Planning and Engineering staff have reviewed the request and
have some concerns about the compatibility of the proposed
use. They are listed below:
1. Biological/archeological disturbance;
2. Adjacent homes, currently under construction (noise,
3. Soils, typically the soils are poor in this area
4. Drainage, to the Encinas Creek, already choked with
dust, spraying of crops);

recently executed ag lease referred to as Exhibit A. is owned by the Daon Corporation and lies in the Southeast corner of La Costa and is designated as a future high school site. The accompanyling aerial photograph approximately outlines the land to be farmed.

This land has been planned for a March planting which requires urgent preparation. Please specify the site work you deem appropriate, if any, in order to issue the permit.

REQUEST FOR AGRICULTURAL GRADING PERMIT - FUTURE HIGH
SCHOOL SITE ADJACENT TO CT 75-9(B) IN LA COSTA
Before an agricultural grading permit is issued for this site the applicant should be required to do a biological and archaeo- logical survey of the property, in order to comply with Ordinance No. 8105 recently approved by the City Council. Even though the applicant is only proposing agricultural grading the proposed grading will eliminate the native vegetation on the site and could impact any archaeological sites on the property.
In addition, Planning staff has some concerns as to whether the proposed large scale agricultural use would be compatible with
the single family homes that are being developed adjacent to this site. As shown by the attached map, a substantial number of units are under construction or approved for development adjacent to this site. Staff is particularly concerned about noise, dust, runoff and pesticide spraying from the agricutural use adversely impacting these residents. Staff has received a couple of complaints from existing single-family homeowners in the area regarding agricultural use on property immediately adjacent to the subject site.
The Planning Department would recommend that the following conditions be applied to the approval of any agricultural grading permit on the site: (1) the applicant should be required to provide detailed erosion control measures; (2) a bond should be posted for the hydroseeding of the site after the completion of the agricultural activity: (3) the setbacks from the proposed residences and the agricultural use should be a minimum of 300 feet in all areas: and (4) a biological and archaeological study
should be done .

RESOLUTION NO. 8442
-A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
AGRICULTURAL GRADING (PE 2.86.15) PERMIT,
SUBJECT TO CONDITIONS.
APPLICANT: UKEGAWA BROS., INC.
CASE NO.: PE 2.86.15
WHEREAS, on September 3, 1985 the City Council adopted
Ordinance No. 8105 establishing requirements for clearing of
vegetation; and
WHEREAS, on January 29, 1986 Ukegawa Bros., Inc.
requested issuance of a grading permit in accordance with
Ordinance No. 8105; and
WHEREAS, subject to conditions, this operation will not
cause damage to any environmentally sensitive areas; and
WHEREAS, in accordance with Council Policy No. 29 the
interim land use for agricultural purposes is hereby proposed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
A. That the above recitations are true and correct.
8. That, subject to the fulfillment of the following
conditions, the. agricultural grading permit is hereby
approved.
1. Prior to issuance of this agricultural grading
permit, the applicant shall submit to and receive
approval of a biological and archeological study
of the proposed area to be farmed.
2. This permit is subject to the express condition
that dust control, overspraying of fertilizers/
pesticides, and noise shall be kept to acceptable
levels, to be monitored by the public works
inspector. Prior to issuance of this agricultural
grading permit the applicant shall receive
approval of an erosion control plan by the City
Engineer.

Prior to issuance of this agricultural grading
permit, the applicant shall submit a soils survey
to justify the farming activity on this site. The
soils survey shall be reviewed and accepted by the
City Engineer.
Prior to the issuance of this agricultural grading
permit, the applicant shall clean up the silt
choked stream of the Encinas Creek, Silt from
recent farming activity shall be removed from the
creek bed, and the drainage path shall be restored
to an acceptable alignment and grade (close to
natural) as determined by the City Engineer and the Planning Director. (The removed silt shall be
placed in a non-erosive manner.)
This permit is subject to the express condition
that the applicant shall restore and revegetate
the site when the activity is discontinued. A
bond for this reseeding shall be posted with the
City Engineer prior to issuance of this grading
permit.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 18th day of March 9
1986 by the following vote, to wit:

PURPOSE:
To establish an interim policy for the use of land which is'not designated
as agricultural in the General Plan.
STATENENT OF POLICY:
It is tha policy of the City Coancil to encourage productive management of
Carlsbad's natural resources. 'This policy includes the temporary agri-
cultural use of land which is not designated as agricultural in'the
Ge'neral Plan. Such agricultural activity, whether carried dn by the
property owner or by n lessee, shall not inanyvay indicate that the
property will be zoned agriculture.

It is also the policy of the City Council that a Site Deveiopment Permit be
required for all agricultural activities conducted on previously undisturbe

As an additional part of this interim policy 2n agricultural advisory corn--
mittee shall be formed. This committee shall be comprised of citizens
from the agricultural community, Planning Commission, and City Council.
The committee's pvrpose will be to document agriculture's problems in
Carlsbad, evaluate and select various solutions, propose incentives for retaining farmland, and return a report to the Planning Commission and
City Council. This report would be considered as the basis for an
agricultural element toathe General Plan.
