ITEM EXPLANATION
As a condition of approval of the telephone service for the
Carlsbad Safety and Service Center, we are required to
dedicate five-foot easements spanning 2-1/2' on each side of
the telephone lines installed in the streets in already
provided conduit runs. The easement includes the Impala Drive
connection to existing Pacific Bell facilities.
FISCAL IMPACT
City will be reimbursed for Pacific
trenching and conduit cost $3,913.54.

3 AN EASEMENT FOR TELEPHONE SERVICE AT THE
CARLSBAD SAFETY AND SERVICE CENTER.

5 WHEREAS, the City of Carlsbad grants an easement to
6 Pacific Bell for telephone service at the Carlsbad Safety and
7 Service Center; and
8 WHEREAS, the City Manager and staff have determined that
9 the easement is in the best interest of the City; and
10 WHEREAS, funds are available for completion and recording
11 of said improvements and easements in Account No. 300-820-1810-
12 3006.
13 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
14 City of Carlsbad, California, as follows:
15 1. That the above recitations are true and correct.
16 2. That the Grant of Easement to Pacific Bell, dated the
17 24th day of June, 1986, conveying easements for telephone
18 services to the Carlsbad Safety and Service Center, which is on
19 file with the City Clerk and is incorporated herein by
20 reference, be processed forthwith.
21 3. That the Mayor is authorized to execute the easement
22 and the City Clerk is hereby authorized to cause the Grant of
23 Easement to be recorded in the Office of the County Recorder of
24 San Diego County, State of California.

The undersigned Grantor(s) hereby grant(s) to PACIFIC BELL, a California Corporation,
Grantee, its successors and assigns, an easement to construct and maintain, place,
operate, inspect, repair, replace and remove such underground communication facilities
as Grantee may from time to time require (including ingress thereto and egress there-
from) consisting of wires, cables, conduit, manholes, handholes and aboveground
markers, pedestals, terminal equipment cabinets, other associated electrical con-
ductors and necessary fixtures and appurtenances in, under and upon that certain
real property in the County of San Diego, State of California, described as:
That portion of Lot B of Rancho Agua Hedionda subdivision as said lot is shown on
map of said subdivision filed for record as Map No. 823 on the 16 day of November,
1896, described in Parcel No. 82-0001-A of deed filed for record at File/Page
No. 82-201566 on the 30 day of June, 1982, all in the Office of the County Recorder
of San Diego County.
The above described easement shall be located on strips of land five (5.00) feet in
width in said property, lying 2.50 feet on each side of the alignment of the facilities
installed hereunder EXCEPTING THEREFROM those portions of said property occupied by
buildings.
Grantee shall be responsible for damage caused intentionally or by any negligent act
or omission of Grantee, its agents or employees while exercising the rights granted
herein.
