RECOMMENDED ACTION:
By motion adopt Resolution No. /& making findings at public hearing pursuant to Chapter 27 of the "Improvement Act of 1 9 1 1 .
By motion adopt Resolution No. &&!J-making appointments in a special assessment district.
ITEM EXPLANATION:
On January 28, Council approved Resolution No. 8373 which
orders the installation of improvements on Appian Road and also established that this meeting of City Council is a public hearing to hear any bjections to the proposed improvements. Resolution No. /'&2+? indicates that the hearing was held pursuant to the provisions of Chapter 27 of the "Improvement Act of 191 1" and directs the Superintendent of Streets (City
Engineer) to cause the proposed improvements of the assessment district to commence if the district owner does not start the
work within 60 days. That 60-day period ends April 1, 1986.
If the required right-of-way is not dedicated to the City by the Frazees prior to this hearing then condemnation of the right-of-way is necessary. An appraisal will be made on the subject property and acquisition costs will be added to the
special assessment.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, MAKING
FINDINGS AT PUBLIC HEARING PURSUANT
TO CHAPTER 27 OF THE "IMPROVEMENT ACT OF 1911"
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD, CALIFORNIA
has instituted proceedings pursuant to the provisions of Chapter
27 of the "Improvement Act of 1911", being Division 7 of the
Streets and Highways Code of the State of California, for the
construction of certain authorized improvements in a special
assessment district known and designated as
ASSESSMENT DISTRICT NO. 86-2 (APPIAN ROAD/CHAPTER 27)
(hereinafter referred to as the "Assessment District); and,
WHEREAS, Notice has been given in the manner and form as
required by law and specifically Article 11, Part 3 of Division 7
of the Streets and Highways Code, and a Certificate of Compliance
is on file in the Office of the City Clerk; and,
WHEREAS, a public hearing has been held and all testimony and
evidence heard relating to the works of improvement as proposed
for the Assessment District, and the legislative body is desirous
at this time to proceed.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That all protests of every nature are hereby
overruled and denied.
SECTION 3. The Superintendent of Streets is hereby directed
to proceed and cause the construction of the works of improvement

in said Assessment District if said construction is not commenced
within sixty (60) days after notice is given to the property owner
to so cause the work to be done.
SECTION 4. That the works of improvement shall be done and
carried through and financed pursuant to the provisions of Chapter
27 of the IIImprovement Act of 1911", and for all particulars as to
these proceedings, reference is made to the Resolution ordering
the installation of the public improvements and instructing the
Superintendent of Streets to so give notice.
SECTION 5. The works of improvement and project shall be
financed pursuant to the provisions of said Chapter 27, and bonds
shall issue to represent unpaid assessments in accordance with
Division 7 of the Streets and Highways Code of the State of
California ("Improvement Act of 1911") to represent each assess-
ment of $150.00 or more remaining unpaid following the expiration
of a 30-day cash collection period. Such bonds shall be issued
and sold as this legislative body directs and shall be dated
following the expiration of the cash payment period.
PASSED, APPROVED and ADOPTED at a regular meeting of the City
Council held on the 18th day of March , 1986, by

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, MAKING APPOINTMENTS IN A SPECIAL ASSESSMENT DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD, CALIFORNIA
is considering the formation of a special assessment district,
under the provisions and authority of Chapter 27 of the
"Improvement Act of 1911", ,being Division 7 of the Streets and
Highways Code of the State of California, for the construction of
certain authorized works of improvement and acquisition of rights-
of-way, if necessary, -- said assessment district to be known and
designated as
ASSESSMENT DISTRICT NO. 86-2 (APPIAN ROAD/CHAPTER 27)
(hereinafter referred to as the "Assessment District"); and,
WHEREAS, at this time the City Council is desirous of making
the required appointments and designating persons to perform
certain duties, in order to allow the proceedings to go forward to
completion in accordance with the provisions of law.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That the CITY ENGINEER is hereby appointed to
perform all of the duties and functions of the Superintendent of
Streets for the above referenced Assessment District.
SECTION 3. That the place for recordation of the assessment
roll and diagram shall be in the Office of the Superintendent of
Streets, and said assessment roll and diagram, upon recordation,
shall be kept as a permanent record.

