ITEM EXPLANATION: At the April 22, 1986 meeting, Council continued this it two weeks to allow property owners to consider alternatives In addition, staff has taken the following actions: 1. Directed the design engineer to review the plans attempt to reduce costs where possible, espe minimizing the retaining wall. - 2. Met with the property owners to discuss alternativ costs. The property owners have stated they need more time to get from contractors and assess the City‘s revised estimate. recommends the public hearing be continued to May 20, 1986. CALIFORNIA 92076 May 1, 1986 City Council City of Carlsbad 1200 Elm Avenue Carlsbad, CA 92008 Re: Park Drive Assessment District Dear Mayor Casler and Members of the City Council: This letter is submitted on behalf of the Bristol COY Property Owners Association. As you know, the Bristol COT Property Owners Association represents the owners of tl condominium units located at the Bristol Cove Development. The Bristol Cove Development, as well as other arc residents and taxpayers, has been adversely affected by tl approximate four year delay in installing the publ: improvements originally required when the City approved t Park Drive development projects some time ago. These impac include traffic safety, drainage, erosion, and sedimentati problems, and I am sure that your Council is fully informed to the severity and extent of these concerns. I understand that the City has initiated the Park Dri Assessment District proceedings to finally take care of t problems, that detailed improvement plans have been prepar by t.he Willdan Engineering Firm and approved by Counc Reso1,ution 8463, and that 60-day Notices To Construct hE gone out to all affected property owners. I also understz that, at your hearing on April 22, 1986, the affected proper owners argued for and were granted a two week continuance z that staff will be recommending a further one we continuance. My client is very much concerned that the requix improvements be accomplished as quickly as possible eliminate the current traffic safety problem and to prevc --< .. . @ m City Council May 1, 1986 Page Two this area from contributing its share of yet another rain season's erosion and siltation of the boat channel and th lagoon. We urge the Council to go forward with the hearing approve the Assessment District, and instruct staff to procee with the utmost diligence in causing the improvements to b instructed in accordance with the Improvement Plans as ordere in your Resolution, In order to insure the completion of th improvements in a timely fashion before the upcoming rain season, we would respectfully suggest the establishment of strict. time schedule. The affected property owners have claimed hardship fo a number of years to delay the project. However, thes improvements are necessary from a public health, safety an welfare point of view, and the public and other area resident should not have to suffer any more hardships because of th property owners' refusal to proceed diligently. They wer involved in meetings with your staff prior to your last Cit Council Meeting, they have long been aware of the improvemen plans and costs, and they have had ample opportunity to see out alternatives. Further delay is unwarranted and contrar to the public interest. If any further continuances of th hearing are granted, we would respectfully urge the Council t insure that they do not in any way affect the running of tt 60-day period under the Notice to Construct or your City' commitment to proceed itself with the required improvements i the end of the 60-day period. We would also respectfully urge your Council not I permit any of the requirements of the Willdan plan to l diluted, including the retaining walls.
