ITEM EXPLANATION: The City of Santee has asked the City Council to adopt the attached Resolution that urges City Council approval of jail sites within a City. The County of San Diego is proposing to locate a jail facility in Santee in a locatfon which the City deems unappropriate. FISCAL IMPACT: No direct impact. EXHIBITS: 1. Resolution No. 2. Currently before the State Legislature is SB 2543 {Presley) which allo- cates the Proposition 52 state bond funding for jail construction. This bill was recently amended with special legislation for San Diego and Los Angeles Counties to require city council approval for all new county jail projects within their jurisdictions. At the core of these amendments is the issue of local control and whether a county should have totally unrestricted powers in siting jail facilities within incorporated cities, despite strong opposition from those jurisdic-tions. The City of Santee is currently facing a county jail facility proposal for the Santee Town Center, the City's major redevelopment area project. The type of facility being proposed would resemble a concentration camp in designw-with 19 prefabricated meta1 barracks, guard towers, and barren unlandscaped grounds encircled by 12-foot chain-link fences topped with sp"iraling strands of barbed wire. This jail proposal is also located within one-third mile of an elementary school and within one mile of five other schools. Just last fall, the City of Santee issued a $6.4 million bond on this redevelopment project. Now, because of the location of this proposed county jail facility, the very economic future of the City is at risk. The purpose of these amendments would be to protect municipalities from the serious socio-economic impacts of county jail facilities inappropri- ately sited within their jurisdictions, without regard to city efforts to revitalize their communities. 10765 Woodside Avenue• Santee, f.alifornia 92071-3198 • (619) 562-6153 June 9, 1986 Page 2 -· As Santee 1 s appointed 11 anti-jail 11 task force members, we strongly urge you to contact your legislators in support of the recent amendments to SB 2543 to provide local veto power over inappropriately placed county jail projeccs. Substantial support will be required to pass these vital amendments through the State Legislature and the Governor's office. Sincerely, ~Lfr Mayor fl;~ELL Council Member Attachment cc: City Manager 1 2 3 4 --,- RESOLUTION NO. 8637 ------- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, IN SUPPORT OF LOCAL APPROVAL FOR COUNTY DETENTION FACILITIES WHEREAS, existing law provides that counties have the 5 authority to site detention facilities within city boundaries 6 despite formal opposition from the affected city government; and 7 WHEREAS, the inappropriate siting of county detention 8 facilities could have serious social 3nd fiscal impacts u~on the 9 public welfare, safety and economic viability cf these communities; 10 .and 11 WHEREAS, some county detention facilities are proposed 12 for city redevelopment project areas financed through tax increment 13 funds, and the resulting property devaluation may affect the City's u I 14;' ability to finance necessary public improvements and revitalization 15 efforts; and 16 WHEREAS, SB 2543 (Presley) would provide the state bond 17 funding for the construction of new county jail facilities; and 18 WHEREAS, Assemblyman Larry Stirling has sponsored 19 amendments to SB 2543 to require City Council approval in the 20 Counties of San Diego and Los Angeles for all county jail facilitie 21 fvnded through the state-wide jail construction bonds; and 22 23 24 25 26 27 28 local WHEREAS, these amendments address the critical issue of over vital matters affecting the social and economic control well-being of a community, such as the siting of a county detention facility; II ---,- l b.i.T, THEREFORE, BE IT RESOLVED that the City Council of 2 tl\e City of Carlsbad, California, does hereby support the proposed 3 amendments to AB 2j43 to provide for local control over the siting 4 of county detention facilities, and we do hereby urge the State 5 Legislature to approve these amendments. 6 PASSED, APPROVED AND ADOPTED at a regular meeting of 7 the Carlsbad City Council held on the 8 1986 by the following vote, to wit: day of July -----1st 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine r.•mss: None ABSENT: None MARYH.ASLER, Mayor ATTEST: lerk (SEAL)
