RECOMMENDED ACTION:
Adopt Resolution No. ,P6.3 V establishing a fee for reappor-
tioning Games Drive Assessment District No. 83-2.
ITEM EXPLANATION
Several property owners in the James Drive Assessment District
have applied for divisions of their land. In order to split
or reapportion the existing Assessment District Bonds on the
divided lots, additional work by City staff and City consul-
tants is required. The State "Improvement Act of 1911" allows
the City to set fees in order to be reimbursed for costs
involved in the reapportionment. This resolution accomplishes
that.

All associated costs will be covered by fees paid by the land
owners. Those costs are as follows:

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ESTABLISHING A FEE
3 FOR PROCESSING LAND AND ASSESSMENT DIVISIONS
PURSUANT TO THE PROVISIONS OF THE "IMPROVEMENT
4 ACT OF 1911."

6 WHEREAS, the City has completed special assessment
7 district proceedings for the construction of certain public
8 improvements pursuant to the provisions of the "Municipal
9 Improvement Act of 1913," being Division 12 of the Streets and
10 Highways Code of the State of California, with bonds to issue
11 under the terms and provisions of the "Improvement Act of
12 1911," being Division 7 of said Code, said special assessment
13 district known and designated as Assessment District No. 83-2,
14 James Drive (hereinafter referred to as the "Assessment
15 District"); and
16 WHEREAS, assessments have been levied and bonds issued on
17 certain parcels of property whereby it is determined that a
18 substantial number of parcels will be divided, and requests and
19 applications will be made for the division of assessments on
20 the divided lots or parcels, all as so provided in said
21 "Improvement Act of 1911;" and
22 WHEREAS, the Council is desirous of establishing a
23 reasonable fee for processing applications for division of land
24 and assessment in order to reimburse the City for the necessary
25 costs so incurred in accomplishing the divisions as necessary.
26 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
27 City of Carlsbad, California, as follows:
28 I 1. That the above recitations are true and correct.

2. That the following fee schedule is hereby determined
to be reasonable and is an amount that will reimburse the City
for the necessary costs in processing applications for division
of land and bond pursuant to the "Improvement Act of 1911,"
being Division 7 of the Streets and Highways Code of the State
of California:
All applications for land and assessment shall be
accompanied by a fee of $450.00 for each application
plus $50.00 for each newly created parcel.
Said fee shall be due and payable upon filing the
application or not later than fifteen (15) days after
notification by the Superintendent of Streets.
3. That all fees so collected, either by application or
as an installment on the assessment, are to be deposited into
the General Fund of the City of Carlsbad.
4. This Resolution is adopted pursuant to the authority
of Section 6481 of the Streets and Highways Code of the State
of California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the lst day of July ,
1986 by the following vote, to wit:
