RECOMMENDED ACTION:
City Council adopt Resolution No. approving the agree-
ment between the City and the Carls5ad Boys and Girls Club to re-
move litter.
ITEM EXPLANATION:
The City of Carlsbad has contracted with the Carlsbad Boys and
Girls Club for several years to provide litter removal services
from selected rights-of-way, including (but not limited to) Carlsbad
Boulevard, El Camino Real, Cannon Road, Chestnut Street, Poinsettia
Lane and Alga Road.
The yearly contract for 85-86 expired June 30, 1986, and the need
exists to extend the agreement and provide for funding through
June 30, 1987.
Boys and girls from the Village Branch of Boys and Girls Club, ages
12-16 years old, work one Saturday each month performing this
service to the community; each youngster earns $25 for five hours
of work.
The City provides the truck and trash bags and disposes of 35 to
50 bags of trash each month; the City's Maintenance Worker determines
which areas will be cleaned. The Boys and Girls Club leader pro- vides supervision and transportation for the "work crew".
Staff recommends Council approve the agreement to continue the Litter Removal Program. It benefits the youngsters as well as our community.
FISCAL IMPACT:
The Litter Removal Program cost is $400 each month with the maximum
payment to the Club of $4,800 during fiscal year 86-87. If the Club is unable to recruit seven workers, the service is cancelled for the month and the funds remain unexpended. Funds are budgeted in the Building Maintenance Miscellaneous Outside Services Account
001-820-5320-2490.

The cost to provide the services of a maintenance worker is
approximately $860 per year. Funds are available in Building
Maintenance Overtime Salaries Account 001-820-5320-1200.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CAFULSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD
BOYS AND GIRLS CLUB TO PROVIDE LITTER REMOVAL
SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE
SAID AGREEMENT
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. That certain agreement between the City of Carlsbad
and the Carlsbad Boys and Girls Club to provide litter removal
services, a copy of which is attached hereto marked Exhibit "A"
and is on file in the City Clerk's office, is hereby approved.
2. That the Mayor of the City of Carlsbad is hereby
authorized and directed to execute said extension for and on
behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
15th day of July , 1986, by the following vote, to wit:

AGREEMENT FOR PROVIDING
LITTER REMQVAL SERVICES
THIS AGREEMENT entered into this 6" day of , 1986,
by and between the City of Carlsbad, a municipal corporation of the State of
California, hereinafter referred to as "Carlsbad", and the Carlsbad Boys and
Girls Club, hereinafter ref erred to as "Club".
WITNESSETH:
WHEREAS, Carlsbad is engaged in various street maintenance programs
including street sweeping to pranote the safety, health and general welfare of
its citizens; and
WHEREAS, it is deemed appropriate to accanplish litter removal fran the r
City rights-of-way by agreement with the Club; and
WHEREAS, the Club can provide litter removal service for just compensation
and in the public interest;
NOW, THEREFORE, IT IS AGREED as follows:
(1) DUTIES OF CARLSBAD
A. Provide appropriate warning signing, equipment and disposal of
collected litter.
8. Provide appropriate inspection of the cleared areas,
C. Reimburse the Club on a monthly basis in the amount of $400.00 on the
condition of faithful performance of litter removal.
(2) DUTIES OF THE CLUB
A. Provide a minimum of seven (7) and maximum of ten (10) youth members to
work, ages 12 to 16 years.
Provide adult supervision on the basis of one (1) adult per ten (10) B.
youth members.
C. Prwide vehicle and transport youth members and supervisor to/fran work
sites .
D. Conduct litter removal during the period 7:30 a.m. to 1:30 p.m. on
Saturday. Specific Saturday to be scheduled to the mutual satisfaction
of the Club and City. (See Attachment "Att, 1985-86 Schedule.)
E. Take all necessary measures to ensure the safety of personnel involved
in the litter renoval efforts.
F. Prwide litter renoval fran the rights-of-way on the followirq
locations and others, as determined by the City:
1. Palmar Airport Road - fran El Canino Real east to the City limits
(Linda Vista Lane).
Alga Road - Alicante to El Fuerte, including the median. 2.
3. Coast Highway (Carlsbad Boulevard) from Palmar Airport Road to the
Batiqdtos Bridge, including the median.
4. El Camino Real - Kelly Drive to Marron Road, including the median
fran Chestnut to Marron.
5. El Canino Real - south fran Beckman entrance to erd of industrial
area.
6. Cannon Road - Carlsbad Boulevard to east end.
7. Marron Road - El Canino Real to Avenida de Anita.
8. Chestnut - Monroe to El Canino Real.
9. Poinsettia Lane - Avenida Encinas to Batiqdtos Lane.
(3) PAYMENT
Payment to the Club on the basis of one canplete litter clean-up per month
in the amount of $400.00 per month during the period of this agreement.

(4) TERM -
This Agreement will be effective upon date of execution of this agreement
by the Mayor of Carlsbad. It shall teninate on 3une 30, 1987. During said
tern, this agreement may be terminated at any the upon thirty (30) days written
not ice.
(5) INSURANCE
The Club shall prwide City a certificate of insurance naniq the City as
additionally insured on their noma1 liability policy.
(6) HOLD HARMLESS AGREEMENT
Carlsbad, its officers and employees shall not be liable for any claims,
liabilities, penalties or fines or any damage to goods, properties, or effects
of any person Hhatever, or personal idfuries to or death of them caused by, or -
resulting fran, or claimed to have been caused by, or resulting fran, any act or

omission of Carlsbad, its officers or employees. The Club further agrees to
indemnify and save free and harmless Carlsbad ard its authorized officers and
employees, against any of the foregoing liabilities and claims thereof, and any
cost and expense that is incurred by the City on account of any claim thereof.
(7) NOTICES
All notices required herein shall be in writing and delivered in person or
sent by mail. Notice to Carlsbad shall be addressed: City Manager, 1200 Elm
Avenue, Carlsbad, California, 92008.
Notices to the Club shall be addressed: Executive Director, P.O. Box 913,
Carlsbad, California, 92008.
