RECOMMENDED ACTION:
By motion, approve the attached Resolution No. rA-707 approving
an $80,000 increase in the Not To Exceed fee estimate for Willdan
and Associate's design of La Costa Avenue Widening Project.
ITEM EXPLANATION:
At its January 28, 1986 meeting, the City Council approved an
agreement with Willdan for design of La Costa Avenue for an
amount not to exceed $95,000. The $95,000 amount did not include
all costs involved in the design work. The correct figure should
have been $175,000. $80,000 in design costs were inadvertently
omitted when the final design cost was calculated. Neither'the
City nor Consultant recognized the error until the design
agreement was signed. City staff and Consultant both agree that
the total design fee should be the "Not to Exceed $175,000"
figure. The revised design cost is consistent with generally
accepted cost standards for this type of design. The design
content of this project includes El Camino Real and La Costa
Avenue intersection, widening of La Costa Avenue to 1-5, and
interim intersection improvements at 1-5.
FISCAL IMPACT:
A total of $250,000 was approved by Council for design of this
project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AUTHORIZING THE EXECUTION
OF AN AMENDMENT TO THE CONSULTANT AGREEMENT FOR
THE DESIGN OF THE LA COSTA WIDENING AND THE
LA COSTA/I-5 INTERSECTION IMPROVEMENTS TO
INCREASE THE PAYMENT TO THE CONSULTANT
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. That an amendment between the City of Carlsbad and
Willdan Associates for engineering services, a copy of which is
attached as EXHIBIT "A" and incorporated herein by reference is '
hereby approved.
2. The Mayor of the City of Carlsbad is hereby authorized
and directed to execute said agreement for and on behalf of the
City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City of Carlsbad City Council held on the 20th day of
May , 1986 by the following vote, to wit:

AMENDMENT TO AGREEMENT FOR
ENGINEERING SERVICES
AMENDMENT NO. 1
This Amendment to the Agreement between the parties
dated January 30, 1986 is made and entered into as of the
day of 9 19 .
The parties agree that paragraph 4 of the Agreement is
amended to read as follows:
4. FEES TO BE PAID TO CONSULTANT
The fee payable for Part A shall not exceed $30,000.
The fee for Part B shall not exceed $175,000. Payments shall be
made incrementally at the completion of each task as shown on
Exhibit 1, attached hereto and made a part hereof. The
contingency amount of $5,200 for Part A and $23,500 for Part B
shall be used only for payment of additional services which are
required for successful completion of the project, including but
not limited to ta'sks which are necessary to comply with permit
requirements imposed by governmental agencies. Payment from the
contingency shall be made by change order if the cost of the task
is less than $5,000. Payments from the continqency for tasks
which cost more than $5,000 shall be made according to paragraph
7. Except as provided herein, no other compensation for
services shall be allowed except for items approved by
supplemental agreements executed pursuant to paragraph 7.
This amendment shall be effective on and from the day
and year first above written. -

Regarding the Willdan contract for the design of La Costa Avenue
from 1-5 to El Camino Real, I am convinced that the error on the
agneda bill was just that.
to make me believe otherwise. I have discussed this error with
Frank Mannen and we believe that safeguards can be instituted to
eliminate this type of mistake. I have thoroughly investigated this
instance and it appears to simply be a human error during preparation
of the agenda bill.
There is no reason evident at this time
