VACATION OF A PORTION
OF OAK AVENUE
RECOMMENDED ACTION:
Adopt Resolution No. f70Q to summarily vacate a portion of Oak Avenue.
ITEM EXPLANATION
A request to vacate excess street right-of-way on the southerly side of Oak
Avenue was made by Bob Coles. The Engineering Department has reviewed the
request concluded that this 5-fOOt strip of right-of-way is not needed for the future widening of Oak Avenue.
and
Utility companies have been notified and have no objection to the street
vacation.
FISCAL IMPACT
Approval of this vacation will result in approximately 700 square feet of
land to be returned to the tax rolls.

RESOLUTION NO. 8709
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUMMARILY VACATING AN
92,o 0 EASEMENT OVER A PORTION OF OAK AVENUE.
WHEREAS, that easement previously dedicated contains excess right-of-way
not required for street purposes and provides no useable access to the
adjoining property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That, pursuant to Section 8330a of Chapter 1050 of the California
Street and Highway's Code, the easement described on Exhibit "A", attached
hereto and made a part hereof, be summarily vacated. All as shown for
convenience sake on Exhibit ItBIr attached hereto and made a part hereof.
3. That the City Clerk is instructed to record this Resolution of
Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 22d day of .T,,I? , 1986 by the following vote, to
wit:
AYES: Council Members Casler, Lewis, Kulchin and Pettine

That portion of Oak Avenue adjacent to Lot 17 in Block 47 of the
Town of Carlsbad, in the City of Carlsbad, County of San Diego,
State of California, according to the Map thereof No. 775, filed
in the Office of the County Recorder of San Diego County,
February 15, 1894, more particularly described as follows:
Beginning at the Northeast corner of said Lot 17 thence North
34°33'00" West 5.00 feet; thence South 55°27'00" West 140.00 feet; thence South 34°33'00" East 5.00 feet to the Northwest
corner of said Lot 17; thence along the Northerly line of said
Lot 17 North 55°27'00" East 140.00 feet to the TRUE POINT OF
BEGINNING.
