ITEM EXPLANATION On June 26, 1986, the Assistant City Engineer approved with conditions a tentative parcel map for Planned Unit Development 255/Miner Subdivision 730. On July 7, 1986, an appeal of this decision was filed by Mr. Robert Johnson with the City Clerk. The reasons for appeal were: lot sizes did not conform to existing R-l-l 5000 zoning and building heights were not in conformance with the Agua Hedionda Land Use Plan. On May 29, 1986, the City Planning Director issued an interdepartmental memorandum indicating that, under the City’s Planned Development Regulations, the proposed lots conform to existing zoning and the project also conforms to the Agua Hedionda Land Use Plan in regards to building height and scenic corridors. Although the lots do not each contain 15,000 sq. ft., the Planned Development Ordinance allows smaller lots as long as the project complies with the General Plan. The General Plan Land Use Designation for this property is RLM-O-4 dwelling units per acre. With the three lots as proposed, the density of the project is 2.9 dwelling units per acre. It should be pointed out that the applicant used the Planned Development Ordinance because his property was 570 sq. ft. short of being able to develop three lots using the standard single family subdivision process. The applicant’s property contains 44,430 sq. ft. and 45,000 sq. ft. would be needed to have three standard single family lots. On July 9, 1986, the City received a copy of a letter from the California Coast al Commission affirming the City Planning Director’s finding in relation to building height and scenic corridors. FISCAL IMPACT The Appellant has paid the required $275.00 appeal fee. The fee covers the expenses for required staff time to prepare an answer to the appeal. EXHIBITS 1. All required fire hydrants, .water mains, and appurtenances shall be operational prior to combustible building materials being located, on the project site. (See attached list.) The tentative parcel map approval shall expire two (2) years from the date of the letter containing the final decision for tentative map approval. If said fee is not paid as promised, this application will not be consistent with the General Plan and the project cannot proceed and this approval shall be void. 7. The Applicant may request a review of the conditions in writing within ten (10) days of the date of this approval. 8. The applicant shall pay park-in-lieu fees to the City, prior to the approval of the final map as required by Chapter 20.44 of the Carlabad Municipal Code. 9. Plans, specifications, and supporting documents for all improvements shall be prepared to the satisfaction of the City Engineer. Prior to approval of the parcel map, the Subdivider shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the tentative map and the following improvements to City Standards to the satisfaction of the City Engineer: a. Half street improvements of Adams Street to collector standards including 20’ offaite A.C. berm and transit ion pavement; the” half street improvements shall extend to the full frontage on Adams Street; b. Half street plus 10’ of Hoover Street to cul-de-sac standards; and c. Storm drain crossing Adams Street to the City Engineer’s satisfaction. 10. Improvements listed above shall be constructed within 12 months of approval of the secured improvement agreement. 11. Hoover Street shall be dedicated by the developer along the subdivision frontage based on a centerline to right-of-way width of 28 feet and in conformance with City of Carlsbad Standards prior to occupancy of any buildings. The offer shall be made by a Certificate on the Parcel Map. All land so offered shall be granted to the City free and clear of all 1 iens and encumbrances and without cost to the City. Adams Street shall be dedicated by the developer along the subdivision frontage based on a centerline to right-of-way width of 30 feet and in conformance with City of Carlsbad Standards prior to occupancy of any buildings. The offer shall be made by a Certificate on the Parcel Map. All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. Streets that are already public are not required to be rededicated. 13. The developer shall dedicate a sight distance easement at the southwest corner of Adams and Hoover to the satisfaction of the City Engineer. 14. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer capacity is available at the time of application for such permits and will continue to be available until time of occupancy. This note shall be placed on the final map. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 17. 18. 19. The grading for this project is defined as “controlled grad- ing I’ by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall. be to coordinate site inspection and testing to insure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad-Municipal Code. No grading shall occur outside the limits of the subdivision/project unless a letter of permission is . obtained from the owners of the affected properties. Page: 4 All slopes within this project shall be no steeper than 2:l. