned CT) while t northern portion was designated Community Commercial (zoned (see Location Map). The intent of the CT zone was to provic' uses which are oriented toward the traveling public (i.e., hotels, motels, restaurants, service stations, etc. 1. The of the Commercial zone was to provide a wide range of retai: facilities that would cater to the traveling public as well local residents. @ m Since adoption of the Specific Plan, the character of the usc approved thus far has deviated from the oriqinal intent. Twc motels have been approved outside of the CT area, in the C-2 area, Kaiser Medical Offices, and two auto dealerships have approved at the northern extremity. Therefore, the concept ( neighborhood retail center with one name has changed because uses are no longer similar enough to warrant identification I a common name, Due to the location of the Kaiser Medical Offices, which are located closer to 1-5 than the other buildings, the Tourist/ Commercial uses are not visible to southbound motorists on Interstate 5. This lack of visibility has a very detrimenta impact on business at these establishments since it is diffic for motorists on Interstate 5 to see the motels in time to st exit the freeway. The lack of visibility has made it diffic to rent rooms and to develop Lots 1A and 1B (see attached Letters). Rather than proposing individual signs the existi motel owners have agreed to utilize their one sign as a mean increasing visibility from the freeway. The sign is propose( be located at the northernmost motel site to give the public much notice as possible prior to approaching the freeway exi. The sign is proposed to be 37 1/2 feet in height with a sign of 250 square feet. Each of the six potential users will ha approximately 41.6 square feet of signage. Specific Plan 18 allows a sign 35 feet tall and 150 square feet in area. The applicant believes the increased height is necessary so that landscaping will not obscure the lower portion of the sign, sign section of the Zoning Ordinance does permit the Plannin Commission to grant an increased sign height for freeway ser facilities due to "severe constraints on view caused by topography, natural vegetation, or existing buildings" , Two hundred fifty square feet of sign area is also permitted for freeway service facilities when there are two or more uses o lot. The applicants believe that this additional size is ne to provide adequate space to identify the tourist oriented u on the site. The applicants believe that this identificatio necessary for the success of the tourist oriented uses on Lo 4. Although the existing and proposed uses are not on one 1 all of the lots south of Lot 5 contain or will contain freew oriented uses, Due to the lack of visibility these uses hav and their need to attract business from Interstate 5, staff believes that it is justifiable to use the flexibility of a specific plan to allow a 250 square foot freeway service typ sign on the northerly edge of Lot 4. The sign as proposed b applicant is shown on Exhibits 'rY1l and ''Z" , If this amendme approved this sign would be subject to approval by the Plann Director. SP-186 recognized that freeway identification is important for travel-oriented uses. -2- .- @ @ In summary, the existing specific plan for this area is curre more restrictive on freeway oriented signs than is the City's Sign Ordinance. The specific plan amendment (see Exhibit "X" would provide this area with the same freeway signage as permitted outside the boundaries of the specific plan, Becac of the need for adequate signage for freeway oriented uses ar because the proposed sign will not exceed City Ordinance standards , staff is recommending approval , IV. RECOMMENDATION That the Planning Commission recommend APPROVAL of the Negatj Declaration issued by the Planning Director and ADOPT Resolut No. 2539, recommending APPROVAL OF ZCA-191 to the City Councj based on the findings contained therein. 11. PROJECT DESCRIPTION This amendment to the Zoning Ordinance has been proposed by I City to modify the definition of a freeway service facility. Specifically, greater flexibility will be permitted in determining sign requirements for freeway service facilities areas of the City covered by a specific plan. Also on the agenda, is a request for a Specific Plan amendment (SP-l86(A] This proposal cannot be approved unless ZCA-191 is also approved. Currently, the Sign Ordinance states as follows: (6) "Freeway service facility" means a lot or para located at the apex of a freeway interchange quadrant wh: contains one or more of the following uses: a restaurani motel, or an automobile service station. When two or mol adjoining lots or parcels are joined in ownership, share common access by means of recorded easement or have an approved common parking-facilities plan, they may be considered a freeway service facility for purposes of th. chapter. PROPOSED AMENDMENT Staff proposes amending Section 21.41.030(6) as follows: (6) "Freeway service facility" means a lot or parce located at the apex of a freeway interchange quadrant whi contains one or more of the following uses: a restaurant motel, or an automobile service station. When two or mor adjoining lots or parcels are joined in ownership, share common access by means of recorded easement, have an appr common parking-facilities plan, or are covered under an approved specific plan, they may be considered a freeway service facility for purposes of this chapter. Unless addressed under a specific plan as stated above, in no ev shall any lot or parcel or portion thereof located more t six hundred sixty feet from the apex of a freeway interch quadrant be considered part of a freeway service facility IV. ANAYLSIS Staff believes that the existing Ordinance provides good safeguards to ensure that freeway service facility signs are appropriate, do not impact other properties, and avoid unattractive clutter. Staff does believe, however, that ther are instances when the ability to exercise some flexibility IT be desirable. This situation has occurred at the northwest corner of Poinsettia Lane and Avenida Encinas. As stated in the staff report for SP-l86(A) the southerly fou lots at this location have developed with tourist-oriented ty of uses which are dependent on the traveling public for their livelihood. They are not jointly owned, nor do they share a common access or parking plan; therefore, the definition of a freeway service facility cannot be met and all the uses are n eligible for a freestanding sign. Due to the location of the Kaiser Medical building which is closer to the freeway than t tourist-oriented uses, these uses are not highly visible to t traveling public. For this reason, an amendment to the speci plan has been requested and recommended for approval by staff Staff believes that in situations where signs can be regulate through the use of a specific plan that the objectives of the Sign Ordinance can still be safeguarded. In providing flexibility for minor modifications, staff in no way intends amendment to provide for additional signs that would not be appropriate. Rather, that flexibility may be applied in unus circumstances when the goals of the Ordinance are met and goc planning may dictate. In addition, the only other freeway intersection covered by a specific plan is Car Country which not classify as a tourist-oriented use. 2 a e *I Staff believes that in consideration with ZCA-191, Economy Inns the intent of the Sign Ordinance has still been met and, therefore, recommends approval of this zone code amendment. V.
