ITEM EXPLANATION A request to vacate excess street right-of-way on the southerly side of Oak Avenue was made by Bob Coles. The Engineering Department has reviewed the request concluded that this 5-fOOt strip of right-of-way is not needed for the future widening of Oak Avenue. and Utility companies have been notified and have no objection to the street vacation. FISCAL IMPACT Approval of this vacation will result in approximately 700 square feet of land to be returned to the tax rolls. WHEREAS, that easement previously dedicated contains excess right-of-way not required for street purposes and provides no useable access to the adjoining property; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That, pursuant to Section 8330a of Chapter 1050 of the California Street and Highway's Code, the easement described on Exhibit "A", attached hereto and made a part hereof, be summarily vacated. All as shown for convenience sake on Exhibit ItBIr attached hereto and made a part hereof. 3. That the City Clerk is instructed to record this Resolution of Vacation.
