ITEM EXPLANATION In preparation for the General Municipal Election, it is necessary for Council to take certain actions. This agenda bill presents the first three actions required. 1. The attached Resolution No. J^^O , calls and gives notice of the General Municipal Election to be held in the City on November 4-, 1986. A. Resolution No. (f>(o'7o only addresses the elected offices. If propositions are to be placed on the ballot, subsequent resolutions will be prepared to amend this resolution. 2. The attached Resolution No. P& "71 > requests the Board of Supervisors to consolidate our General Municipal election with the statewide election being held the same day. A. Placement of propositions on the ballot will also require that this resolution be amended. 3. The attached Resolution No. f% *7j? , adopts regulations for candidates for elective office at the General Municipal Election. A. This resolution has been prepared consistent with the regulations adopted for previous elections. These regulations establish: 1. A 200 word limit on candidate's statements; 2. City payment for translation of candidate's statements into Spanish. 3. Candidates payment of their pro-rata share of printing costs after actual costs are known; and 4. A $25 filing fee. FISCAL IMPACT It is impossible, at this time, to estimate the cost of the election. The cost will be impacted by the number of candidates, number of propositions, number of arguments, and the amount of other information that will be submitted to the voters in the sample ballots. The only known is a $75 per candidate fee for translating candidate's statements into Spanish. PAGE 2 OF AB f EXHIBITS 1. Ouly 8, 1986 TO: MAYOR CASLER AND MEMBERS OF THE CITY COUNCIL FROM: Lee Rautenkranz, City Clerk INFORMATION RE NOVEMBER ELECTION There is a great deal of discussion and questions pertaining to the upcoming election. Therefore, this memo addresses several areas which may be of interest. CALENDAR OF EVENTS In order to take some of the confusion out of the election process, I have prepared a calendar of events for Council. This does not identify every deadline associated with the election, but should serve as a general guideline. That calendar is attached to this memorandum labeled Exhibit "A". CERTIFICATION OF RESULTS AND SEATING OF NEWLY ELECTED OFFICIALS Council should be aware of a change in the timing for the final certification process. It will be different for this election than it has been for past elections. For statewide elections, the County has historically been allowed (by Elections Code) 28 days in which to canvass ballots and certify results. Cities, in contrast, have historically been required by Elections Code to canvass ballots, and certify results (and swear in those elected) by the first Tuesday after the election. That meant City Clerks had one week to canvass the ballots, certify results to Council, and swear in the newly elected officials. When the new provisions were adopted which allowed cities to change the date of municipal elections for consolidation with statewide election dates, cities and counties were caught in a small dilemma. The laws pertaining to times for canvassing ballots were not changed. Therefore, the County had 28 days to canvass and certify results, but cities still were required to complete the process in one week. Therefore, to resolve the problem, the County was providing cities with a semi-official certification so cities could comply with their requirements as stated in the Elections Code. The original oversight has been corrected. They have now amended the Elections Code to provide consistency in canvassing ballots for consolidated elections. That time is consistent with previous County requirements for certification in 28 days. The result is that cities no longer have the one week requirement for certification of results; therefore, the County will no longer provide cities with an early certification. This means newly elected officials may not take office until the Council meeting of December 2, 1986 or December 9, 1986. INFORMATION RE PROPOSITIONS Information relative to propositions will be presented to Council at the time the documents concerning specific propositions/initiatives are presented to Council for action. That information will address such items as the filing of arguments and preparation of impartial analyses by the City Attorney. RESOLUTION NO. 8670 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 2 CARLSBAD, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON 5 TUESDAY NOVEMBER 4, 1986 FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO-GENERAL LAW CITIES. 5 WHEREAS, under the provisions of the laws relating to 7 ' General Law Cities in the State of California, a General o Municipal Election shall be held on November 4-, 1986, for the g election of Municipal Officers; 10 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, 11 CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS 12 FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, 15 there is called and ordered to be held in the City of Carlsbad, 16 California, on Tuesday, November 4-, 1986, a General Municipal 17 Election for the purpose of electing a Mayor for the full term of 18 four years; two Members of the City Council for the full term of 19 four years; a City Clerk for the full term of four years; and a 20 City Treasurer for the full term of four years. 