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route; The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. Addit ional drainage easements and drainage structures shall be provided or installed as may be required. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent property prior to approval of the final map/ariy grading or building permit for this project. The developer shall construct private street accesses to public streets in such a way as to clearly designate that the private streets are not a portion of the public street system. The developer shall place a plaque-type sign with the legend, *‘PRIVATE STREET BEYOND THIS POINT”, at the access point to private streets from public streets. The script on the sign shown above shall be capital letters of a size and contrast such as to be readable for a normally sighted person at a distance of 20 feet. The provisions of this condition shall be met to the satisfaction of the City Engineer prior to issuance of a Certificate of Occupancy for any portion of this project. The developer shall install street lights along all public frontages in conformance with City of Carlsbad Standards. The developer shall install a wheelchair ramp et the public- street corner abutting the subdivision in conformance with City of Carlsbad Standards prior to occupancy of any build- ings. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The design of all private streets and drainage systems shall be approved by the City Engineer prior to approval of the final map/issuance of any grading or building permit for this project. The structural section of all private streets shall conform to City of Carlsbad Standards based on R-value tests. All private streets and drainage systems shall be inspected by the city, and the standard improvement plan check and inspection fees shall be paid prior to approval of the final map/issuance of any building or grading permit for this project. 29. All plans, specifications, and supporting documents, for the improvements of this project shall be signed and sealed by the Engineer in responsible charge of the work. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. Page: 6 Prior to recordation of any final map for this development/approval of any grading or building permits for this project, the owner shall give written consent to the annexat ion of the area shown within the boundaries of the Tentative Map/site plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1. It is the Planning Director's determination tnat based on tne attached conditions, the project is consistent With the City's Planned Development regulations (Chapter 21.45) and with all other applicable City ordinances and policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15305.070(11)(4~) of tne California Environmental Quality Act and a Notice of Exemption was filed on May 29, 1986. Governor CALIFORNIA COASTAL COMMISSION SAN DIEGO COAST DISTRICT 1333 CAMINO DE1 RIO SOUTH, SUITE 125 SAN DIEGO, CA 92108-3520 (619) 297.9740 July 9, 1986 Brook Olsen 3610 Sierra Morena Caclsbad, Ca. 92008 Re: Proposed Subdivision for the Agua Hedionda Lagoon Area Dear Mr. Olsen, In regard to your inquiry of July 2, 1986, I would offer the following comments regarding the Coastal Commission’s staff review of a proposed subdivision of property located to the north and east of Agua Hedionda Lagoon in Carlsbad. The property is located within the plan area of the Agua Hedionda Land Use Plan which was certified by the Coastal Commission in 1982. In addition to the Coastal Act itself, the Agua Hedionda Land Use Plan would be the document used by the Commission’s staff in it’s review of a development proposal for the site. As we discussed, the Agua Hedionda Land Use Plan (LUP) contains a number of policies, the intent of which are, to protect the scenic resources of the lagoon and it’s watershed. In regard to the site in question, Policy # 8.3 of the LUP contains provisions for protection of views from designated scenic corridors such as Adams Street. The policy-calls for new development to preserve existing views of the lagoon from these corridors. The preferred method for preserving such views lies in the siting of all (portions of) structures on a site at an elevation which is below that of the elevation of the adjacent scenic roadway. This would allow passers-by to see over the structure to the lagoon and surrounding areas. In the drafting and review of the Land Use Plan, the City and Commission staff were aware that in some circumstances, the grade elevations of a site would not allow for construction of all portions of a residence (including peaked roofs and decks etc.) at a level lower than that of the adjacent roadway. In such cases, the Land Use Plan allows for an alternative method of view preservation. Under this method, a “view corridor14 is provided through the developed(ing) lot. In such situations, the LUP calls for one third of the width of the lot to be retained as the open space view corridor. The retention of the Brook Olsen July 9, 1986 Page 2 view corridor would be a condition of development and