FOR DOLPHIN COURT w
By motion, adopt Resolution No. flsS3 to summarily vacate
Dolphin Court.
ITEM EXPLANATION
Due to design changes, a request was made by Rick Engineering
on behalf of Kaiser Development, to vacate Dolphin Court.
Kaiser Development owns, by fee title, the underlying
property. Therefore, Dolphin court will revert back to them.
The Engineering Department has reviewed the request and
concluded that, with a coincidental Adjustment Plat No. 316,
there is no u'seable access to adjoining properties.
Access to Parcel A and Parcel 6, per the revised Plat Map,
will be direct to Loker Avenue via a 40-foot and a 70-foot
driveway respectively.
All utility companies were notified of the vacation and they
have no objection.

None.

RESOLUTION NO. 8553
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING
AN EASEMENT OVER DOLPHIN COURT.
WHEREAS, the above street right-of-way previously dedi-
cated and shown on attached Exhibit 'A', will provide no
useable access to the adjoining properties after the Adjustment
Plat No. 315.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said street has not been used for the past five
years.
3. That, pursuant to Section 8330a of Chapter 1050 of the
California Street and Highway's Code, said easement references
above, be summarily vacated.
4. The City Clerk is instructed to record this Resolution
of Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the - 13th day of May ?
1986 by the following vote, to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
