The Planning Commission and staff are recommending that the City
Council direct the City Attorney's Office to prepare documents
DENYING Administrative Variance 85-8.
ITEM JIXPLtANATION
The applicant originally requested an administrative variance to
allow a six foot high grapestake fence eleven feet into the twenty
foot frontyard setback on a lot located on the north side of
Juniper Avenue between Garfield Street and the AT&SF Railroad. The
request was denied by the Planning Director because the four
findings required for a variance could not be made. Eventhe fence has been in existence for eight years it apparently

The applicant appealed the decision of the Planning Director to the
Planning Commission. A number of people spoke at the Planning
Commission hearing both for and against the requested
administrative variance. After hearing all of the relevant
testimony the Commission denied the request because they felt that
they could not make the four findings necessary to grant a
variance. Specifically, that there were no exceptional
circumstances, the applicant was not being denied a substantial
Property right granted to others in the same vicinity and granting
of the proposed variance would be materially detrimental to the
public welfare. The Planning Commission denied the requested
variance by a vote of 5-2.

ENVIRONM''NTAL REVIEW
The Planning Director has determined that this project is EXEMPT
from environmental review based on Section 19.04.07 of the Carlsbad
Environmental Ordinance.
FISCAL IMPACT
The applicant will provide all required public improvements to the
project. Also, the applicant has agreed to pay a public facilities
fee to offset the costs of providing all other public services.

CARLSBAD, CALIFORNIA, DENYING AN ADMINISTRATIVE VARIANCE
TO ALLOW A SIX FOOT FENCE TO ENCROACH ELEVEN FEET INTO
THE TWENTY FOOT FRONTYARD SETBACK ON PROPERTY GENERALLY
LOCATED ON THE NORTH SIDE OF JUNIPER STREET BETWEEN
GARFIELD STREET AND THE AT&SF RAILROAD.
APPLICANT: BEILBEY

WHEREAS, a verified application for certain property, to
wit:
An undivided 1/16 interest in Lot 1 of CT 73-30 of Map
7961 filed June 12, 1974,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as' provided by Titie Y1 of the 'Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 22nd day of
January, 1986, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing. and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors

Findings:
1. There are no exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because no other fences
six feet or higher are located more than five feet into the
20 foot frontyard setback.
2. The requested variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by
other property in the same vicinity and zone but which is
denied to the property in question because no other property
owner in the complex has had to fence in their frontyard
setback for privacy.
3) The granting of this variance might be materially detrimental
to the public welfare since it would create an undesirable
precedent and encourage other property owners to construct
illegal fences, then apply for variances to legitimize the
fence.

the AT&SF Railroad in the R-3 zone.
I. RECOMMENDATION
That the Planning Commission ADOPT Resolution No. 2531 DENYING
AV 85-8 based on the findings contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is appealing the Ple.ining Director's denial of an
Administrative variance to allow a six foot high grapestake fence
eleven feet into the twenty foot frontyard setback on a property
located as described above. The fence has been in existence at
its present location for approximately eight years. Staff could
not locate any record of a building permit for the subject fence.
This item was referred to the Planning Department by the zoning
enforcement officer who received a complaint about an illegal
fence in the frontyard setback at this location. The applicant
applied for -an administrative variance, but staff was unable to
make the necessary findings and had to deny the request. The
applicant is now appealing staff's denial of the administrative
variance.
II. ANALYSIS
Planning Issues
1. Can the four mandatory findings for a variance be made in
this -.case which are as follows:
A) Are there exceptional or extraordinary circumstances or
conditions applicable to the property that do not apply
generally to other property in the same vicinity and
zone?

b) Is the granting of this variance necessary for the
Preservation and enjoyment of a substantial property
right possessed by other property in the same vicinity
and zone?
c) Will the granting of this variance be detrimental to
the public welfare?
d) Will the granting of this variance adversely affect the
General Plan?
Discussion
Staff cannot make the four mandatory findings required to grant a
variance. The zoning code states that exceptional or
extraordinary circumstances must exist that do not generally
apply to other properties in the same vicinity and zone. The
applicant feels the subject property is extraordinary because the
patio to her condominium faces the street and to require a 42
inch high fence would not give her the security and
privac
desires. The staff feels this is not an unusual circumstancehe
since no other owner within the project or other property in the
vicinity has a fence located more than five feet into the twenty
foot setback.
A second issue is whether the applicant is being denied a
substantial property right enjoyed by other property owners in
the vicinity. Staff does not believe that the applicant is being
denied a substantial property right enjoyed by other property
owners in the vicinity. The single family homes and apartments
to the west of the subject property have less than a twenty foot
setback from Juniper Street. However, both of these properties
front on Garfield Street and are only required to have a 10'
street sideyard setback from Juniper Street. As shown by Exhibit
"A", the bulk of these buildings comply with the 10' setback
requirement, even though some architectural pop -outs in the
apartment project and porches on the single family homes appear
to violate the 101 setback requirement. The two single family
homes on substandard lots, directly across from the subject
property, have 181 rather than the required 20' frontyard
setback. However, it appears that both of these structures were
built long before the city incorporated and created any zoning
standards.

The Planning Commissions of the City of Carlsbad
voted
last Tuesday, January 22, 1985, to deny the request ofour-client, Marichu Beilby, for a variance for her six foot fence
in the front yard setback area.
This letter constitutes her appeal
to the CitCouncil
of the order of denial as set forth inthe Planning Commiss-
ion Resolution #2531.
We are aware that the Carlsbad code states that the appeal
must be heard within 30 days from the receipt of the a 1,
however, because the undersigned will be out of the country
through February, that time period is waived by Mrs. Beilby
and we request the hearing be set for a time after March 18,

On February 3, 1986, I received your letter dated January 30, 1986,
appealing the Planning Commission denial of a request for a variance
by Marichu Beilby. Your appeal fee was not included.
The fee for appealing a Planning Commission decision to the City
Council is $275.00, and the appeal cannot be scheduled until the
fee is received. Therefore, if the $275.00 fee is not received
in this office within ten days of the date of this letter, we will
consider your appeal withdrawn.