would be allowed only in those circumstances where existing grade elevations or the presence of sensitive habitat on a site would preclude the construction of a residence at elevations lower than those of the adjacent roadway. Again, where these constraints exist, the staff would prepare a recommendation that would include a condition for the provision of such a view corridor. The recommended condition would most likely require an applicant to provide an open space view corridor in the form of a recorded restriction against the deed for the property. The restriction would prohibit the erection or placement of any materials which would impede views through the open space area from the adjacent street without the consent of the Commission or it’s successor in interest. It appears, from a preliminary review of your proposed subdivision (coastal permit application # 6-86-407), that the staff would recommend the use of the second (view corridor) method for preservation of the viewshed for the site. The elevations of the property in question make siting of a structure at an elevation lower than that of adjacent Adams Street very difficult indeed. The proposed tentative map does appear to satisfy, in terms of area width(s) and configuration(s), the open space view corridor requirements of the LUP. Obviously, a closer examination of the plan and the proposed “view corridors” will be required before a clear determination of their adequacy can be determined. This review is expected to take place shortly, with the preparation of a staff recommend*ation for the coastal development permit request. I would also like to remind’you that there may be other resource issues which arise in the staff review of the project. Scenic preservation is a primary issue addressed in the Agua Hedionda Land Use Plan but it is not the only resource issue related to the afea. The site slopes gently ved from Planned towards the lagoon and is iurrently vacant. The applicant has recei the City of Carlsbad appro,val for the Minor Subdivision (#730) and a Unit Development (#255).. 2. Scenic Preservatioh. Because Agua Hedionda Lagoon and the v surrounding the lagoon is both an environmentally sensitive area and recreational resource, it was the subject of a detailed LCP Land Use iewshed major Plan prepared by the City and c .tified by the Coastal Commission. The Aqua Hedionda Land Use Plan Se!: ,,it is not part of the Commission prepared Mello I or Mello II LCP segment; ri ler, it was a seg;.:ent prepared by the City in the typical LCP process. In regard to the site in question, Policy $ 8.3 of the LUP contains provisions for prL action of views from designated scenic corridors such as Adams Street. The' ;~licy calls for new development tw preserve existing views of -the lago.. from these corr:dors. The preferred method for preserving such views lies '1 the siting of all (portions of) structures on a site at an elevation which 's below that of the elevation of the .sdjacent scenic roadway. This woul; allow passers-by to see over the structure to the lagoon and surrounding are::;. The latter provision was included in the LUP because the existence of lots which lie between the roadway and the lagoon on which siting of structures below a "critical view elevation" would be difficult. This difficulty is due to either, the limited size, and the topographical elevations of the parcel or, the existence on the parcels of steep slopes covered with native vegetation which are also afforded protection under the Land Use Plan policies. The applicable view preservation policies of the LUP are cited below. The site itself ranges in elevation from 29 feet to 54 feet (MSL). With the setback requirements of the City's ordinances, this lf.;!ited elevation differential eliminates the potential for constructio;! of even a single-story residence at an elevation below that of adjacent Ad: $,s Street. Therefore, the second, 'I view corridor", method of view preservati,.: would appear more appropriate for the subject property. There should be no exceptions to established conditions on such fundamentals as minimum lot size , grades, elevations, etc., certainly r& by administra- tive staff without hearings and a vote by the City Council to amend the plan. If the City Council wants to vote to reduce the minimum lot size (a major zoning change) or change the limit on building heights, (again, a major change), let them face the public in an open hearing, listen to the pros and cons, and vote on it. We live two blocks away and are not affected as to view, but feel very strongly about the character of this unique area and the scenic quality of the lagoon and its surroundings. Either there is a plan, as previously approved by the City Council, and in force, or there isn't any plan at all. Piecemeal attrition will make all the effort and thought that went into that plan a farce. R-1-15,000 zoning and no building height exceeding the grade level of Adams Street are very simple, easily understood requirements, with which anyone purchasing the affected property should be aware @'before closing escrow.
