ITEM EXPLANATION The City Council at their meeting of June 24, 1986 directed Attorney to prepare documents approving CT 85-10. The resol> attached carries forward the conditions of approval as recomi the Planning Commission in Resolution No. 2551 and as discus the memorandum from the Planning Director dated May 7, 1986 reflect a recently adopted Council ordinance regarding the L traffic fee and the increased public facilities fee. Condition number 33 has been deleted. The following conditi been added: - "NO final map shall be approved for this subdivision at the time of the final map approval the subdivider complied with the provisions of City Council Ordinan 9791 or any subsequent ordinance adopted by the City to implement a growth or development management syst or development management system or regulation which adopted by popular vote of the citizens of Carlsbad. Additional conditions may be applied to this tentati as the City Council determines necessary to implernen plan, system, and regulation." The following sentence has been added to 49(e): public facilities phasing plan for the City or of an - "The City Engineer will do a traffic review of the intersection. If he determines it is required, the shall install the signal subject to a reimbursement for the other half of the signal." APPLICANT: RICE PROPERTY CASE NO: CT 85-10/PUD-81. WHEREAS, on April 23, 1986 the Carlsbad Planning Commission adopted Resolution No. 2551 recommending to th Council that Tentative Tract Map (CT 85-10) and Planned U Development (PUD-81) be approved; and WHEREAS, the City Council of the City of Carlsba June 24, 1986 held a public hearing to consider the recom tions and heard all persons interested in or opposed to T Tract Map (CT 85-10) and Planned Unit Development (PUD-81 WHEREAS, the environmental review for said tenta was completed in conjunction with a previous project, a N of Prior Compliance was filed by the Planning Director or 14, 1985 in compliance with the requirements of the City Carlsbad Environmental Protection Ordinance of 1980 and t California Environmental Quality Act: I B. Subparagraph (3) (g) has been added to read a follows: "(3)(g) The applicant has complied with or is L as a condition of this approval to comply with all provis City Council Ordinance No. 9791 and with any development management system or public facilities phasing plans whic subsequently be adopted by the City Council." C. That said Tentative Tract Map, together with provisions for its design and improvement and subject to conditions of this resolution, is consistent with all apr general and specific plans of the City of Carlsbad. D. That Tentative Tract Map CT 85-10 and Planne Development PUD-81 are hereby approved subject to all apF requirements of the Carlsbad Municipal Code and to the satisfaction of the conditions contained in Planning Comn Resolution No. 2551 dated April 23, 1986 marked Exhibit 1 attached hereto and made a part hereof, with the exceptic ! following: 1. Condition No. 4 is amended to read as follo~ "4. This project is approved under the express condition that the applicant pay the public facilities fe adopted by the City Council on April 22, 1986 and any det fees established by the City Council pursuant to Ordinanc 9791 or subsequent ordinance adopted to implement a growt development management system or public facilities phasir and to fulfill the subdivider's agreem-ent to pay the pub1 facilities fee dated February 15, 1985 a copy of which is with the City Clerk and is incorporated by this referencc the fees are not paid this application will not be consi: with the General Plan and approval for this project shall void. Condition No. 4A is added to read as follows "4A. No final map shall be approved for this subdivision unless at the time of the final map approval subdivider has complied with the provisions of City Counc Ordinance No. 9791 or any subsequent ordinance adopted by City Council to implement a growth or development managem system or public facilities phasing plan for the City or growth or development management system or regulation whi be adopted by popular vote of the citizens of Carlsbad.
