APPLICANT; CITY OF CARLSBAD CASE NO: zc-337 The City Council of the City of Carlsbad, Californ: does ordain as follows: SECTION 1: Title 21 of the Carlsbad Municipal Cod1 amended by the amendment of a zoning map for a zone change M to RD-M-6.5Q on property as shown on the map marked ZC-33 Exhibit "B" , attached hereto and made a part hereof provide the site plan shall require City Council Approval. NOW, THEREFORE, BE IT RESOLVED by the City Council the City of Carlsbad, California as follows: A, That the above recitations are true and correct R. That the €indings of the Planning Commission as forth in Planning Commission Resolution No. 2518 (GPA/LU 85- Resolution No. 2525 (GPA/LU 85-7), and Resolution No. 2535 (GPA/LU 86-1) constitute the findings of the City Council. C. That in addition, the City Council makes the following findings: “1. Since January 1985, the City of Carlsbad I been undertaking a comprehensive review of the Land Use Ele of its General Plan. As part of that review a Council appo Citizens Committee prepared a comprehensive report and recommendation to the City Council. That report was subjec public hearings by both the Planning Commission and City Co Included in the recommendations of the Land Use Committee, recommendations concerning development on open space and sl areas. 2. On August 6, 1985, the City Council adopt€ , Interim Ordinance No. 9766, imposing certain temporary lane controls on property within the City, consistent with the 1 recornmendation of the Citizens Committee which reviewed the 1 Use Element. On September 3, 1985, the City Council adopt€ I Interim Ordinance No. 9771 which extended the restrictions Ordinance No. 9766 until July 20, 1986. On December 10, 1s the City Council approved in concept several land use propc not contained in the Citizens Committee report. The Councj finds that it is necessary to amend the Land Use Element 0‘ General Plan and appropriate sections of Title 21 of the Carlsbad Municipal Code to implement the Open Space policic previously approved by the Council. 3. This action of the City Council is consis’ with long standing policies and objectives of the City to significant open space areas within Carlsbad, to enhance t: environment of the City by protecting those significant opl space areas and to improve the quality of life within the ensuring that a sufficient balance between open space and developed areas continues to exist within the City. This will protect the public health, safety and welfare of the 2. Fur protection of open space areas will ensure both passive and active recreational opportunities for the citizens of Carlst This action will also protect the rights of prc owners by cleraly delineating those properties which are no1 developable, allowing the property owner a better opportuni' assess the development potential of their property. This action is consistent with the City's to provide housing opportunities for all economic sectors c community, because sufficient opportunities for new housing continue to exist within the City even though the absolute of housing units which may ultimately be constructed will k reduced. Reduction of residential densities and protection open space will ensure the quality of life and the environm within the City of Carlsbad. In addition, development of h for low and moderate income persons and families would most likely occur in areas of the City already designated for hi density residential development. These areas will be affec this action only to a limited extent." D. That the Land Use Element of the General Plan amended as follows: 1. GPA/LU 85-7 LA CORUNA PLACE: To change the L( Use Element from RPlH to RM for approximately 1.58 acres of property generally located on the south side of La Costa A west of La Coruna Place as shown on the map marked Exhibit GPA/LU 85-7 attached hereto and made a part hereof. 1 1 2. GPA/LU 85-13 ALGA HILLS: To change the Land Element from RMH to RM on approximately 64 acres of proper generally located on the south side of Alga Road east of Alicante Road as shown on the map marked Exhibit A - GPA/I 13 attached hereto and made a part hereof. 3.
