adopt Resolution No. gj4&L*
ITEM EXPLANATION
The City Council at your meeting of February 18, 1986, directed our
office to prepare documents granting an appeal filed by the Carlsbad
Unified School District of a condition of approval attached by the
Planning Commission to a conditional use permit for the Lake Calavera
Hills Elementary School. Resolution No. j*j£?£,, granting the appeal
and deleting Condition No. 5 regarding driveways and otherwise
approving the conditional use permit as a condition by the Planning
Commission is attached. If the City Council concurs, you should
take the action recommended above.

RESOLUTION NO.8422
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A CONDITIONAL
USE PERMIT CUP-280 FOR AN ELEMENTARY SCHOOL
ON PROPERTY GENERALLY LOCATED ON VILLAGES M AND N
OF THE CALAVERA HILLS MASTER PLAN
WHEREAS, the Planning Commission on January 22, 1986,
adopted Resolution No. 2529 approving a conditional use permit
for an elementary school on property generally located on
Villages M and N of the Calavera Hills Master Plan, and
WHEREAS, the Carlsbad Unified School District filed a
timely appeal, asking that Condition No. 5 of Planning
Commission Resolution No. 2529 be deleted, and
WHEREAS, the City Council at their meeting of February
18, 1986, held a public hearing to consider said appeal and
after hearing and considering all the evidence introduced at
that time has determined to grant the appeal.
NOW, THEREFORE BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
A. That the above recitations are true and correct.
B. That the appeal of the Carlsbad Unified School
District to be relieved of Condition No. 5 of
Planning Commission Resolution No. 2529 is granted
and that condition is hereby deleted. In all other
respects, the findings of the Planning Commission
constitute the findings of the City Council in this
matter.
C. That conditional use permit 280 as approved by
Planning Commission Resolution No. 2529 is approved
subject to all of the terms and conditions of that
resolution except number five.
