A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DENYING THE MITIGATED
NEGATIVE DECLARATION ISSUED BY THE PLANNING
DIRECTOR AND DIRECTING THE PREPARATION OF AN
TENTATIVE MAP AND CONDOMINIUM PERMIT
ENVIRONMENTAL IMPACT REPORT FOR A 216 UNIT
CT 85-23/CP-320
WHEREAS, on March 18, 1986 the City Council held :
public hearing to consider a request to approve a 216 unit
tentative map and condominium permit, CT 85-23/CP-320 and 1
consider approving the mitigated negative declaration for t
project issued by the Planning Director; and
WHEREAS, at the public hearing it became apparent
there is a serious public controversy over the environmenta
effects of the project; and
WHEREAS, members of the public challenged the
conclusions of the environmental impact assessment and of t
studies and reports submitted by the project applicant
particularly with respect to the environmental impacts .that

project may have. on: (a) traffic circulation in the vicinit
whether arising directly from the project or in combination
other reasonably foreseeable projects within the immediate1
surrounding vicinity; (b) the biological habitat as a resul
the destruction of a large number of mature trees which may
constitute the habitat for a variety of bird species; (c) t
Buena Vista Lagoon as a result of siltation from the projec
slope stability within the project; (d) the social and econi
environment as it relates to the physical change occuring f
the elimination of a historic eucalyptus grove and replacini

natural recreational activities provided by the grove: and
WHEREAS. the Council finds based on the testimony
documentary evidence presented that substantial evidence hi
presented that the project may have a significant effect 01
environment, The Council further finds that because it is
clear that the significant effects have been reduced to a I
of nonsignificance by the mitigation measures proposed for
project or by the redesign of the project, that further st1
the form of an environmental review for the project is reqL

WHEREAS. preparation of the environmental review M
provide the Council with the information it needs to fully
the project and will allow the Council to consider alternat
to the project, the preparation of an environmental impact
will provide the citizens of Carlsbad with an opportunity t

NOW, THEREFORE, the City Council of the City of Cai
resolves as follows:
1. That the above recitations are true and correct
2. That the conditioned negative declaration prepz
for CT 85-23/CP-320 is hereby disapproved.
3. That an environmental impact report shall be
prepared for the project referred to as CT 85-23/CP-320.

4. That the environmental impact report shall in
consideration of project alternatives including but not li
to a no project alternative, a residential density reducti
alternative and a reduction in scale alternative.
5. That further consideration of CT 85-23/CP-320
continued until after the completion of the environmental
report.
6. That the Planning Director is instructed to p
- and process all general plan and zone code amendments nece
to implement each alternative identified in the environmen
impact reports so that the amendments may be considered at
same time as CT 85-23/CP-320 is reconsidered.

the City Council of the City of Carlsbad, California held