SECTION 4. That F. MACKENZIE BROWN, INC., Attorneys at Law,
is hereby appointed as Special Council for the purposes of
preparing proceedings and issuing an approving opinion attesting

Dear Mayor and City Council Members,
As owners of approximately 869 of the proposed Appian Road improvement distric€, we respectfully submit that we do not wish to participate in the district for the following reasons:
First and foremost, the $43,000 plus cost is too much
for one family to pay. We have done nothing to justify
such an expense, that benefits us so little, and the citizens of Carlsbad so greatly. We have lived at tnis location for more than 20 years, and the road was more than sufficient for the amount of traffic that used it, until the land was developed around us. Now we are being = asked to subsidize the developers.
Secondly, when Larwin Co. had their final map approved, one.of the conditions was that they had to construct the intersection of Elm and Appian, and complete Appian back up to the existing grade. This was only done for a half width street.
Thirdly, we proposed in May of 1984, to dedicate the
land (more than 6,000 square feet) if the City would make the improvements. The Council approved that pro- posal, but an agreement was never drawn up, because of a nisunderstanding over a 1965 agreement that we had with the City to put in curbs, gutters, and sidewalks
on the existing street. We thought then, as we do now,
that giving the property in exchange for the improve-
ments was a fair deal. We are still willing to sit
down and talk about what is fair.

Dear Mayor and Council Members,
In order to avoid any costly and lengthy legal battles, although we feel it is a violation of our Fifth Amendment rights (the government can not force one person to bear public burdens which, in all fairness and justice, should be borne by the public as a whole) we would be willing to put in all improvements to the portion of Appian Road in front of our home, including all necessary permits, and construction to city standards. Upon completion and acceptance by the city, we will dedicate the property and improvements to the city; provided the city drop all accumulated fees, lega*l and engineering, give us all engineering plans already done, allow us to place the dirt from the excavation on the proposed park site on Elm Avenue, and participate in the cost of the improvements for $13,500.

Dear Aletha:
It is my understanding that the public hearing for the referenced Assessment District
has been continued to March 18, 1986. Please note for your agenda material that the
Resolution Making Findings, as previously prepared and transmitted to you, will
require a 4/5's vote for its adoption. I have enclosed herein an amended Order of
Procedure, if you so desire, that does show the requirement for the 4/5's vote.
Please be reminded that the property owner has 60 days in which to complete the work,
and thus the City could not proceed to advertise for bids until the completion of the
60 day period. Also, at this time it is still necessary for the City to obtain the
necessary rights-of-way for the works of improvement, and if the property owner is
unwilling to dedicate the right-of-way or make an arrangement with the City, the City
will have to generally accomplish the following:
A. Appoint an appraiser
B. Make the appraisal

If the matter has not been resolved, I will gladly work with the City in coordinating
a timing schedule as it relates to the above and coordinate that activity with the
authorization for bidding and/or award of construction contracts under the Chapter 27
proceedings.

Enclosed herein please find your legal Notice as it relates to the proceedings for the formation of a special assessment
district which will allow for the completion of certain public
improvements, specifically those fronting your property. Upon receipt of the legal Notice, you have sixty (60) days to commence the construction of the frontage public improvements. If the construction is not commenced within sixty (60) days, the work shall then be performed by the City.
Please note that the Notice sets forth the estimate of the costs
of the improvements and incidental expenses of the proceedings, not including acquisition, if the work is performed by the City to be $43,000.00. This Notice does not include any costs for acquisition of right-of-way, and if the right-of-way is not dedicated to the City, it will be necessary to increase the estimated cost estimate and assessment by all costs of right-of- way, including cost for land acquisition, appriasals, negotiations and legal fees.

NOTICE TO CONSTRUCT IMPROVEMENTS
NOTICE IS HEREBY GIVEN by the C,ITY COUNCIL of the CITY OF CARLSBAD, CALIFORNIA, pursuant to the provisions of Division 7, Part 3, Chapter 27, Sections 5870 and 5899, inclusive, of the Streets and Highways Code of the State of California, that the public works of improvement as set forth below must be constructed in front of the property as
shown on the map attached hereto in a special assessment district designated as
ASSESSMENT DISTRICT NO. 86-2 ( APP IAN ROAWCHAPTER 27)
(hereinafter referred to as the "Assessment District"). All work and materials used in the construction of the improvement shall conform to the latest standard specifications and plans of the City.
NOTICE IS HEREBY FURTHER GIVEN that if said construction is not commenced within sixty (60) days after this Notice is given, and diligently and without interruption prose-
cuted to completion, the Superintendent of Streets shall cause the construction to be
done and the costs of said work shall be a lien on the property. If said amount is not paid upon confirmation, serial bonds shall be issued in accordance with Division 7 of
the Streets and Highways Code ("Improvement Act of 1911") to represent each assessment of One Hundred Fifty Dollars ($150.00) or more remaining unpaid for thirty (30) days after the date of recordation of the diagram and assessment for this improvement. The serial bonds shall extend over a period not to exceed NINE (9) YEARS from the second
day of January next succeeding the next September 1st following their date. The interest rate on said shall not exceed the current legal maximum rate of 12% per annum.
NOTICE IS HEREBY FURTHER GIVEN THAT ON TUESDAY, THE 4TH DAY OF MARCH, 1986, AT THE HOUR
