Adopt Resolution No. to summarily vacate a portion of
Harwich Drive.

PORTION OF HARWICH DRIVE CITY MGR.-
ITEM EXPLANATION
Due to design changes and realignment of Harwich Drive, a request
has been made by Rick Engineering on behalf of Treetops Unlimited
to vacate the original right-of-way for Harwich Drive.
Staff has reviewed the request and has concluded that this
original right-of-way is not needed. Grant Deeds dedicating the
realignment right-of-way will be processed concurrently with this
street vacation request.
Utility companies have been notified. The public utilities were
never constructed within the area proposed to be vacated.
FISCAL IMPACT
Approval of this vacation will result in approximately 175,309
square feet of land to be returned to the tax rolls.

WHEREAS, the above street right-of-way previously dedi-
cated and shown on attached Exhibits "A" and "B", will provide
no useable access to the adjoining properties after the
realignment of Harwich Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows: I
1. That the above recitations are true and correct.
2. That said portion of the street has not been used- for
the past five years.
3. That, pursuant to Section 8330a of Chapter 1050 of the
California Street and Highway's Code, said easement references
above, be summarily vacated.
4. The City Clerk is instructed to record this Resolution
of Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 15th day of July 9
1986 by the following vote, to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
NOES: None

lengthened or shortened at the TRUE POINT OF BEGINNING to meet a line. bearing North 68O55'00" East passing through said TRUE POINT
OF BEGINNING, and at the Point of Terminus to meet the Westerly sideline of said existing 60 foot easement for street purposes per Document No. 85-251154, Recorded 7-15-85, Official Records.
