By motion adopt Resolution No. &&!J-making appointments in a special assessment district. ITEM EXPLANATION: On January 28, Council approved Resolution No. 8373 which orders the installation of improvements on Appian Road and also established that this meeting of City Council is a public hearing to hear any bjections to the proposed improvements. Resolution No. /'&2+? indicates that the hearing was held pursuant to the provisions of Chapter 27 of the "Improvement Act of 191 1" and directs the Superintendent of Streets (City Engineer) to cause the proposed improvements of the assessment district to commence if the district owner does not start the work within 60 days. That 60-day period ends April 1, 1986. If the required right-of-way is not dedicated to the City by the Frazees prior to this hearing then condemnation of the right-of-way is necessary. An appraisal will be made on the subject property and acquisition costs will be added to the special assessment. FISCAL IMPACT: The Engineer's Estimate at this time is break down is as follows: Construction Consultant (design is complete paid by the City) City staff engineering Legal expenses Cost for printing and advertis Bond servicinq and collection $44,500. If the Frazees do not construct the necessary improvements within 60 days, then an appropriation of additional funds will be necessary to cover the above estimated construction costs. Dear Mayor and City Council Members, As owners of approximately 869 of the proposed Appian Road improvement distric€, we respectfully submit that we do not wish to participate in the district for the following reasons: First and foremost, the $43,000 plus cost is too much for one family to pay. We have done nothing to justify such an expense, that benefits us so little, and the citizens of Carlsbad so greatly. We have lived at tnis location for more than 20 years, and the road was more than sufficient for the amount of traffic that used it, until the land was developed around us. Now we are being = asked to subsidize the developers. Secondly, when Larwin Co. had their final map approved, one.of the conditions was that they had to construct the intersection of Elm and Appian, and complete Appian back up to the existing grade. This was only done for a half width street. Thirdly, we proposed in May of 1984, to dedicate the land (more than 6,000 square feet) if the City would make the improvements. The Council approved that pro- posal, but an agreement was never drawn up, because of a nisunderstanding over a 1965 agreement that we had with the City to put in curbs, gutters, and sidewalks on the existing street. We thought then, as we do now, that giving the property in exchange for the improve- ments was a fair deal. We are still willing to sit down and talk about what is fair. Upon completion and acceptance by the city, we will dedicate the property and improvements to the city; provided the city drop all accumulated fees, lega*l and engineering, give us all engineering plans already done, allow us to place the dirt from the excavation on the proposed park site on Elm Avenue, and participate in the cost of the improvements for $13,500. I have enclosed herein an amended Order of Procedure, if you so desire, that does show the requirement for the 4/5's vote. Please be reminded that the property owner has 60 days in which to complete the work, and thus the City could not proceed to advertise for bids until the completion of the 60 day period. Also, at this time it is still necessary for the City to obtain the necessary rights-of-way for the works of improvement, and if the property owner is unwilling to dedicate the right-of-way or make an arrangement with the City, the City will have to generally accomplish the following: A. Appoint an appraiser B. Make the appraisal C. D. If the matter has not been resolved, I will gladly work with the City in coordinating a timing schedule as it relates to the above and coordinate that activity with the authorization for bidding and/or award of construction contracts under the Chapter 27 proceedings.
