Pm MASTER PLAN AND NEW DEVELOPMENT PLAN RECOMMENDED ACTION: DEPT. HD. b CITY ATT & CITY MGR- Adopt Resolution No. r3-3p , authorizing the Mayor to execute an amendment to the agreement with the consulting firm of WESTEC Services, Inc. to provide additional environmental consulting services for the Pacific Rim Country Club and Resort EIR. ITEM EXPLANATION On October 29, 1985 Council adopted Resolution No. 8247 approving an agreement with WESTEC Services to provide an amended subsequent EIR for the Pacific Rim Country Club and Resort Master Plan. A substantial amount of work was completed under that contract. Since that time, HP1 has radically revised the concept of their Master Plan. Revision is needed to the EIR to address the potential effects of the new Master Plan, including the Phase 1 Tentative Map, and Site Development Plans for Planning Areas 1, 2, 9, 10 and 11. Because of the magnitude of the project, the detailed planning now completed, and the length of time since the previous EIR, staff and HP1 have agreed that a full EIR is necessary for the project. The EIR will analyze the new plans, report, maps and technical studies prepared by the consultant team for the revised project. WESTEC has prepared all of the previous environmental studies on the project and has special expertise on the subject property and the lagoon. As a result, staff and HP1 felt that "sole source" selection was the best alternative. The estimated cost of the proposed work is $26,100. FISCAL IMPACT The developers (Hunt Properties, Inc.) are responsible for the provision of the funding for the amended supplemental EIR. FOR PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT FOR THE PACIFIC RIM COUNTRY CLUB AND RESORT NEW MASTER PLAN AND NEW DEVELOPMENT PLAN. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That certain agreement between the City of Carlsbad land WESTEC Services, Inc. for preparation of an environmental 1 impact report for the Pacific Rim Country Club and Resort, New 'Master Plan and New Development Plan, a copy of which is attached hereto, marked Exhibit "A" r and incorporated herein by reference, is hereby approved. 2. The Mayor of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. RAU erk (SEAL) EXHIBIT “A” - AGREEMENT THIS SUPPLEMENTAL AGREEMENT is made this day of April, 1986, between the CITY OF CARLSBAD, a municipal corporation of the State of California, hereinafter referred to as CITY, and WESTEC SERVICES, INC. hereinafter referred to as CONSULTANT, pursuant to Article 9, "Changes in Work", of that certain agreement between the parties dated October 22, 1985 which is on file with the City Clerk ("original agreement"). Except as set forth below, all terms and conditions of the Original Agreement shall remain in effect for the balance of the term of this Agreement. The original agreement shall be supplemented and amended as follows: (1) DUTIES OF THE CONSULTANT CONSULTANT shall prepare an Environmental Impact Report which includes an environmental analysis of the new Master Plan, the Phase One Tentative Map, and development plans for Planning Areas 1, 2, 9, 10 and 11, for the the subject project in accord with the California Environmental Quality Act as implemented by the State Guidelines and by CITY in Title 19 of the Carlsbad Municipal Code and its implementing resolutions. In carrying out this obligation the CONSULTANT'S duties shall include the following: (a) CONSULTANT shall prepare a draft report in compli- ance with the Work Program contained in Attachment "1" attached hereto and made a part hereof and -3 with applicable state law and city ordinances. The CONSULTANT shall submit to CITY fifty copies (in 3 ring binders) plus a reproducible master of the draft EIR to the CITY. (2) DUTIES OF THE CITY (a) The CITY will make payment to the CONSULTANT as pro- vided for in this agreement. (b) The CITY will promptly make available to the CONSULTANT any documents , studies, or other information in its possession related to the proposed project. (c) The CITY will review the Preliminary Report presented by the CONSULTANT within fourteen working days of their receipt and make written comments to the CONSULTANT within that time period. (d) Within five (5) days of their receipt, the CITY shall provide the CONSULTANT with copies of all written comments received on the draft Environmental Impact Report subsequent to public notice that the draft Environmental Impact Report has been filed and is available for public review. (3) PAYMENT The CONSULTANT will be paid a maximum of $86,900 for preparing an environmental analysis under the revised Scope of Work. This increases the contract value by $26,100 from $60,800 to $86,900. -2- Payment shall be made within fifteen (15) days after receipt of CONSULTANT'S invoice, in accordance with the following schedule: 50% upon submittal of revised Screencheck Draft EIR. 30% upon submittal of Draft EIR. 10% upon submission of Responses to Comments. 10% upon City certification of Final EIR*. * or 30 days after submission of printed copies of the Final EIR, if hearings are delayed through no fault of CONSULTANT. As you know, at the City’s request, WESTEC has begun additional work to address project changes. This proposal addresses the increased scope of services and costs necessary to complete the Draft and Final EIRs for the revised project. SCOPE OF WOR& WESTEC will prepare an EIR that addresses the potential effects of the new Master Plan, including the Phase 1 Tentative Map, and Site Development Plans for Planning Areas 1,2,9,10, and 11. Because of the magnitude of the project, the detailed planning now completed, and the length of time since the previous EIR, the City has decided that a Subsequent EIR would no longer be appropriate for the project. The EIR will analyze the new plans, reports, maps and technical studies prepared by the consultant team for the revised project.
