I ,‘ i, a RECOMMENDED ACTION: By motion, adopt Resolution No.$,flscbeclaring the intention to vacate a portion of Oak Avenue and setting a public hearing for 6:OO PM, Tuesday, July 15, 1986. ITEM EXPLANATION A request to vacate excess street right-of-way on a portion of Oak Avenue was made by the Southland Corp. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for the ultimate street widening. Oak Avenue is a collector street with required right- of-way width of 60 feet. The City currently has 80 feet of right-of-way on the above street. The Southland Corp. is currently processing street improvement plans adjacent to the area proposed to be vacated. The improvements proposed include curb, gutter, sidewalk, street lights and street trees. Staff recommends that this vacation be conditioned to agree to install and post the appropriate securities for these improvements prior to recording this vacation. Utility companies have been notified of the vacation. An easement for all existing utilities is exempt from this v acat ion. BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. The City Council of the City of Carlsbad hereby declares its intention to proceed, under the provisions of the Public Streets, Highways, and Service Easement Vacation Law of 1981, to vacate a portion of Oak Avenue between Carlsbad Boulevard and Lincoln Street, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit "A" , attached hereto and by this reference incorporated herein. 2. A public hearing shall be held at the City Council Chambers at 1200 Elm Avenue, Carlsbad, California, at 6:OO P.M. on July 15, 1986 for all persons ,interested in or objecting to said proposed vacation.