21 SECTION 2. WHEREAS, the City Council of the City of Carlsbad called a General Municipal Election to be held on November 4, 1986; WHEREAS, Section 439.1 of the Administrative Code of the County of San Diego authorizes the Registrar of Voters of the County of San Diego to render specified services relating to the conduct of an election to any City which has by resolution requested the Board of Supervisors to permit the Registrar to render the services, subject to requirements set forth in that section; and WHEREAS, the City of Carlsbad called an election to be held on the same day in the same territory or in territory that is in part the same; WHEREAS, pursuant to Part 2.5 (commencing with § 23300), Division 14 of the Elections Code, the Board of Supervisors has authority to consolidate public district, city, county, or other political subdivision elections with each other and with a statewide election to be held on the same day; NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above-cited provisions, the Board of Supervisors of the County of San Diego is hereby requested to permit the Registrar of Voters to perform and render all services and proceedings incidental to, and connected with, the conduct of the subject election of the 1 City of Carlsbad, with the cooperation and assistance of the 2 City Clerk of the City of Carlsbad, such services to include, but 3 not to be limited to the following activities as are appropriate 4 to the subject election: 5 1. Furnish a tabulation of the number of registered 6 voters in each precinct. 7 2. Examine the signatures on nomination papers or 8 petitions of candidates for public office. 3. Establish voting precincts, secure locations for 10 polling places, secure the services of election officers for each 11 precinct as required by law, and furnish a list of precincts, polling places, and election officers for filing in the office of 13 the City Clerk of the City of Carlsbad. 4-. Prepare and furnish to the election officers necessary election supplies for the conduct of the election. 5. Cause to be translated, as appropriate, and printed the requisite number of sample ballots, official ballots, polling place slips, rosters, tally sheets, and other necessary forms. 6. Furnish and address the envelopes necessary to mail 20 sample ballots to the registered voters of the City of Carlsbad. 7. Insert the sample ballots and other printed matter into envelopes for mailing, and cause the same to be mailed, as 23 required by law. 24 8. Assemble the election material and supplies into ballot bags and make necessary arrangements for their delivery to 26 the various precincts. /// 28 /// 1 9. Distribute absent voter ballots as required by 2 law. 3 10. Receive the returns of the elections and supplies. 4 11. Sort and assemble the election material and 5 supplies in preparation for the canvassing of the returns of the 6 election. 7 12. Canvass the returns of the election, including the 8 absent voters ballots. 9 13. Furnish a tabulation of the number of votes given in 10 each precinct. 11 14. Make all arrangements and take the necessary steps 12 to pay the members of the precinct boards, the polling place 13 rentals, the persons returning the ballot bags, and to pay all 14 other costs of the election incurred as the result of services 15 performed for the City of Carlsbad and pay for the election 16 officials the amounts prescribed by the Board of .Supervisors of 17 the County of San Diego. 18 BE IT FURTHER RESOLVED that pursuant to the requirements 19 of the laws of the State of California relating to General Law 20 Cities within said State, the election of the qualified electors 21 of the City of Carlsbad was called for the purpose of electing a 22 Mayor, two members of the City Council, a City Clerk, and a City 23 Treasurer of said City. 24 BE IT FURTHER RESOLVED that the Board of Supervisors of 25 the County of San Diego is hereby requested to consolidate this 26 election with the other elections to be held on the same day, in 27 the same territory, or in territory that is in part the same. 28 /// BE IT FURTHER RESOLVED that if this consolidation is ordered, then pursuant to Section 23306 of the Elections Code, (a) the election shall be held in all respects as if there were only one election; (b) only one form of ballot shall be used; and (c) the Registrar of Voters of the County of San Diego shall canvass the returns of the subject election as part of the canvass of the returns of the election or elections consolidated 8 hereby. RAUTENKRANZ, City Cl^rk" 12 (SEAL) 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 RESOLUTION NO. 8672 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS FOR 3 CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE 4 HELD ON TUESDAY NOVEMBER 4-, 1986. 5 Q WHEREAS, Section 10012 of the Elections Code of the 7 State of California provides that the governing body of any local 8 agency adopt regulations pertaining to materials prepared by any 9 candidate for a municipal election, including costs of the 10 candidates statements; 11 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF 12 CARLSBAD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND 13 ORDER AS FOLLOWS: 14 SECTION 1. GENERAL PROVISIONS. That pursuant to 15 Section 10012 of the Elections Code of the State of California, 16 each candidate for elective office to be voted for at an election 17 to be held in the City of Carlsbad may prepare a candidate's 18 statement on an appropriate form provided by the City Clerk. The 19 statement may include the name, age and occupation of the 20 candidate and a brief description of no more than two hundred 21 (200) words of the candidate's education and qualifications 22 expressed by the candidate. The statement shall not include 23 party affiliation of the candidate, nor membership or activity in 24 partisan political organizations. The statement shall be filed 25 in the office of the City Clerk at the time the candidate's 26 nomination papers are filed. The statement may be withdrawn, 27 but not changed, during the period for filing nomination papers 28 and until 5:00 P.M. of the next working day after the close of the nomination period. X,.,.*' SECTION 2. SPANISH LANGUAGE. The City clerk shall have all candidates statements translated and available upon , request in the City Clerk's Office,o 4 SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot - package. 7 SECTION fr. PAYMENT.
